The Trump administration’s 2025 pause disrupted the federal NEVI program, but court orders later restored or protected access to funding for some states. A California Energy Commission document proposed a $1,590,348 NEVI grant to Tesla for 40 public fast-charging ports; it does not establish that Tesla received the money or show a nationwide Tesla total.
What the NEVI program funds
Congress appropriated $5 billion for the National Electric Vehicle Infrastructure (NEVI) Formula Program in the 2021 Infrastructure Investment and Jobs Act. It is a state-administered program intended to build a connected network of EV chargers and improve charging access and reliability. The Government Accountability Office’s decision on NEVI describes the program and its administration; the Department of Energy’s program overview explains its network purpose.
NEVI formula funding is distinct from the separate Charging and Fueling Infrastructure (CFI) grant program, which awards discretionary grants. A state may use federal funding for projects involving private companies, but that does not mean the federal government directly paid a company.
How the funding pause unfolded
- January 20, 2025: President Trump’s executive order directed a pause in certain disbursements under the Infrastructure Investment and Jobs Act and Inflation Reduction Act, including EV-charging funds.
- February 6, 2025: The Federal Highway Administration rescinded NEVI guidance and withdrew earlier approvals of state plans. The GAO says funds became unavailable while states awaited replacement guidance and submitted updated plans. See the GAO decision.
- June 2025: A federal judge ordered funding released for 14 states in a multi-state lawsuit. The preliminary injunction did not cover every plaintiff jurisdiction, so it was not a nationwide restoration. The Associated Press report on the ruling describes its scope.
- January 2026: California and Arizona officials announced further court developments. California’s Department of Justice said a January 23 order ensured access to $379 million in previously awarded EV-charging infrastructure funds. Arizona’s Attorney General said a January 27 ruling found the Transportation Department had illegally withheld infrastructure funds. These are state officials’ summaries of court action, not evidence that every state’s funding status was identical.
What the Tesla grant document actually says
The California Energy Commission’s 2025 grant request names Tesla, Inc. as the proposed recipient of $1,590,348 under California’s NEVI Formula Program. The proposal covers installation, operation, and maintenance of 40 public DC fast-charging ports at sites in Copperopolis and Campbell. It lists an agreement start date of October 8, 2025, and an end date of March 31, 2032; the proposed commission meeting date is also October 8, 2025. The CEC grant request RNEV-25-002 is the basis for these details.

This is a proposed state grant request, not proof that the grant was approved, that funds were disbursed, or that the federal government paid Tesla directly. It also cannot establish a nationwide total for Tesla. The record supports the narrower statement that California proposed this amount for this project.
Is NEVI funding still available?
FHWA’s October 1, 2025 notice for fiscal year 2026 listed $1 billion appropriated for NEVI. After a stated $15 million administrative retention and a $100 million set-aside for additional assistance, the notice listed $885 million for distribution to states. These figures describe amounts apportioned or available for distribution, not money proven to have been obligated, awarded, or spent. The details appear in FHWA Notice N 4510.909.

California’s January 2026 announcement referred to $379 million in previously awarded EV-charging funds covered by the court order. Arizona separately reported that Phoenix’s $15 million CFI grant had been selected but not sent. That Phoenix award is a CFI grant, not NEVI formula funding, and should not be added to the NEVI figures. How to read the headline’s “gave Tesla millions” claim
- Established: California’s CEC proposed a $1,590,348 NEVI grant to Tesla for a 40-port public charging project.
- Not established by that request: approval or payment of the grant, a direct federal payment to Tesla, or Tesla’s cumulative awards across the country.
- Program status: The 2025 pause made funds unavailable pending new guidance and updated plans; subsequent court orders addressed access for particular states, and FHWA later listed FY2026 NEVI funding for distribution.
