Temu and Shein are facing a tougher EU compliance environment, but they are not at the same legal stage. As of August 16, 2026, Temu has received a €200 million European Commission fine under the Digital Services Act (DSA), while Shein is subject to a separate formal DSA investigation. Both also face wider consumer-protection, product-safety and customs measures that could affect prices, product availability and delivery models.
The short version
This is not one new EU law aimed only at Temu and Shein. It is the convergence of several regulatory tracks:

- Digital Services Act enforcement: stronger obligations for very large online platforms, including risk assessment, illegal-product controls and recommender-system transparency.
- Consumer-law enforcement: scrutiny of discounts, urgency messages, reviews, rankings, returns and trader information.
- Product-safety enforcement: closer attention to unsafe goods sold through cross-border marketplaces.
- Customs reform: new controls and a temporary €3 customs duty for qualifying low-value imports.
Temu has already received a final DSA penalty. Shein remains under investigation in the DSA case covered here; the opening of proceedings is not a final finding that Shein infringed EU law.
Why Temu was fined €200 million
On May 28, 2026, the European Commission fined Temu €200 million for breaching the Digital Services Act. The Commission said consumers were highly likely to encounter illegal products on the marketplace and found shortcomings in Temu’s assessment and mitigation of systemic risks, including risks linked to product recommendations and promotions.

The decision followed work including a mystery-shopping exercise and cooperation with customs and market-surveillance authorities. The Commission identified substantial safety failures among selected products, including chargers and baby toys. These findings are evidence relevant to the platform’s risk-management obligations; they do not mean that every product listed on Temu is illegal or unsafe.
The distinction matters. The fine concerns Temu’s responsibilities as a large platform: how it assesses risks, detects problematic listings, responds to them and designs systems that can promote or recommend products. It is not a declaration that every third-party seller or every item on the site has broken the law.
Temu was required to submit an action plan under Article 75 of the DSA by August 28, 2026. As of the reporting date of August 16, that deadline had not yet passed, so the plan should not be treated as filed or approved.

Why Shein is under investigation
On February 17, 2026, the Commission opened formal DSA proceedings against Shein. The investigation examines:
- potentially addictive design features;
- the transparency of Shein’s recommender systems;
- the circulation or sale of illegal products;
- protections for users, including minors; and
- compliance with platform transparency and risk-management duties.
Formal proceedings give the Commission investigative powers and do not establish liability by themselves. Based on the official material covered here, Shein had not received a final DSA penalty as of August 16, 2026.

Shein also faces a separate consumer-law track. In May 2025, EU consumer authorities notified the company about practices they considered potentially contrary to EU consumer law, including misleading discounts, fake urgency, incomplete or misleading information, and questions about reviews, rankings and ratings.

Why Temu and Shein are being discussed together
The platforms are prominent examples of a wider issue involving large non-EU e-commerce businesses. Both rely heavily on cross-border sales, third-party sellers and high volumes of relatively low-value parcels. Their business models can make it harder for consumers and authorities to identify sellers, verify product compliance and monitor thousands or millions of listings.
Both platforms also fall within the EU’s scrutiny of very large online platforms. Under the DSA, a very large platform generally means a service with more than 45 million monthly users in the EU. Such platforms have enhanced obligations because failures in their systems can affect consumers at scale.
The European Economic and Social Committee has described the rapid expansion of third-country platforms such as Temu and Shein as raising connected concerns about fair competition, consumer protection and regulatory compliance. The measures should not be described simply as a China-specific ban: the underlying rules generally apply to relevant cross-border e-commerce businesses regardless of nationality.
What the Digital Services Act requires
For very large platforms, the DSA is principally a systems-and-governance law. In practical terms, it requires platforms to build stronger processes for:

- assessing systemic risks created by their services;
- mitigating the spread or sale of illegal goods and content;
- explaining how recommender systems work;
- providing user reporting and notice-and-action mechanisms;
- publishing transparency information;
- cooperating with regulators; and
- giving researchers and authorities appropriate access to information.
Serious DSA violations can attract fines of up to 6% of a company’s worldwide annual turnover. The DSA does not replace product-safety law, customs law or ordinary consumer-protection rules. A platform can therefore face different obligations and investigations under different legal frameworks for related aspects of its business.

The other EU rules affecting these platforms
Consumer protection
The EU Consumer Protection Cooperation Network has challenged practices involving misleading discounts, fake countdowns or scarcity claims, reviews, returns and information about traders. These cases can result in demands to change interface design, commercial claims and disclosures even when the conduct is not handled as a DSA proceeding.

