The headline’s “do it on Polymarket” punchline is satire, not advice: Polymarket’s rules prohibit several forms of insider trading, and federal authorities have announced a separate case alleging classified-information trades there. Kalshi’s case against a MrBeast editor was a platform sanction, not a criminal conviction.
What happened in the MrBeast editor case?
In February 2026, Kalshi said an account holder had traded about $4,000 on streaming markets tied to MrBeast videos with near-perfect success. Kalshi said the trader was a Beast Industries employee who likely had access to material nonpublic information. The Associated Press reported that Kalshi suspended the editor for two years, fined him $20,000 and notified federal regulators. TechCrunch identified the editor as Artem Kaptur and reported that the fine included $5,397.58 in profit and a separate $15,000 penalty. Kalshi says its surveillance flagged unusual activity and that users submitted tips. The company describes monitoring for anomalous timing, win-rate irregularities and coordinated activity. Does Polymarket allow insider trading?
No. Polymarket’s published Market Integrity rules prohibit trading on confidential information when doing so would breach a preexisting duty of trust or confidence; trading on illegal tips; and trading by people with enough authority or influence to affect an event’s outcome. The rules also prohibit fraud, market manipulation, front-running, self-dealing and misuse of information. In March 2026, the Associated Press reported additional guardrails: Kalshi said political candidates would be barred from trading on their own campaigns and sports participants blocked from related contracts; Polymarket clarified restrictions on confidential information and influence over an event. What is the federal case involving Polymarket?
On April 23, 2026, the Commodity Futures Trading Commission announced a civil complaint alleging that an active-duty Army service member used classified information about Operation Absolute Resolve to trade Maduro-related event contracts on Polymarket. The CFTC called it the first time it had charged insider trading involving event contracts. The Department of Justice separately announced an indictment concerning alleged use of classified government information. U.S. Attorney Jay Clayton said in the DOJ announcement: “Prediction markets are not a haven for using misappropriated confidential or classified information for personal gain.” CFTC Director of Enforcement David I. Miller said the case was the agency’s first insider-trading charge involving event contracts and its first use of the so-called “Eddie Murphy Rule” for charges based on misuse of government information. The answer depends on the conduct and applicable law, not just on a platform’s label or rulebook. A platform can prohibit trading under its own terms, while regulators or prosecutors may also allege violations of law. In the MrBeast case, Kalshi announced a suspension and fine; the available reporting does not make that a criminal conviction. In the separate Polymarket case, federal authorities announced allegations, not a final finding. Keep platform rules, platform enforcement and legal outcomes distinct.

A public comment filed with the CFTC argues that Kalshi, as a designated contract market, is subject to CFTC oversight and contrasts that with enforcement issues for decentralized markets. What the cases do—and don’t—show
- Kalshi said the MrBeast-related trades were suspicious and sanctioned an employee it believed likely had access to material nonpublic information. The accusation should not be described as a conviction.
- Polymarket’s rules prohibit specified insider trading and information misuse; the existence of those rules does not show that all violations are caught.
- Federal authorities have announced a separate Polymarket case involving alleged classified-information trades. The allegations remain distinct from adjudicated facts.
- These cases do not establish which platform has more insider trading. The available sources provide no comparable, independently verified rate for either platform.
