President Donald Trump’s October 5, 2026, executive order could temporarily defer federal diesel excise-tax payments for certain dyed-diesel transactions and direct the IRS not to impose specified penalties for highway use. It does not automatically make red-dyed diesel available to every driver, erase the tax debt, or guarantee lower pump prices. Eligibility, deadlines and other conditions depend on Treasury and IRS guidance, while state rules, fuel access and supply will shape any savings.
What did Trump’s diesel order change?
The order, titled “Emergency Tax Relief on Diesel Fuel,” directs Treasury to determine within five days whether relief is authorized under Internal Revenue Code section 7508A. If Treasury makes the required determinations, certain diesel excise-tax payment obligations incurred from October 5 through December 31, 2026, would be deferred. The order also directs the IRS to announce that it will not impose specified penalties for dyed diesel sold for or used on highways during that period. Both mechanisms are conditional and subject to applicable law. Read the executive order.
The White House described the action as temporarily opening highway use of tax-free dyed diesel. But the operative order is narrower than President Trump’s public statement that anyone could buy red diesel for any reason: it calls for conditional payment deferral and penalty relief, not an unconditional repeal of the tax. It also asks Treasury to explore ways, including legislation, to eliminate the repayment obligation. Until that happens, deferral should not be confused with forgiveness. The White House release.
What remains to be specified
Treasury’s implementation guidance is expected to define who and what is covered, the locations and activities included, applicable conditions and postponed-tax deadlines. The order and reviewed official materials do not themselves settle those details. Whether the deferred amount must later be paid, and whether it will ultimately be forgiven, remain unresolved.

What is red-dyed diesel?
Dyed diesel is fuel marked with red dye so authorities can identify diesel sold for tax-advantaged off-road use. The fuel is described as nearly identical to regular diesel aside from the dye. Under ordinary rules, highway use is restricted and penalties help prevent drivers from avoiding fuel taxes. CBS coverage and ABC coverage describe the fuel and the rules.
The federal diesel excise tax is 24.4 cents per gallon, a rate cited by the White House from the U.S. Energy Information Administration. That sets the scale of the federal tax component: at the full rate, a 150-gallon fill represents $36.60, and a 250-gallon fill represents $61. Those are arithmetic illustrations, not guaranteed savings. Actual benefits depend on eligibility, availability, state policy and whether sellers pass through the full amount.

Will it lower diesel costs?
Some covered buyers could pay less if the tax relief applies to their purchase and the benefit reaches the retail price. But the federal tax difference is only one part of what buyers pay, and the order does not increase the amount of diesel available. Patrick De Haan, a petroleum expert at GasBuddy, told CBS: “It might lead to savings for some, but there are a lot of details that will prevent this from having widespread relief.”
Farmers may see less incremental benefit
Farmers already use dyed diesel for much of their off-road equipment, according to De Haan’s comments to CBS. For those existing users, the order may provide less new savings than it could for an on-road buyer newly permitted to use the fuel under the eventual rules.

Access and state rules matter
Dyed diesel is sold at a limited set of locations, ABC reports. The order calls for federal transportation officials to engage with states and encourages states to adopt corresponding policies, but state rules vary. That may complicate use for people who travel between states, including interstate truckers: a policy change in one state does not by itself establish the rules elsewhere. Check the relevant federal guidance and state requirements before relying on the fuel for highway travel.
Supply and prices limit the effect
Opening a fuel-tax benefit to more buyers does not create more supply. Tom Kloza, Gulf Oil’s chief energy adviser, told CBS on October 6, 2026, that U.S. diesel inventories were about 105 million barrels; that is his dated estimate, not a current inventory reading for later dates. Experts quoted by ABC also warned that increased demand without more available supply could blunt or offset price reductions.

The tax amount is modest compared with the diesel-price increase reported in September and October 2026. The Associated Press reported AAA’s national average at $6.52 per gallon on September 23, 2026, versus $3.77 immediately before the Iran conflict that month. CBS later reported AAA’s national average at $6.32 per gallon on October 6, compared with $3.76 before the conflict in September. These are separate dated snapshots. Even if an eligible buyer received the entire 24.4-cent federal tax difference, that would not offset the broader price increase. University of Tennessee business economics professor Timothy Fitzgerald told ABC that tax relief would help but would not offset the underlying price difference.

Any effect on grocery bills would be indirect: lower fuel costs could reduce some transportation expenses, which are only a small part of food costs. ABC quoted Michigan State University food economist David Ortega describing expected grocery-price relief as “negligible.” The more plausible near-term effect, if the rules and market conditions allow it, is direct fuel savings for some buyers—not a broad reduction in store prices.
