In a reported ruling concerning construction-related services for 2006–07 to 2008–09, CESTAT Kolkata said the service-tax demand needed to be recalculated with reference to consideration actually received, rather than accruals. The Tribunal reportedly remanded the case for that exercise; it did not finally determine the tax payable. The holding is tied to the historical period and facts in Britannia Enginering Ltd. v. Service Tax-I, Kolkata, and should not be treated as a general rule for later service-tax periods or GST.
The available account is a secondary summary published by LawLens on October 8, 2026. The primary tribunal order was not available to verify its precise wording or legal authorities.

What the reported ruling says about receipts and accruals
Accrual and receipt mark different events. An amount may be recorded as earned or due before the customer pays it. According to LawLens’s account, the Tribunal treated consideration actually received as material to calculating service tax for the period in dispute, rather than relying on accruals alone.

That is a reported, period-specific proposition—not a statement that actual receipts always control service-tax liability. The summary does not identify the statutory provision or precedent behind the reasoning, so those details should not be inferred from the account.

How the dispute reached the Tribunal
Britannia Enginering Ltd. provided construction-related services and faced an assessment covering 2006–07 to 2008–09. LawLens reports that, after an audit, the department calculated tax on the gross work value while allowing a 67% abatement for materials; the company made payments under protest.
The company argued that its work was Works Contract Service, challenged its classification in the show-cause notice as Commercial or Industrial Construction Service, and contended that services rendered before the relevant provisions came into force could not be taxed under those provisions. It also raised limitation. The adjudicating authority confirmed the demand, and the Commissioner (Appeals) dismissed the company’s appeal.
Rank #2
Why the demand was sent back for recalculation
The summary says the Tribunal saw little force in the classification objection because the department’s calculation already treated the company as supplying both goods and services and allowed an abatement for materials. But it considered the demand in need of re-quantification, taking account of contract timing, service completion and when the related consideration was received.

It also reports that amounts attributable to services rendered before the relevant Commercial or Industrial Construction Service provisions came into force could not be taxed under those provisions. The secondary account does not establish the exact statutory provisions or how the Tribunal applied them to particular contracts.
Rank #3
Records identified as relevant
For the recalculation, the reported directions make the documentary record important. The summary identifies these facts as relevant:
- When each contract was entered into.
- When the contracted services were completed or rendered.
- When consideration for those services was actually received.
- Documents supporting the relevant dates and amounts.
What the remand did—and did not—decide
A remand returns an issue to the lower authority for further examination. Here, the reported result was a direction to examine documentary evidence and re-quantify the demand while observing natural justice. It was not a final ruling fixing the amount of tax payable.
Rank #4
LawLens also reports that the adjudicating authority was directed to decide within four months after receiving the order and that the company was asked to cooperate and provide relevant documents. Because the primary order was not available, treat that deadline and the wording of the directions as details reported by the summary, not verified quotations from the operative order.

The summary says the limitation contention was not finally decided. It does not provide the case number, tribunal composition, exact statutory provisions, or any cited precedent. Those points require the primary order; the summary alone is not enough to establish them.