Product safety and trader traceability
Product-safety and market-surveillance rules provide separate tools for dealing with unsafe consumer products. Marketplaces are also under pressure to provide accurate information about the businesses selling through them and to help authorities identify responsible traders, particularly when goods are shipped directly from outside the EU.
This is why a platform’s responsibility and a seller’s responsibility should not be treated as identical. The DSA may address a platform’s recommendation or risk-management systems, while product-safety and customs rules may place duties on sellers, importers, distributors or the platform depending on the transaction structure.

Customs and import responsibility
The EU is also changing how low-value imports are controlled. The broader customs reform aims to improve data sharing and make platforms and sellers more responsible for customs formalities, duties and VAT rather than leaving consumers to deal with import procedures themselves.

From July 1, 2026, the former duty-free treatment for qualifying imports valued at €150 or less was replaced by a temporary customs measure. A €3 customs duty applies per item category or tariff heading in qualifying low-value consignments.
That does not mean every Temu or Shein order automatically costs exactly €3 more. One parcel can contain products in several categories and therefore generate several €3 charges. The Council’s example shows why a parcel containing different types of garments may attract multiple charges.
The temporary measure is scheduled to remain in place until July 1, 2028, alongside work on the longer-term customs system. Its effect depends on several factors:
- whether the product is imported from outside the EU;
- whether it is already held in an EU warehouse;
- the parcel’s value and customs treatment;
- how the goods are classified; and
- whether the platform includes the cost in the displayed price, shipping charge or checkout total.
Do not confuse the €3 duty with a handling fee. The customs duty is a separate measure from the future Union handling fee. Current guidance indicates that the handling fee is a separate measure expected no earlier than November 2026, with the final amount and implementation details requiring qualification.

Will Temu and Shein prices rise?
The defensible answer is that new regulatory and customs costs create upward pressure, but the effect will vary by product and platform. Possible responses include:
- raising displayed prices;
- adding a charge at checkout;
- reducing promotional discounts;
- consolidating orders;
- holding more inventory in EU warehouses;
- dropping some ultra-low-value products; or
- absorbing part of the cost through lower seller or platform margins.
Consumers should distinguish customs duty from VAT, shipping fees, platform fees and any future handling fee. A change in the final checkout price may reflect one or several of these components, and the €3 duty is not a universal flat surcharge on every order.
What shoppers should check before ordering
- Dispatch location: An item in an EU warehouse may not be treated like a parcel imported directly from outside the EU.
- Seller identity: Check whether the trader is clearly identified and whether there is a usable contact and return address.
- Product information: Take extra care with electrical goods, toys, cosmetics, chemicals and products intended for children.
- Reviews and discounts: Treat dramatic countdowns, unusually large discounts and unverified reviews cautiously.
- Returns: Check where the return must be sent and who pays the shipping cost.
- Checkout total: Look for customs, tax, shipping or handling charges before paying.
EU enforcement can reduce risks, but it does not make every marketplace listing automatically safe or compliant. A buyer remains better protected by checking the seller, product documentation and return terms before ordering.

What changes for European sellers
For EU-based merchants, stricter enforcement could narrow some of the cost advantage enjoyed by direct-import models. It may also create a more level comparison where competing products must meet similar safety, traceability and customs expectations.
Sellers should expect greater importance attached to:
- documenting product origin and tariff classification;
- maintaining safety and conformity records;
- identifying the responsible economic operator;
- providing accurate customs and VAT data;
- monitoring marketplace listings and claims; and
- verifying suppliers before products reach consumers.
Tax automation, customs software and product-testing providers may help larger merchants, but no service transfers legal responsibility away from the relevant seller, importer or platform. The appropriate solution depends on the product, sales model and countries involved.
What happens next
The main developments to watch are:
- Temu’s corrective action: the Commission’s stated deadline for Temu’s Article 75 action plan was August 28, 2026.
- The Shein investigation: further Commission findings or a final decision will determine whether the proceedings result in remedies or a penalty.
- Customs implementation: authorities and platforms will continue applying the temporary €3 duty and developing the longer-term customs system.
- The handling fee: its timing, amount and practical collection method should be kept separate from the €3 customs duty.
- Consumer and product-safety enforcement: additional actions may address listings, trader identification, interface design or unsafe goods under different legal frameworks.
Neither the available official material nor the current enforcement actions establishes an EU-wide ban on Temu or Shein. The immediate pattern is fines, investigations, corrective measures and higher compliance expectations—not a confirmed prohibition.
