Seattle’s Rent-Setting Software Ban Took Effect in 2025: What It Covers

Seattle’s 2025 law targets certain cross-landlord rental-data coordination—not all pricing software. Here’s what it prohibits, who enforces it, and what remains unknown about its effect on rents.

Seattle’s ban on certain rent-setting software is already in force. The City Council passed the amended bill on June 24, 2025, the mayor signed it on July 1, and the ordinance took effect July 31, 2025. It targets specified coordination between landlords through shared rental data and automated recommendations—not every rent algorithm or every use of software to set prices.

What Seattle’s rent-setting law prohibits

Ordinance 127241 addresses coordination between landlords through a service provider. Under the ordinance, coordination can involve a provider collecting historical, anticipated, or current rental prices, price changes, supply, occupancy, or lease termination and renewal data from at least two landlords or databases, then using automated processing to recommend rents, lease-renewal terms, or occupancy levels to more than one landlord. The City’s renter guidance summarizes the rule as prohibiting landlords from using software that aggregates data from unaffiliated third-party properties to recommend or set rents. It says a landlord may use software based on that landlord’s own property data. The ordinance also applies to service providers that coordinate landlords, not just landlords who act on recommendations. Seattle’s renter guidance.

What the law does not automatically prohibit

The ordinance is not a blanket ban on rent-setting software, automated pricing, or all dynamic pricing. Its definitions, exclusions, and exceptions matter. For example, it excludes public estimates based solely on public information when the information is equally available to the public and obtaining the estimate does not require a contract or agreement. Whether a particular tool or practice falls within the law depends on its data sources and use.

Practice How the ordinance treats it
Software using only one landlord’s own property data The City says this use is allowed under the law’s summary guidance.
Recommendations drawing on data from unaffiliated properties Potentially covered; the ordinance’s definitions and conditions determine whether it is prohibited.
Estimates based solely on qualifying public information Excluded when the information is equally available to the public and no contract or agreement is required.
A provider coordinating recommendations for multiple landlords The ordinance reaches service providers as well as landlords, subject to its definitions and exceptions.

Who enforces the ban—and what tenants can do

Seattle’s renter guidance says the City does not enforce this law. Separately, the ordinance allows an aggrieved tenant to bring a private civil action against a landlord or service provider for a violation, subject to statutory conditions. A private right of action is not city enforcement, and bringing a claim does not guarantee a particular outcome or recovery. Tenants considering a claim should review the ordinance and seek qualified legal advice about their circumstances.

Why Seattle adopted the law

The ordinance’s legislative findings describe concerns that the sharing and automated use of rental data could coordinate landlords’ decisions and contribute to higher rents. Those findings explain the policy rationale; they are not proof that every covered tool caused a particular rent increase.

Among the findings, the ordinance recounts that ProPublica reported in 2022 that, in one Seattle neighborhood, 70 percent of apartments were overseen by ten property managers, all of which used pricing software sold by RealPage. The ordinance also cites an inflation-adjusted 32 percent rise in average monthly rents from 2012 to 2022 and attributes to the Washington Attorney General an estimate that about 800,000 Washington leases were priced using RealPage software between 2017 and 2024. Has the ban lowered Seattle rents?

The official materials cited here do not establish that the ordinance has reduced rents. The cited rent figures describe earlier periods, and the Attorney General estimate concerns leases priced with RealPage software; neither measures the effect of Seattle’s ban, which took effect on July 31, 2025. The law’s enactment and its intended response to coordination concerns should not be treated as evidence that rents have since fallen because of it.

Seattle’s 2026 grocery-pricing law is separate

Seattle later enacted a different measure, CB 121267 / Ordinance 127515, concerning certain retailers’ use of personal information in setting prices for specified goods, including groceries. That law is scheduled to take effect September 1, 2027. Its coverage and exceptions include specified grocery businesses, mixed-use grocery businesses, and delivery services, with exclusions for certain delivery-cost differences, broadly available discounts, and qualifying loyalty-program tiers.
