The more immediate problem is visibility: roughly 44% of surveyed companies could not determine whether their products contained chips made by foundries in China. Washington is investigating whether China’s rapidly expanding capacity could create future price pressure, supplier displacement and strategic dependence—not proving that China already controls every U.S. legacy-chip supply chain.
What “legacy” or mature-node chips are
Legacy, mature-node and foundational chips are made with established process technologies rather than the newest leading-edge nodes. “Mature” does not mean unimportant or obsolete. These components are often embedded in products designed for long service lives and lengthy safety or regulatory qualification.

A low-cost microcontroller, display driver, connectivity chip or power-management device can be a production bottleneck even when it represents a tiny fraction of a finished product’s cost.
What the U.S. government investigated
The Commerce Department and its Bureau of Industry and Security (BIS) conducted a supply-chain assessment; the separate U.S. Trade Representative (USTR) proceeding is a trade investigation. They should not be described as an import ban or a completed tariff case.

What BIS found about current exposure
The figures need to be read together. A product can contain a Chinese-foundry chip while Chinese-foundry devices remain a small share of all chips and of total component value.
| Measure | BIS finding | What it means |
|---|---|---|
| Respondents unable to identify PRC-foundry content | About 44% | Many companies cannot measure their own exposure reliably. |
| Surveyed products likely containing PRC-foundry chips | At least two-thirds | Presence is widespread among the surveyed products, not a claim about every U.S. product. |
| PRC-foundry chips by unit count | About 2.8% | Chinese-made devices were a small portion of all chips counted. |
| PRC-foundry chips by value | About 1.3% | The aggregate dollar share was smaller still. |
| PRC-foundry share of surveyed U.S. suppliers’ chip sales | Less than 2% | Surveyed suppliers reported limited sales exposure overall. |
BIS also reported that several suppliers were experiencing pricing pressure as Chinese capacity expanded. Its report estimated that China could account for nearly half of new mature-node capacity added over the following three to five years (BIS public report). That is a forecast about new capacity, not a prediction that China will capture half of global sales or installed capacity.

Why a small percentage can still disrupt production
Critical components are not interchangeable commodities
A product may use hundreds of semiconductors but depend on one specific power-management chip or controller. If that part is unavailable, the entire product can stop shipping. Replacing it may require a board redesign, software changes, new reliability tests and customer or regulator approval.
Visibility often ends above the wafer fab
Companies commonly buy through distributors, contract manufacturers or system suppliers. A part number may not reveal where its wafer was fabricated, and a change of fab can occur without a visible commercial-name change. Assembly and testing may also occur in a different country from wafer fabrication.
Qualification takes time
Automotive, medical, aerospace and defense products can require months or years to qualify an alternative. The engineering and certification cost can exceed the price of the chip itself, making a nominally cheap substitute impractical in the short term.

Does China “dominate” legacy chips?
That headline requires qualification. The evidence supports saying China is pursuing dominance in mature-node production and is becoming a major source of new capacity. It does not show that Chinese companies manufacture all legacy chips or control every global market.

Ownership, wafer-fabrication location, assembly location and the product’s final shipping origin are separate facts.
USTR alleged that China uses market-share targets and other non-market or anticompetitive means in pursuit of semiconductor self-sufficiency and global dominance. Those are allegations under investigation, not a final adjudicated finding (USTR statement).

Why expanding Chinese capacity concerns Washington
- Potential overcapacity: Rapid, state-supported expansion could produce more chips than market demand supports.
- Price pressure: Lower-priced Chinese output could displace U.S. and allied suppliers even before it becomes a majority source.
- Supplier concentration: Reduced diversity can leave critical sectors vulnerable to a single region or group of suppliers.
- Hidden embedding: A Chinese-origin component may enter a defense, grid, medical or telecommunications product through a lower-tier supplier without the end customer knowing.
- Strategic dependence: Policymakers are concerned that commercially minor components could become difficult to replace during a geopolitical or trade crisis.
These concerns are the rationale cited by Commerce, BIS and USTR; they should not be confused with evidence of a specific Chinese-caused outage or failure.

Possible measures remain distinct from enacted policy. Options identified or raised in the government record include:
Free tools Windows power users keep installed
One-click scans. No signup required.
- Tariffs on selected Chinese semiconductor imports
- Restrictions on PRC semiconductors in U.S. government procurement
- Additional CHIPS Act support for domestic mature-node production
- Allied cooperation on supply-chain monitoring and traceability
- Disclosure requirements for sensitive components and manufacturing locations
- Targeted rules for defense, automotive, medical, aerospace, telecommunications, power-generation and grid applications
- Incentives for second-source qualification and domestic or allied capacity
A measure could target Chinese ownership, fabrication in China, particular process technologies, or a combination. Those choices determine who is covered and how easily companies can comply.

The trade-offs of tariffs or blanket restrictions
- U.S. manufacturers could face higher component costs before substitutes are qualified.
- Domestic fabs cannot immediately replace every imported mature-node part.
- Tariffs might shift sourcing to third countries without improving visibility into the wafer fab.
- Broad restrictions could create shortages in automotive, industrial or medical supply chains.
- U.S.-based companies operating fabs in China could be caught by definitions based only on location.
- Redesign, testing and certification can cost far more than the original chip.
- China could retaliate against U.S. semiconductor, automotive or technology companies.
How the CHIPS Act fits
The BIS survey was not an application for CHIPS Act funding. BIS said individual survey responses would not affect eligibility for CHIPS Act or other government funding (BIS survey information).
The findings can nevertheless inform future incentives. Commerce separately announced up to $6.165 billion in CHIPS incentives for Micron projects in December 2024, including expanded U.S. memory production and legacy DRAM relevant to automotive and industrial markets (Commerce Micron announcement). Domestic fabrication improves resilience, but packaging, materials, equipment and design may remain internationally dependent.
What manufacturers and procurement teams should check
- Map every critical part to its wafer-fabrication location and the owning company.
- Record assembly, testing and packaging locations separately from wafer origin.
- Obtain current supplier declarations rather than relying only on old part-number databases.
- Identify parts with no qualified second source and estimate redesign or requalification time.
- Require contractual notification before a supplier changes fab, package or sub-tier source.
- Check whether distributor substitutions are allowed under product certifications.
- Rank single points of failure by lead time, safety impact and qualification cost.
- Set inventory buffers based on realistic replacement time, not just the chip’s purchase price.
Software and data services can help normalize bills of materials and monitor supplier changes, but they do not replace supplier attestations, audits, engineering qualification or regulatory review. A distributor’s country-of-origin field may describe assembly or shipment rather than wafer fabrication.
What the investigation means now
The defensible conclusion is narrower than “China controls U.S. legacy chips.” The BIS assessment found hidden and widespread exposure in surveyed products, while the measured Chinese share of chip units and value was small. The strategic concern is what rapidly expanding Chinese capacity, pricing pressure and poor supply-chain visibility could do over time. USTR’s Section 301 investigation moves the issue from measurement toward possible trade and procurement remedies, but the cited record does not establish what final measures, if any, will be adopted.
