Yes. TikTok remains available in the United States. The decisive step was not the September 2025 announcement of a proposed framework, but the establishment of TikTok USDS Joint Venture LLC on January 22, 2026. The new entity is majority-owned by investors other than ByteDance, which retains a 19.9% stake. The restructuring allowed the U.S. operation to continue under a new ownership and governance structure; it was not a sale of ByteDance or the global TikTok business.
What deal was reached?
TikTok’s U.S. operations were transferred into TikTok USDS Joint Venture LLC, established on January 22, 2026. The venture says it is responsible for U.S. data protection, algorithm security, content moderation, and software assurance. Its formation followed a September 2025 framework announced by the White House; that announcement described a proposed structure, while the January establishment made the new entity a reality. Silver Lake’s announcement confirms the establishment date and stated responsibilities.
This was a restructuring of the U.S. operation, not a purchase of all of TikTok. The White House said the structure qualified as a divestiture under the law and would separate the U.S. application from foreign-adversary control. That is the administration’s legal determination, not proof that every concern about the platform has disappeared. The September executive order sets out the administration’s rationale and proposed safeguards.

The White House described a seven-member board and said ByteDance could select one director; it also said ByteDance would be excluded from the venture’s security committee. Oracle’s 15% ownership and its infrastructure and security role are separate things: the White House described Oracle as a U.S. security provider that would monitor and assure the safety of U.S. operations, not as the owner of TikTok’s entire recommendation technology. Why was TikTok facing a U.S. ban?
Congress enacted the Protecting Americans from Foreign Adversary Controlled Applications Act in 2024. It required TikTok’s parent, ByteDance, to divest the U.S. operation through a qualifying arrangement or face restrictions that would make the app unavailable in the United States. The law reflected national-security concerns about access to U.S. user data, corporate control, and the possibility of influence through a major recommendation-driven platform. Those concerns were the basis for government action; they should not be confused with a finding that TikTok had been proven to spy on every American user.
TikTok briefly became unavailable around the law’s January 2025 effective date. The incoming Trump administration then directed the Justice Department not to enforce the law during a specified period while negotiations continued. That temporary non-enforcement was not the completed divestiture. The January 2025 White House order describes the enforcement delay.

What changes for users?
Access and the app
The arrangement was designed to keep the existing U.S. TikTok experience operating. The available announcements do not establish a mandatory nationwide replacement app for ordinary users. A corporate restructuring is not, by itself, an app relaunch. Users should rely on TikTok’s official notices and app-store listing rather than downloading unofficial apps presented as an “American TikTok.”
Data and security
The venture and the White House describe safeguards for U.S. user data, software, and operations, including a secure U.S. cloud environment provided by Oracle. These are stated protections and oversight arrangements, not an absolute guarantee that data can never be exposed or misused. The practical question is how the safeguards are implemented and enforced over time.

Feed, moderation, and privacy
The restructuring places algorithm security and content moderation among the new venture’s stated responsibilities, but it does not establish that users will see a specific redesign, different recommendations, or an immediate change in moderation. Privacy terms and product features may evolve; users should check TikTok’s current notices for changes that affect their accounts.
What happens to TikTok’s recommendation algorithm?
The public descriptions point to safeguards and operational control within the U.S. venture, not a simple transfer of all global TikTok algorithm intellectual property to an American owner. The Justice Department’s Office of Legal Counsel said the venture had revised elements of the recommendation algorithm and cybersecurity program in assessing a separate federal-government-device prohibition. That opinion concerns the government-device restriction; it is not a full public account of the algorithm’s licensing, code ownership, or day-to-day change process. Important details remain publicly unclear, including the precise licensing boundaries, who approves all software and model updates, and how U.S. recommendation systems may differ from international versions. Oracle’s security and infrastructure role does not establish that Oracle owns or independently writes TikTok’s global recommendation technology. On the available public descriptions, it is not possible to predict how much the average U.S. user’s feed will change.

The immediate outcome is continuity: creators, advertisers, and merchants can continue using the U.S. platform rather than planning around an imminent removal. The venture cited more than 200 million Americans and 7.5 million businesses as participants in the platform. That does not guarantee stable reach, sales, or revenue. Recommendation changes, moderation decisions, commercial policies, and future legal or geopolitical disputes could affect businesses even while the app remains available.

- Creators: Keep copies of important content and maintain ways to reach audiences outside TikTok. Continued access does not guarantee distribution or monetization.
- Advertisers: Review current platform terms and campaign settings; the restructuring does not guarantee campaign performance or settle every policy question.
- Merchants: Check current seller, fulfillment, returns, and compliance terms. TikTok Shop policies and charges can vary, so consult the official TikTok Shop seller site for current requirements.
- Businesses using paid campaigns: The official TikTok for Business site is the place to check current account options and campaign details; advertising costs are variable rather than a fixed subscription price.
For creators and merchants whose income depends on one platform, keeping an independent audience channel and diversifying distribution can reduce exposure to a future service or policy change. YouTube Shorts, Instagram Reels, Snapchat, and Pinterest can serve as additional channels, but their audiences and recommendation systems are not identical to TikTok’s.
Is ByteDance still involved?
ByteDance retains a 19.9% stake, so it has not vanished from the ownership picture. Under the announced structure, it no longer has controlling ownership of the U.S. venture; the White House also described limits on its board representation and exclusion from the security committee. Those formal arrangements are distinct from the broader technology and commercial relationships that may continue to matter when a U.S. operation is connected to a global platform.
For that reason, “ByteDance has no connection to U.S. TikTok” is too broad. The stronger supported statement is that the U.S. operation was placed in a majority-owned venture that the administration and company describe as independent, while ByteDance remains a minority shareholder.
What remains uncertain?
- Detailed contracts: Public announcements do not fully disclose all ownership, licensing, and operational terms.
- Technology boundaries: The precise division of rights and responsibilities for algorithm licensing, updates, model training, and software changes is not fully described publicly.
- Long-term independence: The ownership structure is one part of separation; ongoing governance and enforcement determine whether the safeguards work in practice.
- Product differences: The available announcements do not establish whether U.S. and international versions will diverge in features, moderation, or recommendations.
- Future scrutiny: Congress, courts, or a later administration could revisit the arrangement, and compliance disputes could reopen the issue.
The Justice Department’s Office of Legal Counsel separately concluded that the joint venture did not fall under the federal-government-device prohibition, citing majority American ownership, operational independence, and revised algorithm and cybersecurity arrangements. That opinion addresses a separate device rule; it does not settle every legal or political question about the divestiture. The opinion is available from DOJ.
