Rain Seeks U.S. Trust Bank Charter as ICBA Sues OCC Over Crypto Charters

Rain has reportedly sought an OCC national trust bank charter for custody and stablecoin services. The filing is not an approval, and ICBA is challenging the OCC’s crypto-charter framework.

Rain has reportedly applied to the Office of the Comptroller of the Currency (OCC) to establish a national trust bank, but the application is not an approval and the proposed bank is not shown to be operating. The filing was reported days after the Independent Community Bankers of America (ICBA) announced a lawsuit challenging the OCC framework for crypto-related trust charters.

What Rain is applying for

Cointelegraph reported on October 6, 2026, that stablecoin payments infrastructure provider Rain filed an application on Monday to establish Rain National Trust Bank, headquartered in New York. The report does not provide a filing control number, and a Rain-specific public OCC application record was not visible in the agency listing returned for this story. Cointelegraph’s report

If the OCC approves the application, the proposed bank could provide fiduciary custody of digital assets and U.S. dollars for institutional clients, manage reserves for permitted stablecoin issuers, and issue and redeem dollar-backed stablecoins under the GENIUS Act. These are proposed activities, not services currently established as available from a Rain-chartered bank.

The report names former Square Financial Services CFO Brandon Soto as the proposed bank’s president and CEO, subject to OCC review. It does not establish that he has taken office.

What a national trust bank means for customers

A trust bank charter is not the same thing as a conventional deposit-taking bank charter. The Rain proposal is framed around fiduciary custody and stablecoin-related institutional services. The available reporting does not establish that Rain National Trust Bank would accept ordinary consumer deposits, offer checking accounts, or provide FDIC-insured deposit accounts. A proposed charter alone is not evidence of any such consumer product.

For individuals, this is therefore a regulatory and institutional-finance development, not a new account or payment service to sign up for. The details of what an approved Rain bank could do would depend on its charter and the OCC’s decision.

Why the timing matters: ICBA’s lawsuit

ICBA announced on October 2, 2026, that it was suing over national trust bank charters for crypto firms. ICBA’s announcement followed the OCC’s March 2026 National Bank Chartering rule and Interpretive Letter 1176, which the lawsuit reportedly challenges.

ICBA argues that the framework lets non-depository trust banks conduct activities beyond the proper scope of a trust charter and may give them an advantage over community banks. Those are the plaintiff’s allegations and policy arguments, not findings by a court. The suit seeks to overturn the rule and interpretive letter and prevent further approvals relying on them; the material available for this article does not establish a court ruling or injunction.

Cointelegraph also reported that Modern Treasury announced a charter application on the same Monday. That is context for the timing, not evidence about Rain’s filing status or prospects.

Has the OCC approved Rain’s charter?

No approval is established in the available information. Cointelegraph reported the application, but the OCC’s Digital Assets Licensing Applications page did not list Rain in the version returned for this story. The OCC describes that page as a list of pending applications from entities planning digital-asset products or services; absence from a particular listing is not proof that no filing was made, since a report may precede intake or public posting. The OCC says its Corporate Applications Search (CAS) can be used to find applications, status, and actions taken. The agency notes that a received application may take five days to appear in CAS. Search by applicant name and date range after that period, then check for an application number, status, any applicable comment period, and later actions. OCC Corporate Applications Search

The OCC’s chartering unit receives and analyzes filings and works with legal and supervisory divisions on decisions supported by factual, legal, and supervisory analysis.
