Short answer: TikTok’s U.S. operation is now run by TikTok USDS Joint Venture LLC, a majority-American-owned company established on January 23, 2026. ByteDance still owns 19.9% of the venture; it did not disappear from the ownership structure. The new entity says it has authority over U.S. user-data protection, software security, content moderation, and the U.S. recommendation system. TikTok is still intended to work as part of the global service, so users should not expect a wholly separate American app.
What changed, and when?
The change followed years of legal and political dispute over ByteDance’s ownership of TikTok and the risks that U.S. user data or the platform’s recommendation system could be subject to foreign influence. Congress passed the Protecting Americans from Foreign Adversary Controlled Applications Act in April 2024, creating a divestiture route for TikTok. After a proposed U.S. joint-venture structure was approved by executive order in September 2025, TikTok USDS Joint Venture LLC announced its establishment on January 23, 2026.
The earlier U.S. Data Security program had already used Oracle Cloud and included code-review arrangements. The 2026 transaction is therefore a change in ownership and governance built on existing security efforts, not the first time TikTok stored U.S. data in the United States. Who owns and controls TikTok’s U.S. operation?
The venture’s disclosed ownership makes “U.S.-owned” shorthand for majority American ownership and control of the U.S. operation—not total American ownership of TikTok or the global company. The three managing investors are Oracle, Silver Lake, and MGX, each with a 15% stake. ByteDance holds 19.9%; other consortium participants hold the balance.

The joint venture has a seven-member board: Shou Chew, Timothy Dattels, Mark Dooley, Egon Durban, Raul Fernandez, Kenneth Glueck, and David Scott. The White House said ByteDance could select one director and would be excluded from the security committee. The venture identifies Raul Fernandez as independent director and chair of that committee. Adam Presser is CEO and Will Farrell is chief security officer. The ownership announcement and the White House fact sheet describe the structure.
Oracle does not own TikTok, and the U.S. government does not own the venture. Oracle’s role as investor and security provider is distinct from the venture’s corporate ownership and government oversight.
What changes for users?
Data governance and security
TikTok USDS says U.S. user data is protected in Oracle’s U.S. cloud under a dedicated privacy and cybersecurity program. It says the program is audited and certified by outside cybersecurity experts and aligned with standards including NIST CSF, NIST 800-53, ISO 27001, and CISA requirements. The venture announced ISO 27001 certification on April 18, 2026. These are security controls and a compliance milestone, not proof that every national-security concern has been resolved.
Data location alone does not answer who can access data, who grants permissions, who can change software, how information is used, or what happens if a control fails. The venture’s official site describes its security program; its newsroom lists the certification announcement.

Recommendation system
The joint venture says it will retrain, test, and update the U.S. recommendation algorithm using U.S. user data, secure it in Oracle’s U.S. cloud, and monitor software updates, data flows, and recommendation models. The White House says the new entity controls operation of the algorithm and U.S. content-moderation decisions.
That is not the same as proving TikTok has built a wholly new recommendation system independent of ByteDance technology. Earlier White House descriptions said the recommendation technology would be licensed and adapted. Public announcements do not fully disclose the technical architecture, model weights, training data, evaluation methods, or the extent of any continuing ByteDance involvement. The careful description is that the U.S. venture says it controls, secures, and retrains the U.S. system—not that the public has independently verified a fully separate algorithm.
Moderation and software updates
The venture says it has decision-making authority over U.S. trust-and-safety policies and content moderation, and that Oracle will support source-code review and software-assurance protocols. That could matter for guideline enforcement, appeals, political content, misinformation, transparency reporting, and the relationship between U.S. and global policies. The public announcement does not provide a full comparison of old and new moderation rules, so it does not establish that moderation will become more permissive, more restrictive, or less controversial.

TikTok’s earlier security explanation described Oracle and independent inspectors’ access to app code, backend services, third-party libraries, and recommendation algorithms.
Privacy policy and permissions
The joint venture published “Understanding TikTok’s U.S. Privacy Policy” on February 6, 2026. A policy announcement by itself does not show that TikTok collects less information. For practical privacy choices, review the current policy and in-app controls for location, contacts, camera and microphone access, personalized advertising, data access, and deletion. Consider permissions separately for each feature: a location-based discovery or booking tool may involve different information from simply watching videos. Public summaries alone do not establish every policy detail, retention period, or cross-border data flow.

