Your state decides eligibility and how a particular payment arrangement affects a claim. Review your severance terms, file with the appropriate state unemployment agency, and report payments accurately when asked.

The U.S. Department of Labor says the Fair Labor Standards Act does not require severance pay and that severance is generally a matter of agreement between an employer and employee or their representative. Can severance delay or reduce unemployment benefits?
It depends on the state and the terms and timing of the severance. Do not assume that receiving severance automatically disqualifies you, nor that it can never affect your claim. The state may treat a lump-sum payment differently from salary continuation when evaluating eligibility, benefit amounts, timing, or reporting requirements. There is no single nationwide answer established here.
Check the current instructions from the unemployment agency where you worked and ask how your exact arrangement is treated. Older federal material documents historical differences among state approaches; it should not be read as a current rule for every state.

What to do after a layoff
- Read the severance paperwork. Identify whether the employer promises a lump sum, periodic salary continuation, or another form of payment. Note the dates, conditions, and any agreement or plan that applies.
- Find the correct state agency. In the usual case, file in the state where you worked. If you worked across state lines, worked remotely, or now live in a different state, ask the agency for filing instructions. USAGov’s unemployment benefits page directs workers to state programs.
- File promptly under that agency’s current instructions. A layoff is commonly a lack-of-work separation, but you still must meet state wage, work, availability, and other requirements. Many states also require job searching; confirm your state’s rules.
- Answer payment questions accurately. Report severance when the claim or agency asks about it. Do not hide it or describe it as something else. Ask whether your particular payment affects the claim’s start date, weekly benefit, or reporting obligations.
- Keep records and follow up. Save the severance agreement, payment dates, claim confirmation, and any agency responses. If the agency requests more information, respond by its deadline.
Are severance and unemployment taxable?
Both severance pay and unemployment compensation are generally subject to federal income tax. The IRS explains that unemployment compensation is taxable and that recipients can request federal withholding or make estimated tax payments; it is generally reported on Form 1099-G. See IRS Topic No. 418 and IRS guidance on what to consider after losing a job. Check current IRS and state tax instructions for the tax year in which you receive the money.
For unemployment compensation, voluntary federal withholding may be requested using Form W-4V, or you can consider estimated payments. The IRS notes that severance and unemployment compensation are generally taxable in its job-loss tax guidance. Tax withholding and state income-tax treatment can differ from the rules that determine whether severance affects unemployment eligibility.
