Trump’s Glyphosate and Phosphorus Order: What Executive Order 14387 Does and Doesn’t Do

Executive Order 14387 delegates Defense Production Act supply and allocation powers to the Agriculture Secretary for elemental phosphorus and glyphosate-based herbicides. It sets no quota or funding, and its implementation status is not yet confirmed.

Executive Order 14387, signed by President Donald J. Trump on February 18, 2026, and published in the Federal Register on February 23, 2026 (91 FR 8703–8705), uses Defense Production Act authority to protect the supply of elemental phosphorus and glyphosate-based herbicides. It delegates specified supply-priority and allocation powers to the Secretary of Agriculture. It does not set a production quota, a funding amount, or a named recipient company, and it does not by itself change what farmers pay or what consumers buy. For a household budget, the effect is indirect and still unfolding.

What the order actually authorizes

The order is short, and its operative powers are narrower than headlines often suggest. It invokes the Defense Production Act of 1950 and passes specified presidential authority to the Agriculture Secretary, with the stated goal of ensuring continued and adequate supplies of both materials.

The delegated powers

  • Contract performance: the Secretary may require performance of relevant contracts or orders that support national defense and supply.
  • Allocation: the Secretary may allocate materials, services, and facilities to promote national defense and maintain supply.
  • Priorities: the Secretary is directed to set nationwide priorities and allocations in consultation with the Secretary of War.
  • Implementing rules: the Secretary may issue or revise orders and regulations needed to carry the order out.

The limits written into the order

Several provisions constrain how these powers can be used. Section 4(b) states: “This order shall be implemented consistent with applicable law and subject to the availability of appropriations.” Section 2(d) states: “Accordingly, the Secretary shall ensure that any order, rule, or regulation issued under this section does not place the corporate viability of any domestic producer of elemental phosphorus or glyphosate-based herbicides at risk.”

The order also references immunity under section 707 of the Defense Production Act and says domestic producers must comply in accordance with 7 C.F.R. part 789. It states that it creates no enforceable private right or benefit, which means a private party cannot sue to enforce it. It does not specify output targets, dollar amounts, or which company would receive any allocation.

How the order ties phosphorus to defense and farming

The administration’s rationale runs along two lines. The first is defense. The order’s findings say elemental phosphorus is used in smoke, illumination, and incendiary devices; in semiconductor manufacturing relevant to radar, solar cells, sensors, and optoelectronics; and in some modern lithium-ion battery chemistries used in weapon-system supply chains.

The second is agriculture. The order describes elemental phosphorus as a precursor for glyphosate-based herbicides, which links the defense argument to crop production. These are the administration’s stated reasons. They are presented in the order and in the White House fact sheet summarizing it, not as findings from an independent review.

Figures to treat as administration claims

Two statistics in the order are frequently repeated and deserve careful handling:

  • More than 6,000,000 kilograms of elemental phosphorus are imported annually, according to the order itself (Executive Order 14387, 2026). This figure was not independently verified for this article.
  • The order says there is “only a single domestic producer” of elemental phosphorus and glyphosate-based herbicides, and that domestic production does not meet annual U.S. needs. This is an assertion in the order, not an independently verified market census.

If you see these numbers in commentary, check whether the writer is citing the order or an outside source. The order is the only source attached to them here.

Phosphate and elemental phosphorus are different materials

The order notes that the Department of the Interior designated phosphate a critical mineral on November 7, 2025, under the Energy Act of 2020. Phosphate and elemental phosphorus are related but distinct materials, and the two terms should not be used interchangeably. The order’s supply concern concerns elemental phosphorus and the herbicides derived from it.

Organic production: no change indicated

The USDA Agricultural Marketing Service states that herbicides containing glyphosate are prohibited in organic crop production under the National List framework. The materials reviewed for this article do not indicate that Executive Order 14387 changes organic production standards. The order concerns supply and Defense Production Act authorities, not the National List.

What it means for your money

The order gives no price, subsidy, or payment figure, so no direct cost to households or farm operations can be read from its text. Its practical effect would depend on whether USDA later uses the delegated powers to set priorities or allocations, and on how those actions affect glyphosate and elemental phosphorus supply and cost. Those downstream effects are not established by the order.

For a household budget, that means there is nothing to act on from the order alone. For anyone who owns stock in agricultural input or chemical producers, or who farms and buys these inputs, the useful question is whether implementing actions follow, and what they require of buyers and sellers.

Implementation status as of October 8, 2026

The sources available for this article do not establish which USDA orders, rules, or allocations, if any, have been issued under this delegation. Do not assume implementation has happened, and do not assume none has. Check these records directly:

  • The Federal Register, where USDA rules and notices are published, searchable for Executive Order 14387 and for the 7 C.F.R. part 789 provisions it references.
  • GovInfo, which reproduces the presidential document as published.
  • USDA announcements and any Agricultural Marketing Service notices on glyphosate or elemental phosphorus supply.

Authority, implementation, and rationale: keeping them separate

Coverage of this order often blends three different things. The table below separates them.

When an article says the order “requires” production or “protects” a company, it has moved from the first row into the second without evidence. The order’s own text is more limited.

Bottom line

Executive Order 14387 gives the Agriculture Secretary Defense Production Act tools to prioritize and allocate elemental phosphorus and glyphosate-based herbicides, subject to law, appropriations, and a safeguard for domestic producers. It sets no quota, funding, or named beneficiary. Its supply figures are the administration’s claims. Whether it changes costs or availability depends on implementing actions that the sources reviewed do not confirm.
