The SEC’s investigation into Fisker was closed in September 2025, according to a February 2026 report based on an agency response to a Freedom of Information Act request. Fisker’s Chapter 11 liquidation is a separate matter: the court confirmed its liquidation plan in October 2024, but claims and other case administration continued afterward.
Is the SEC still investigating Fisker?
According to TechCrunch’s February 13, 2026 report, the SEC said in a follow-up email responding to a FOIA request that its investigation “was closed in September 2025.” The agency’s response reportedly came after TechCrunch sought records in January 2026.
That is a reported closure date, not a public SEC announcement explaining the investigation’s outcome. TechCrunch said it was unclear how far the investigation had progressed and that an SEC spokesperson declined to comment. The reporting does not establish that the SEC found a securities-law violation or brought an enforcement action against Fisker in connection with this probe.
What the 21.7-gigabyte figure means
The SEC FOIA department reportedly said records related to the probe totaled approximately 21.7 gigabytes. That describes the volume of electronically maintained records identified in response to the request; it does not measure findings, evidence of misconduct, or the investigation’s significance.

What the SEC disclosed in 2024
In an October 2024 filing in Fisker’s bankruptcy, the SEC disclosed that it had sent the company subpoenas for documents as part of an investigation into possible violations of federal securities laws. The Commission also objected to aspects of the liquidation plan, asking that its regulatory powers be preserved in relation to the then-pending investigation and the preservation and production of company records. Those were procedural statements about an investigation, not a finding that Fisker or any person broke the law. The filing is summarized in an October 2024 report reproducing the SEC objection.
Why the bankruptcy case continued after the plan took effect
Fisker and certain affiliates filed for Chapter 11 bankruptcy protection in Delaware in June 2024. The case portal identifies June 17 as the petition date. The bankruptcy court confirmed the joint liquidation plan on October 16, 2024, and it became effective the next day. The Verita Global case portal lists later claims-administration and hearing activity in 2026.

Plan confirmation and effective date mark steps in a court-approved liquidation process; they do not necessarily mean every remaining administrative task ends immediately. Later claims and court activity are consistent with continued administration of the bankruptcy estate. They do not mean the SEC investigation remained open.
Fisker used the bankruptcy process to sell its remaining Ocean inventory to a company leasing vehicles to ride-hail drivers and to liquidate other assets, according to TechCrunch. The cited reporting does not establish all sale terms, proceeds, asset dispositions, or the current operating condition of vehicles.

What Fisker owners should not infer
The closure of the SEC investigation does not answer practical ownership questions. The cited sources do not establish current availability of Ocean repairs, replacement parts, warranty service, or other owner support. Nor do they show the present operating condition of individual vehicles. Owners should verify any service provider’s current operations and the specific scope of its services before relying on it.
For the same reason, the continuing bankruptcy case should not be treated as proof that a particular warranty or service remains available. Those questions require current, service-specific information, not just the status of the SEC probe or the liquidation docket.
