The Future of Crypto Regulation: Opportunities and Challenges Around the World

Crypto regulation is converging on shared priorities, but implementation remains uneven. Here’s what global standards, EU MiCA and emerging policy reviews mean for consumers and firms.

Crypto regulation is moving toward shared priorities—consumer and investor protection, market integrity, financial stability, and anti-money-laundering controls—but there is no single global crypto rulebook. International bodies set standards and recommendations; jurisdictions decide how to implement them. The result is a patchwork that can make compliance clearer in some markets while leaving gaps and uneven protections in others. The EU’s MiCA framework shows what a regional rulebook can cover, and current reviews show how regulators are reassessing stablecoins, lending, DeFi, and large multi-function firms.

Why isn’t cryptocurrency regulated under one global rulebook?

Crypto markets operate across borders, but legal obligations are set and enforced by individual jurisdictions and regional authorities. International coordination can align priorities without creating a law that automatically applies everywhere. The Financial Stability Board (FSB) issues recommendations for authorities; the Financial Action Task Force (FATF) sets anti-money-laundering and counter-terrorist-financing standards. Each jurisdiction still has to put applicable rules into effect and supervise them.

The FSB’s 2023 framework covers crypto-asset activities and markets as well as global stablecoin arrangements. Its October 2025 peer review, based on information available through August 2025, found progress on regulating crypto-asset activities but less progress on global stablecoin arrangements, alongside meaningful gaps and inconsistencies. The FSB called for fuller, more consistent implementation and stronger cross-border coordination. Read the FSB’s thematic review.

The FSB warned that uneven implementation creates opportunities for regulatory arbitrage and complicates oversight of a global, evolving market. That is a regulator’s assessment of the risk—not evidence that every firm uses differences between jurisdictions to avoid oversight. The FSB’s 16 October 2025 release attributes this assessment to Arthur Yuen, Deputy Chief Executive of the Hong Kong Monetary Authority and chair of the team that prepared the report.

What do FATF standards mean for crypto transfers?

FATF’s Recommendation 15 addresses virtual assets and virtual-asset service providers (VASPs). Its standards inform national rules on risk assessment, licensing or registration, supervision, enforcement, and the sharing of originator and beneficiary information for certain transfers—the “Travel Rule.” They do not by themselves create one directly enforceable global licensing system.

In its 16 July 2026 update, FATF reported that 83% of surveyed jurisdictions had passed legislation implementing the Travel Rule, up from 73% in 2025; 11 additional jurisdictions said implementation was under way. Those figures measure reported legislative passage, not whether every jurisdiction’s supervision or enforcement is effective. FATF also identified continuing implementation difficulties and risks involving fraud, stablecoin misuse, peer-to-peer transactions through unhosted wallets, offshore providers beyond effective oversight, and DeFi arrangements. These are FATF’s identified concerns, not a claim that all crypto use involves those risks. See FATF’s Travel Rule figures and its 2026 update on Recommendation 15.

What does MiCA cover in the European Union?

The EU’s Markets in Crypto-Assets Regulation (MiCA) is a regional framework, not a global statute. It covers specified crypto-assets, issuers, and crypto-asset service providers where the relevant assets or services are not already governed by other EU financial-services legislation. Its requirements include transparency and disclosure, authorisation and supervision, and organisational, operational, and prudential obligations. The European Commission also identifies anti-money-laundering and counter-terrorist-financing obligations for covered service providers. The Commission’s MiCA overview describes the framework and its scope.

MiCA illustrates both the potential and limits of regional harmonisation: common requirements can give covered firms and customers a clearer reference point within the EU, but the framework does not settle how every jurisdiction outside the EU regulates crypto. Nor does an EU label alone establish that a particular provider is authorised for a particular service.

How to check an EU provider’s status

  1. Look up the provider and the relevant service in the current ESMA MiCA information and register links, and check the relevant national competent authority’s information.
  2. Do not assume that an old national transitional arrangement still permits a firm to operate. Member States could apply different transition measures to firms already operating under national law; the general grandfathering period described by ESMA ran until authorisation or refusal, or 1 July 2026, subject to the applicable provisions and national choice.
  3. Read any available crypto-asset white paper as a disclosure document, not as an endorsement. ESMA says white papers on its interim register have not been reviewed or approved by an EU competent authority.

