The EPA’s 2026 summer waiver temporarily allowed nationwide E15 sales; it did not make year-round E15 legal. Farm and biofuel groups welcomed the relief but urged Congress to pass a permanent fix. A House bill cleared the House in May, but its Senate status was unresolved in sources current through October 8, 2026.
What the 2026 E15 waiver did
On March 25, 2026, the Environmental Protection Agency, in consultation with the Department of Energy, announced a temporary emergency fuel waiver. It allowed nationwide E15 sales and waived federal enforcement of state “boutique” fuel requirements for E10. EPA said the action would begin May 1 in most states and initially run through May 20. The agency presented the waiver as a way to support fuel supply and consumer options ahead of summer driving; that rationale is not proof that the waiver lowered prices. EPA’s March 25 announcement includes the agency’s explanation.
On August 20, Growth Energy said a further temporary EPA and DOE waiver supported E15 sales for the remainder of the 2026 summer driving season. That later extension continued temporary relief; it did not repeal the underlying summer rules. Growth Energy’s August statement describes the extension.
What E15 is—and why summer rules apply
E15 is gasoline blended with up to 15% ethanol. Under the Clean Air Act, Reid Vapor Pressure requirements limit gasoline volatility during the high-ozone summer season. More volatile fuel evaporates more readily in hot weather and can contribute to ground-level ozone formation. Under usual rules, E15 generally cannot be sold during summer; the law allows EPA to issue temporary waivers under specified conditions. The waiver provides temporary regulatory relief rather than a permanent change to those rules. The Congressional Research Service’s April 23, 2024 overview explains the regulatory mechanism; it predates the 2026 waiver actions.

Why farm and biofuel groups praised the waiver
In its March 25 stakeholder roundup, EPA reported favorable reactions from agricultural organizations, state officials, lawmakers and biofuel groups. Supporters cited consumer choice, possible pump-price savings, markets for American-grown crops, domestic fuel supply and energy security. These are advocates’ arguments, not established outcomes for every driver or region. EPA’s roundup records the statements and their speakers.
American Farm Bureau Federation President Zippy Duvall said consumers could save 10–30 cents per gallon. That is an AFBF estimate attributed to its president, not a verified or universal price difference. A lower posted price per gallon also does not necessarily mean lower cost per mile: ethanol has less energy per gallon than gasoline, which can affect fuel economy. CBO noted that seasonal access is not the only limit on E15 demand, and the Associated Press reported expert cautions about whether expanded E15 use would substantially reduce overall driving costs.

The groups’ support came with a request to Congress. Renewable-fuel advocates and farm leaders argued that annual emergency waivers leave retailers, farmers and drivers without dependable year-round rules. In an August statement, Growth Energy CEO Emily Skor said retailers, farmers and drivers should not have to rely on separate EPA waivers each year to access the fuel option. Growth Energy’s statement sets out that case. Agriculture.com’s March 25 report quotes ACE CEO Brian Jennings describing temporary waivers as a stopgap and calling for a permanent nationwide solution.
What Congress has—and has not—done
The legislative proposal identified by supporters is H.R. 1346, the Nationwide Consumer and Fuel Retailer Choice Act of 2025. It would permit year-round E15 sales, while also revising parts of the Renewable Fuel Standard, including provisions affecting small-refinery exemptions. The House passed it 218–203 on May 13, 2026, according to Representative Michelle Fischbach’s report.

House passage is not enactment. Senate disposition was not confirmed in sources current through October 8, 2026, so year-round nationwide E15 should not be described as law. The distinction matters: the temporary waiver applied during the 2026 summer season, while H.R. 1346 would change the legal framework if enacted.
The Congressional Budget Office estimated that the full House-reported bill package would increase the federal deficit by $2.3 billion over 2026–2036. That estimate covers the package, including its Renewable Fuel Standard changes; it is not an estimate of the waiver’s effect on fuel prices. CBO also said E15 uptake and crop-market effects were uncertain, and that year-round sales would produce a modest increase in E15 sales because the seasonal restriction is not the only factor limiting demand. What the waiver does not guarantee for drivers
Availability varies by station
A nationwide waiver permits sales under the specified federal rules; it does not mean every station carries E15. Retailers may need separate or specialized tanks and pumps, and CBO and the Associated Press have noted equipment and supply constraints. The waiver itself does not install infrastructure or guarantee local availability.
Check compatibility before filling up
Do not assume E15 is appropriate for every vehicle or piece of equipment. The Associated Press reported expert cautions involving older vehicles and certain non-road equipment, but the sources do not establish a complete compatibility list. Check the vehicle or equipment manufacturer’s guidance, or authoritative EPA information, for the exact model before using E15.

Price, fuel economy and environmental effects are different questions
Supporters point to possible savings at the pump, but the price per gallon is not the same as cost per mile, and availability is not universal. The summer volatility rules are intended to reduce smog precursors; the Associated Press reported concerns about ozone and crop-market consequences. Those are considerations in the policy debate, not proof that a particular waiver caused a specific environmental or agricultural outcome.