What will users actually see in the app?
The intended model preserves interoperability with global TikTok. U.S. users are meant to retain a global experience, including the ability for international audiences to discover U.S. creators. TikTok’s global U.S. entities will continue to manage certain commercial activities, including e-commerce, advertising, and marketing. That makes an immediate new app name, separate social graph, or U.S.-only video catalog unlikely. The venture describes this arrangement in its announcement.
Some changes may be invisible to users: corporate authority, data permissions, cloud infrastructure, recommendation-model testing, code review, moderation governance, and security audits. The venture also announced visible product developments:
- Local Feed: announced February 12, 2026. The newsroom confirms the product announcement, but does not establish uniform availability, precise location signals, whether location permission is required, creator opt-out options, or whether ranking is separate from the For You feed. Do not assume every account or device sees the same feature.
- TikTok GO: announced May 13, 2026, as a way to discover and book experiences. It represents a move toward transactions and local commerce, not a direct consequence of the ownership change alone.
Both announcements appear in the USDS newsroom. Users should check the current app version, feature settings, and permission prompts rather than assume a feature works identically for everyone.
Is American ownership a privacy guarantee?
No. The restructuring addresses a specific concern: whether a foreign-adversary-owned parent could control the U.S. operation or influence sensitive systems. It does not establish that TikTok collects less data than before, eliminate advertising tracking, prevent every breach, or create a comprehensive U.S. consumer privacy law.

Privacy-conscious users can review permissions and advertising controls, limit optional access, and use available data-download or deletion tools. A business or creator should also consider whether it can reach customers through channels it controls, such as a website or email list, rather than relying on one social platform.

What creators and businesses should watch
The restructuring is relevant to creators, advertisers, sellers, and local businesses because the service is intended to remain globally connected while its U.S. governance changes. U.S. creators may continue to reach international viewers, but the public announcement does not guarantee that recommendation behavior, eligibility rules, or commerce terms will remain unchanged.

- Businesses and advertisers: assess whether TikTok reaches the intended audience and produces measurable sales or discovery. Recheck advertising, measurement, and data-access terms before making a substantial commitment.
- Sellers: review current commissions, fulfillment, returns, and promotional terms before depending on TikTok Shop; costs vary by category and program.
- All users investing in the platform: keep customer relationships portable and maintain another channel. A changed ownership structure is not a guarantee of permanent regulatory stability.
The deal does not require a business to buy new infrastructure or advertise on TikTok. Oracle Cloud is an enterprise infrastructure service, not a consumer TikTok growth subscription; TikTok’s business advertising platform and U.S. seller portal are separate services with their own current terms.
What does this mean for government devices?
In July 2026, the Justice Department’s Office of Legal Counsel concluded that TikTok USDS Joint Venture is not covered by the federal No TikTok on Government Devices Act because ByteDance does not control it and the venture operates independently. The opinion says the U.S. entity revised its recommendation algorithm and cybersecurity program with the aim of insulating federal information. Read the OLC opinion for its reasoning.
That opinion does not mean TikTok is allowed on every government or contractor device. Federal procurement rules still contain restrictions on “ByteDance covered applications” on executive-agency technology and certain federal-contractor systems. State rules, agency policies, military and intelligence policies, and employer or school restrictions may also differ. Consult the applicable rule or contract, including FAR Subpart 4.22 and FAR clause 52.204-27, rather than treating the DOJ opinion as blanket permission.
What remains uncertain?
The formal structure is clearer than the technical and contractual details. ByteDance has a 19.9% stake and one board seat under the announced arrangement, while the White House says it is excluded from the security committee. Public sources do not fully explain the surviving technology-licensing terms, who controls updates to the global codebase, what access global employees may have to U.S. systems, or how the venture can resolve conflicts with global TikTok over product or policy decisions.

There is also no public evidence in the cited announcements that lets readers measure how much the U.S. recommendation system’s behavior has changed. Useful evidence would include independent audit summaries, model documentation, training-data descriptions, foreign-influence tests, before-and-after evaluations, and researcher access to platform data. Until such evidence is public, algorithm-independence claims should be attributed to the company or the government rather than treated as independently verified outcomes.
Nor does the U.S. venture’s announcement establish the treatment of other ByteDance-linked services such as CapCut or Lemon8. The cited government-device opinion addresses TikTok USDS Joint Venture, not every app with a ByteDance connection.
How to judge the change over time
For users, the most informative signs will be concrete disclosures and product behavior—not just ownership language. Watch for public audit reports, privacy-policy changes, recommendation-system documentation, moderation transparency reports, app-update differences, and whether U.S. and global policies diverge. For creators and businesses, track reach, conversion, and policy terms in your own account data, and keep an alternative route to customers available.
The U.S. restructuring is a real corporate change with stated security and governance consequences. Whether it produces a measurably different feed, stronger privacy in practice, or durable regulatory certainty depends on details and evidence that public announcements have not fully supplied.
