The initial docket posting showed a 41-month judgment, but DTN reported that it was amended hours later to 24 months. The amended 24-month term is the sentence reported by DTN; the earlier figure reflects the initial posting.
Why was McBee sentenced?
McBee pleaded guilty on November 5, 2024, to one federal count of crop-insurance fraud. The U.S. Department of Justice said he admitted to understating his 2018 crop production when reporting yields to obtain federal crop-insurance benefits.

False crop reporting
According to the Justice Department, McBee understated his 2018 corn crop by approximately 674,812 bushels and his soybean crop by approximately 155,833 bushels. The department also said he admitted additional false reporting connected to insurance claims in 2019 and 2020.
The Justice Department described the admitted conduct as fraudulent activity from 2018 through 2020 that caused an economic loss to the U.S. Department of Agriculture. Its account concerns McBee’s plea and admitted conduct; it is separate from DTN’s later reporting about the sentence.
How do the loss, forfeiture and restitution figures differ?
The Justice Department’s November 2024 release lists several amounts from the plea case. They are not interchangeable: improper benefits and premium subsidies, the government’s claimed total loss, forfeiture, and the later-reported restitution order refer to distinct figures.
| Figure | What it refers to | Source and context |
|---|---|---|
| $2,605,943 | Improper federal crop-insurance benefits | U.S. Department of Justice, November 2024 |
| $552,980 | Improper premium subsidies | U.S. Department of Justice, November 2024 |
| $3,158,923 | Combined benefits and subsidies; also the amount the plea agreement required McBee to forfeit | U.S. Department of Justice, November 2024 |
| $4,022,123 | The government’s total loss claim | U.S. Department of Justice, November 2024 |
| About $4 million | Restitution ordered at sentencing, with USDA’s Risk Management Agency identified by DTN as the recipient | DTN, October 2025 |
The Justice Department’s $4,022,123 loss claim is not the same description as the $3,158,923 forfeiture amount. DTN’s approximately $4 million restitution report is a sentencing figure, not a restatement of the plea agreement’s forfeiture amount.

What was the potential maximum penalty?
At the time of the plea, the Justice Department said the charged offense carried a statutory maximum of up to 30 years in prison. That was the maximum available penalty described in the 2024 release, not the sentence McBee received. DTN reported the imposed prison term as 24 months.