What are the opportunities and challenges of crypto regulation?

Potential benefits

  • More predictable expectations: Clearer authorisation and conduct requirements can help firms plan compliance investment and understand what regulators expect.
  • More consistent cross-border operations: The Commission presents MiCA’s harmonised framework as a way to support innovation and cross-border scaling within the EU. That is an intended benefit, not a guarantee that every provider will be able to expand or succeed.
  • More usable information for customers: Disclosure requirements can make it easier to assess a covered product or provider, although disclosure cannot remove the underlying risks of a crypto-asset.

Costs and unresolved problems

  • Uneven implementation: Differences in timing, definitions, supervisory capacity, or enforcement can make it harder to oversee firms operating across borders. The FSB identifies regulatory arbitrage and oversight difficulty as risks arising from these gaps.
  • Compliance burdens: Authorisation, governance, operational controls, and prudential obligations require resources. The rules may improve clarity, but firms must still determine which requirements apply to their activities and jurisdictions.
  • Categories that do not fit neatly: Lending, DeFi arrangements, stablecoin networks, and businesses combining several crypto functions can challenge rules designed around a single issuer or service provider.
  • Protection is not uniform: A framework’s existence does not prove that every provider is authorised, every disclosure has been reviewed, or every rule is enforced effectively.

How are stablecoins, lending, DeFi, and multi-function firms entering policy reviews?

Regulators are examining how existing frameworks work as crypto markets and business structures evolve. A review priority or consultation is not the same as an enacted legal change.

Stablecoin arrangements The FSB found less implementation progress for global stablecoin arrangements than for crypto-asset activities. The European Banking Authority (EBA) has also highlighted risks from multi-issuer stablecoin schemes in its MiCA review priorities. Implementation gaps and review priorities; not a new global stablecoin law.
Crypto-asset lending and DeFi The EBA recommended considering regulation of crypto-asset lending, including DeFi-linked activity. FATF has separately identified implementation challenges involving DeFi arrangements. Review recommendation and FATF implementation concern, not an enacted MiCA amendment.
Multi-function groups The EBA has raised how MiCA should address groups combining functions and how the framework interacts with other EU law. The European Systemic Risk Board (ESRB) selected multi-function groups for financial-stability analysis, noting that concentration and scale may create macroprudential risks. Areas for review and risk analysis, not a finding that a crisis will occur.
Payments rules and MiCA scope The EBA has identified the interaction between MiCA and other EU law, including payments rules, as an issue for review. Review priority; no amendment is established by that recommendation.

The European Commission opened a consultation on how MiCA is functioning on 20 May 2026; it closed on 31 August 2026. The Commission said feedback would inform future policy work and an assessment of whether the framework needs updating. On 24 September 2026, the EBA published its review priorities, including scope and definitions, stablecoin arrangements, multi-function groups, payments-law interactions, and possible rules for lending. The ESRB’s October 2025 report examined stablecoins, crypto-investment products, and multi-function groups as financial-stability issues. It discussed possible stablecoin contagion channels and risks associated with concentration and scale in multi-function groups. Those are risk analyses, not predictions that a crisis will happen. How can consumers and businesses compare crypto rules across jurisdictions?

There is no reliable way to infer a provider’s legal status or a customer’s protections from a country’s general reputation as “crypto-friendly.” Compare the same practical questions in each jurisdiction, and verify the applicable regulator’s current rules and register rather than relying on a global standard or a firm’s marketing.

  • Scope and classification: Which assets and activities are covered, and how are tokens classified?
  • Authorisation: Which issuers or service providers must register or obtain permission, and are transition arrangements still available?
  • Provider duties: What disclosure, governance, custody, operational, and prudential requirements apply?
  • Stablecoins: What rules apply to issuers, reserves, and redemption?
  • AML/CFT: Which entities and transfers are subject to customer checks and Travel Rule requirements?
  • Supervision: Which authority oversees the activity, what enforcement powers does it have, and how does it coordinate across borders?
  • Newer activities: How does the jurisdiction treat DeFi, lending, and firms combining multiple crypto functions?

These questions also clarify what regulation can and cannot tell an individual customer: a legal framework can set obligations and disclosures, but it is not a guarantee of investment performance, a particular level of enforcement, or the safety of every service.
