What happened to Seth Green’s Bored Ape NFT?

The phishing incident

Green said he was phished on May 17, 2022, while trying to mint an NFT through a fraudulent site. Decrypt reported that four tokens were stolen: Bored Ape #8398, which Green named Fred Simian; Mutant Apes #9964 and #19182; and Doodle #7546. Decrypt’s contemporary account identifies the tokens and reports Green’s statement.

Fred Simian and the White Horse Tavern rights question

Green had planned a television project called White Horse Tavern featuring Fred Simian. The theft and resale of the Bored Ape raised a question about who could commercially use the character. Bloomberg Law reported that the Bored Ape Yacht Club license tied commercial rights to the NFT’s owner, leaving uncertainty around rights after the token changed hands. That coverage describes an unresolved issue at the time; it does not establish a final court ruling or a settled legal answer. Bloomberg Law’s report discusses the licensing question.

Reported recovery and cost

Blockhead reported that Green recovered Fred Simian about a month after the theft at a cost of $300,000. That is the outlet’s reported amount associated with the recovery, not a verified accounting of all costs. Green described the process as difficult and said he had resources to pursue it; the report should not be read as establishing a general price for recovering stolen NFTs or a standard legal remedy.
