Trump Administration Is Easing the Path to Deep-Sea Mining—but Has Not Approved a Mine

The administration is making U.S. seabed mineral projects easier to pursue. NOAA’s review of a TMC USA application is still underway, with public comment and further decisions ahead.

Yes, the Trump administration is trying to make U.S. deep-sea mineral projects easier to pursue, but no commercial mine has been approved through the process described here. A January 2026 NOAA rule lets eligible applicants seek exploration and commercial recovery authorizations together. As of NOAA’s October 2026 update, The Metals Company USA’s Clarion-Clipperton Zone application had passed an information-requirements review, but still faced public comment, additional certification findings and, if certified, an environmental impact statement.

What the administration has changed

An April 24, 2025, executive order, “Unleashing America’s Offshore Critical Minerals and Resources,” made seabed mineral development an administration priority. NOAA followed with a final rule on January 21, 2026, changing how eligible applicants can pursue U.S. authorizations.

Under the new option, an applicant may submit a consolidated application for an exploration license and a commercial recovery permit rather than follow only the earlier sequential route. The rule changes the application pathway; it does not itself grant a license or permit, waive later findings, or establish that a project is environmentally acceptable.

Where the TMC USA application stands

NOAA says The Metals Company USA (TMC USA) submitted a consolidated application on February 6, 2026, for proposed activity in the Clarion-Clipperton Zone (CCZ), a central Pacific region between Hawaii and Mexico. NOAA’s October 2026 update says its technical review found the application compliant with applicable information requirements. That is a threshold review of the application’s information, not approval to mine.

As of October 8, 2026, NOAA’s public-comment period was still open. The agency set October 19, 2026, as the comment deadline and announced a virtual public hearing for October 13, 2026. NOAA says it must still make specified findings about the applicant’s financial responsibility, technological capability and plans. If it certifies the application, NOAA would then assess environmental impacts in an environmental impact statement, with another opportunity for public comment.

  1. Information review: NOAA determined the submitted application met applicable information requirements.
  2. Public input: The comment period runs through October 19, 2026; NOAA announced a virtual hearing for October 13.
  3. Certification findings: NOAA must assess financial responsibility, technological capability and the applicant’s plans.
  4. Environmental review, if certified: NOAA says it would prepare an environmental impact statement and provide further public-comment opportunities.
  5. Commercial recovery authorization: The application’s current status does not mean this final authorization has been issued.

NOAA Administrator Neil Jacobs described the agency’s approach by saying, “NOAA is proud to set the global standard for science-based deep sea mining practices.” That is the administrator’s characterization of the agency’s approach, not an independent determination that the proposed project is safe or approved.

What deep-sea mining targets

“Deep-sea minerals” covers different deposits in different habitats. Their location and geology matter because they affect what would be collected and what environments could be disturbed.

NOAA’s maps of prospective mineral areas are predictions based on geological and oceanographic criteria. They do not prove that a deposit is present at a particular site, or that it could be recovered economically. Potential applications in batteries, electronics, defense systems and renewable-energy technology help explain the strategic interest, but do not establish future production, market share or reduced dependence on other suppliers.

Which rules apply depends on where mining would occur

U.S. authority is not the same everywhere in the ocean. The Clarion-Clipperton Zone application and the separate American Samoa proposal must not be treated as if they concerned one legal area.

Areas beyond national jurisdiction NOAA administers U.S. licenses and permits under the Deep Seabed Hard Mineral Resources Act (DSHMRA). The International Seabed Authority (ISA) has a role under the Law of the Sea Convention for countries that are party to it; the United States has not joined that convention.
U.S. waters, including offshore areas under U.S. jurisdiction NOAA identifies the Outer Continental Shelf Lands Act, administered by the Bureau of Ocean Energy Management (BOEM), as the primary authority for offshore mining in U.S. waters.
American Samoa proposal Associated Press reporting described the U.S. push as departing from the ISA-centered framework used by many other countries and reported that the ISA had authorized exploration contracts, but not commercial mining. That international context does not make American Samoa waters and international waters the same jurisdiction.

What is known—and uncertain—about environmental effects

NOAA identifies plausible harms from seabed collection and related operations, including disturbance of sediment, destruction of benthic habitat, plumes that affect seafloor and deep midwater communities, smothering, toxic-metal bioaccumulation, changes to food supplies and harm to marine life. It also says underwater noise and light effects have not been thoroughly studied, and that the spatial and temporal scales of impacts remain undetermined.

  • Persistent physical disturbance: NOAA reported in 2025 that dredge marks from equipment tests in a manganese-nodule area appeared unchanged up to 50 years later. This is an observation from a particular site, not a universal recovery estimate for every seabed or mining method.
  • Different habitats may recover differently: NOAA cautions that deep-sea corals and sponges may take hundreds of years to regenerate after damage, if they recover at all. Some vent ecosystems may begin recolonizing within years to decades. These are different recovery profiles, not one timeline for all deep-sea life.
  • Large gaps remain: NOAA says more information is needed on plume transport, effects of processing at the surface, fisheries, cultural heritage, and connections among seafloor, midwater and surface ecosystems.
  • Limited mapping: NOAA reported in 2025 that 26% of the global seafloor had been mapped to modern bathymetric standards as of January 2024. That is a mapping-coverage statistic, not the share suitable for mining.

NOAA’s January 2025 fact sheet said no commercial-scale deep-sea mining had occurred globally as of that fact sheet’s date. Because that statement is dated, it should not be read as a verified account of global activity in October 2026. The available environmental evidence identifies credible risks, but NOAA also says the significance and extent of impacts are not yet determined. Uncertainty is not proof either that mining is safe or that every proposed operation will cause the same outcome.

What this could mean for critical-mineral supply and personal finances

The administration’s policy direction may matter to investors, manufacturers and consumers watching critical-mineral supply chains. But the current application status does not support a prediction that seabed minerals will soon change mineral availability, company earnings, investment returns or consumer prices. No commercial recovery permit has been established by the NOAA update described above, and the cited material does not establish project economics, comparative environmental costs, future production volumes or a timeline for supply.

For anyone evaluating a company or investment tied to seabed mining, distinguish a policy announcement or permit application from an operating mine. The relevant questions are whether the project has the required authorizations, what environmental review finds, whether deposits can be recovered economically, and whether downstream processing and sales are feasible. A favorable policy signal alone answers none of those questions.
