Not every crash requires a lawyer, and hiring one does not guarantee compensation or a larger recovery.
What a car accident lawyer can do
A lawyer may assess the facts and legal issues in your claim, help gather and present evidence, communicate or negotiate with insurers, and bring a lawsuit if needed. Which services matter depends on the case; representation does not guarantee a particular result.
There are two practical options: manage a straightforward claim yourself or consult a lawyer about whether representation would help. Consider how clear fault is, how serious or long-lasting the injuries are, whether coverage or evidence is disputed, how close a filing deadline may be, and whether you can manage insurer communications. A consultation does not commit you to hiring counsel.
When legal advice may be especially useful
- Fault is contested: Texas’s proportionate-responsibility rules can affect whether you recover and how much.
- Injuries are serious or ongoing: Medical needs and losses may be difficult to assess while treatment continues.
- Coverage is uncertain: More than one policy or type of insurance may be relevant, and policy terms matter.
- Evidence needs to be gathered or explained: A lawyer may help investigate the crash and present evidence about responsibility and losses.
- A filing deadline may be near: Insurer discussions do not necessarily preserve the right to sue.
These are practical considerations, not a legal test requiring you to hire a lawyer.

How Texas fault rules can affect recovery
Texas Civil Practice and Remedies Code Chapter 33 governs proportionate responsibility in covered tort cases. Section 33.001 states that “a claimant may not recover damages if his percentage of responsibility is greater than 50 percent.” In other words, the statutory bar applies when the claimant is more than 50 percent responsible—not when responsibility is exactly 50 percent. Read Texas Civil Practice and Remedies Code §33.001.
How responsibility is assigned depends on the evidence and the factfinder. A lawyer may investigate and present evidence, but cannot guarantee how fault will be decided.

Check your own insurance as well as the other driver’s
A claim against the other driver’s insurer is not the only possible source of benefits. Texas law generally requires auto policies to include personal injury protection (PIP) and uninsured/underinsured motorist (UM/UIM) coverage unless the named insured rejects each in writing. The coverage available in a particular crash depends on the policy, its limits and conditions, and the statutory requirements.
- PIP: Texas Insurance Code provisions address payment of specified reasonable expenses related to an accident. Check your declarations and policy documents to see whether PIP applies and what limits and conditions govern it.
- UM/UIM: This coverage may apply to qualifying losses involving an uninsured or underinsured vehicle, subject to the policy and statute. Check the declarations, endorsements, limits, and conditions.
The Texas Department of Insurance explains personal injury protection and uninsured and underinsured motorist coverage. A policy review is necessary to determine what coverage you have; the general rules do not establish an individual claimant’s benefits.
How long you have to sue after a Texas car accident
Texas Civil Practice and Remedies Code §16.003 generally requires a personal-injury lawsuit to be filed no later than two years after the cause of action accrues. The applicable accrual date, exceptions, parties, and type of claim can affect an individual case, so two years is a general rule rather than a universal calculation. Read §16.003.
Sending a demand or negotiating with an insurer does not necessarily preserve the right to file suit. If the deadline may be approaching, get case-specific legal advice promptly.

How car accident lawyer fees work in Texas
Texas Government Code §82.065 requires a contingent-fee contract for legal services to be in writing and signed by both the attorney and client. The cited law does not establish one standard percentage, and fee terms are not universal. Read §82.065.
Before signing, review the agreement’s terms for:

- How the attorney’s fee is calculated and when it is owed.
- How litigation costs and other expenses are handled.
- Which services and claims are included in the representation.
- What happens if you or the attorney ends the relationship.
Ask the lawyer to explain any provision you do not understand. Do not assume a particular fee percentage or that every cost is treated the same way.
What to ask before hiring a lawyer
- Who will handle my case and communicate with me?
- What work do you expect to do, and what information or evidence do you need from me?
- How does the written agreement calculate fees and expenses?
- What happens to fees, costs, and my file if either of us ends the relationship?
- Are there deadlines or coverage issues I should address now?
