TASER and Stinger: What the Patent Fight Decided

The Arizona case found the Stinger S-200 infringed two claims of a TASER patent, while another TASER claim was invalidated. Later disputes involved separate allegations.

TASER and Stinger’s Arizona patent case produced a mixed, claim-specific result: a court found Stinger’s S-200 literally infringed two claims of a TASER patent, while separately ruling one claim of another TASER patent invalid as obvious. A stipulated judgment and injunction followed in 2010. Later disputes over Stinger assets and a related Nevada case involved different allegations and should not be mistaken for new patent-infringement findings.

How the Arizona patent case developed

TASER International filed suit against Stinger Systems in the District of Arizona on January 5, 2007. The original complaint asserted U.S. Patent 7,145,762 along with false-advertising and false-marking claims. TASER later added U.S. Patents 6,999,295 and 7,102,870. In a second amended complaint, it dropped claims related to the ’762 patent and added U.S. Patent 7,234,262. Stinger denied liability, raised defenses and asserted a false-advertising counterclaim. The dispute turned on the scope of particular patent claims, not simply on whether the companies’ devices looked similar. A February 2009 claim-construction order interpreted terms involving the ’295 patent’s two-mode electrical output, the ’870 patent’s language about a grounded user, and the ’262 patent’s time-tracking limitations. The March 2010 ruling applied those constructions to the parties’ summary-judgment motions.

What the court decided in March 2010

On March 31, 2010, the court ruled on cross-motions for summary judgment. Judge Mary H. Murguia’s order described the competing requests as Stinger’s motion for summary judgment of patent invalidity or noninfringement and TASER’s motion for partial summary judgment of literal infringement. The decision resolved the issues in part rather than giving either side a blanket win. March 31, 2010 order

  • ’295 patent: The court found as a matter of law that Stinger’s S-200 literally infringed claims 2 and 40.
  • ’870 patent: The court found claim 3 invalid as obvious, granting Stinger summary judgment on that claim.
  • Other issues: The order resolved the parties’ motions in part; its specific rulings should not be generalized into a finding that every asserted patent claim was infringed or valid.

The 2010 judgment and injunction

The parties entered a stipulated final judgment on August 30, 2010, which included a final injunction. As later described by the court, the injunction barred Stinger and its officers, agents, servants, employees and attorneys from making, using, offering to sell or selling S-200 devices, as well as products only colorably different from the S-200 in the context of claims 2 or 40 of the ’295 patent. Why the Karbon Arms and MPID dispute was separate

After Stinger’s former president Robert Gruder placed the company into insolvency proceedings, Karbon Arms acquired Stinger’s assets. TASER later alleged that Karbon Arms produced the Karbon MPID and characterized it as essentially the same as the S-200. TASER sought contempt based on the injunction. That description of the MPID is TASER’s allegation as recited in the later order; it is not, on the evidence cited here, an independent finding that the MPID infringed the patents or violated the injunction. The Nevada press-release allegations were not another patent ruling

A separate Nevada proceeding concerned TASER’s allegations that Stinger-related actors issued misleading press releases to harm TASER’s stock value and reputation. Those were allegations about statements and alleged business harm, distinct from the Arizona patent claims. The Nevada order also explained that the Arizona Lanham Act claims had been voluntarily dismissed to streamline the litigation; their dismissal did not resolve factual or legal issues on the merits and supported no inference for or against either party. What the case does—and does not—establish

The central patent result is specific: the S-200 was found to literally infringe claims 2 and 40 of the ’295 patent, while claim 3 of the ’870 patent was found invalid as obvious. The injunction’s scope was tied to the S-200 and products only colorably different in relation to those ’295 claims. The later MPID contempt dispute and the Nevada press-release allegations were separate procedural chapters, not extensions of that original infringement finding.
