The Trump Organization’s online Trump Store listed a red “Trump 2028” hat on April 24, 2025, weeks after Donald Trump said he was “not joking” about a possible third term. The listing is political merchandise—not an announcement of a candidacy, and not evidence that a third presidential election would be allowed under the Constitution.
What the Trump Store listed
The Trump Organization’s online store listed the hat on April 24, 2025. The store’s current Trump 2028 Hat product page describes a high-crown embroidered hat with a snap closure and flag embroidery on the side, and says it is made in America. Its product copy reads, “The future looks bright! Rewrite the rules with the Trump 2028 high crown hat.”
When accessed on October 7, 2026, the page showed the hat in stock for $55. ABC News, CBS News and Axios reported a $50 price when the listing appeared in April 2025. Those are prices from different dates; the live price and availability can change. The store’s own description is not an independent quality assessment.
The Guardian reported that the store also offered “Trump 2028 (Rewrite the Rules)” T-shirts in navy and red for $36 in April 2025. That is a historical price, not a current offer.

What Trump said about a possible third term
In a March 2025 NBC News interview, Trump said there were “methods” by which he could serve a third term. Asked about a scenario in which Vice President JD Vance ran for president and later passed the office to him, Trump replied, “Well, that’s one,” then added, “But there are others, too. There are others.” He also said it was “far too early to think about it.”
On March 30, 2025, Axios reported that Trump, asked about the NBC comments aboard Air Force One, said, “I’m not looking at that,” and did not want to discuss a third term then. The merchandise listing followed on April 24. CBS News reported that Trump’s political operation posted a photo of Eric Trump wearing the hat; Eric called the merchandise “master trolling” and added “#NeverSayNever.”

Does the hat mean Trump announced a 2028 run?
No. A product listing shows that the Trump Organization was marketing 2028-branded merchandise. It does not establish a formal campaign announcement, a decision to run, or a viable legal route to another term. The comments and the hat are relevant political messaging, but neither changes the constitutional rules.
The Trump Store in the title is the Trump Organization’s online shop. It is distinct from a Trump-themed store in Bensalem, Pennsylvania, covered by the Associated Press in January 2026; that separate shop’s inventory does not establish what the Trump Organization’s website currently sells.

What the Constitution says about a third presidential election
The direct route is barred by the 22nd Amendment
The Twenty-Second Amendment states: “No person shall be elected to the office of the President more than twice.” That is the constitutional limit relevant to a conventional bid for election to a third term. Selling a hat does not amend or override it.
The proposed vice-president succession theory is disputed
The suggestion that a vice president could become president and then pass the office to someone already elected president twice is not an established loophole. The Twelfth Amendment says that a person constitutionally ineligible to be president is ineligible to be vice president. Reporting by CBS News described the succession theory as untested and heavily debated; Axios noted competing scholarly interpretations of the constitutional language. It should not be treated as a confirmed plan or settled legal route.

Changing the limit would require an amendment
A constitutional amendment under Article V can be proposed by two-thirds of both houses of Congress and must then be ratified by at least 38 states, according to The Guardian’s explanation of the process. That is a separate and demanding political process; the hat listing itself has no effect on it.
