There is no single New York license that covers every freshwater fish sale. The rules depend on the fish’s source and species, whether it will be sold as bait or food, and whether you harvest, raise, process, or simply retail it. Before spending money on gear or inventory, identify which rules apply to your specific operation: wild catch, baitfish, hatchery-raised fish, or food retailing and processing.

These are separate questions: permission to harvest or sell a particular fish does not by itself answer whether a food-business license is required for the way you handle or sell it.
Wild-caught freshwater fish: check the species and water first
NYSDEC’s general rule is that fish listed with no closed season and no minimum length are generally salable. Fish subject to a closed season or minimum length are generally not salable, subject to stated exceptions. A lawful recreational catch limit alone does not establish that a fish may be sold. Check the current rules for the species, waterbody, and origin before harvesting fish for sale. NYSDEC’s freshwater regulations include the statewide rules and exceptions.
The exceptions matter. DEC identifies certain fish that are salable only if taken outside New York State. It also lists restrictions on channel catfish taken in Lake Ontario and certain connected waters; American eel from the Hudson, Harlem, and East rivers, except for bait; and certain salmon eggs, which may be sold only for bait. Do not assume that a species is salable everywhere just because it appears in a general statewide rule.

The DEC material cited here does not establish a general inland commercial harvest license that authorizes every wild freshwater food-fish sale. A recreational fishing license should not be treated as permission to harvest commercially or sell a catch. Ask DEC about the exact species, water, harvest method, and intended sale before relying on a recreational license or investing in a commercial catch.
Baitfish: a dealer license and operating rules apply
DEC states that “A baitfish license is required to sell baitfish in NY.” The Freshwater Bait Fish Dealer License is available to residents and non-residents. It authorizes harvest of certain freshwater fish and aquatic insects from designated waters for sale as bait, and wholesale or retail sale of certified or uncertified baitfish. The license runs from January 1 through December 31, and its fee depends on the gear or activity. Review the current license requirements and baitfish rules before applying; only specified species, waters, and gear are allowed.
Gear, receipts, and disease status
Gear limits are specific rather than general permission to collect fish. For example, DEC’s baitfish gear table allows a minnow trap no longer than 20 inches, with an entrance diameter no larger than 1 inch, marked with the owner’s name and address, in waters open to baitfish use. A trap that meets those dimensions does not authorize collection in a closed or otherwise ineligible water.

Certified baitfish are tested for specified diseases. For each sale, a receipt must identify the seller, sale date, species, and quantity for each species. Uncertified baitfish are restricted to use in the same waterbody where collected and generally cannot be transported overland by motor vehicle outside designated corridors. Outside a corridor, sellers of uncertified bait must also provide the allowed waterbody and a warning about motor-vehicle transport on the receipt.
Personal collection is not a route to bait sales
Eligible anglers may collect baitfish personally for their own hook-and-line use, but fish collected under that personal-use allowance may not be sold. Carp, goldfish, lamprey larvae, round goby, European rudd, and endangered or threatened species may not be used as bait.
Application timing
A DEC application revised in May 2022 requests 45 days for review and processing; this is an estimate, not a guaranteed turnaround. Check the current baitfish license application and agency instructions before planning an opening date.

Hatchery-raised fish: use the private hatchery permit path
DEC’s Fish Hatchery Permit applies to private commercial hatcheries raising trout or black bass. It permits sale of hatchery-raised trout and largemouth bass; hatchery-raised smallmouth bass may be sold except for human consumption. This permit does not itself authorize stocking fish into New York waters. See the current Fish Hatchery Permit requirements before choosing species or a sales plan.
Fish-health certification is required before fish are offered for sale, sold, bartered, imported, or transported for stocking into New York waters, as described by DEC. The hatchery must keep a completed inspection report on its premises and provide a copy to the purchaser. DEC says the report can certify a fish lot as disease-free for up to 12 months. Hatchery trout carcasses offered for sale, sold, or transported must be tagged or packed with producer information; imported trout are subject to a country-of-origin marking rule.

It says purchasers from listed hatcheries must receive a Fish Health Certificate Report showing testing within the previous 12 months. The directory helps locate facilities; confirm that the particular facility, species, and transaction meet current requirements.

Food sales, retailing, and processing may need separate approval
Fishery authorization and food-business licensing are distinct. New York Agriculture and Markets says Article 20-C Food Processing Establishment licenses apply to covered preparation and processing activities, including slicing, smoking, cooking, or otherwise processing fish. Its Article 28-A Retail Food Store license description covers stores selling food to consumers for off-premises consumption when they do not conduct the processing described on the agency page. The department’s food business licensing guidance and seafood overview describe oversight of primary seafood processors, wholesale secondary seafood processors, and retail markets selling and processing seafood.
Those categories do not mean every occasional fish sale requires the same license. Requirements depend on the establishment and its actual activities; a retail store, processor, and other sales arrangements may be treated differently. The state guidance cited here does not resolve every facility, local permit, or sales-channel scenario. Describe your exact business model to Agriculture and Markets and, where relevant, the local health department before you begin handling or selling food.
Marine commercial permits are not a general inland fish license
DEC’s commercial fishing and aquaculture permit overview describes marine commercial permits, including Food Fishing, Food Fish Landing, and Food Fish & Crustacea Dealers & Shippers. Those categories concern marine fish and crustacea and related commercial landing, resale, storage, shipping, or export activity. They should not be treated as general permits for inland freshwater fish. See the agency’s commercial fishing and aquaculture permits page for the marine scope.

Before you start selling
- Define the product and source. Establish whether the fish are wild-caught, baitfish, or hatchery-raised, and whether they will be sold as bait or food.
- Confirm the DEC pathway. Use the applicable current species, waterbody, gear, permit, and sale rules; ask DEC to resolve a wild-harvest situation not clearly covered by its published material.
- Map the handling and sales activity. If fish will be prepared, processed, or retailed as food, check Agriculture and Markets requirements and local health department requirements for the actual setup.
- Verify current forms and conditions before committing funds. Fees, forms, season tables, and agency guidance can change; use the linked agency pages rather than relying on an old application or a general description.
