Under the federal baseline, an ordinary firearm transfer between two unlicensed people who live in the same state generally does not require a background check through a licensed dealer or federal transaction recordkeeping. A licensed dealer generally must check a prospective buyer through the National Instant Criminal Background Check System (NICS) before transferring a firearm, and must keep specified transaction records. These are not nationwide one-size-fits-all rules: state and local laws can add requirements, and a private seller may not transfer a firearm to someone the seller knows or has reasonable cause to believe is prohibited from possessing one.
This comparison describes the federal baseline for the United States, not the law in every state. State and local requirements can change what a seller or buyer must do, so check the law where the transfer will occur before arranging it.
How do private sales and dealer sales differ?

Do private gun sales require a background check?
At the federal level, an ordinary transfer between unlicensed people who reside in the same state generally does not require the seller to use an FFL or obtain a NICS check. ATF’s FAQ also says the Gun Control Act does not require federal recordkeeping for that described transaction. Those points are narrow: they do not override a state or local check, permit, waiting-period or record requirement.
The seller still cannot transfer to a prohibited person
Federal law bars a person from selling or delivering a firearm while knowing or having reasonable cause to believe the recipient is prohibited from possessing one. Therefore, “no federal check required” does not mean “a private sale to anyone is allowed.” The Department of Justice described this restriction in its February 6, 2025 update on the dealer-definition rule.

Using a dealer is an option, not a nationwide private-sale requirement
A private seller or buyer may choose to ask a local FFL about facilitating a transfer. ATF provides guidance for dealers handling private-party transfers and encourages FFL assistance. Whether a dealer will provide the service, what it charges, and what paperwork or procedures it requires are matters to confirm with that dealer; no nationwide fee or uniform participation policy is established here.
What happens when a licensed dealer sells a firearm?
For a dealer’s transfer to a nonlicensee, the general federal process includes the buyer’s identity and transaction paperwork and a background check before the firearm is transferred. The dealer generally contacts NICS, though a recognized qualifying permit may substitute for the check in specified circumstances. The rules therefore do not mean that every dealer transaction must use NICS in precisely the same way.

Federal requirements are only part of the transaction. A state may impose additional procedures on the buyer, dealer or both. The Congressional Research Service’s September 12, 2025 overview is a neutral summary of the broader federal framework; it does not replace checking the current law in the state where the sale takes place.
What records does a gun dealer keep?
Federal rules require licensed dealers to maintain acquisition and disposition records and to retain Form 4473 and specified transaction records for the periods set by regulation. ATF’s dealer guide describes completed sale or disposition records as generally subject to a retention period of at least 20 years. The precise requirement depends on the type of record and applicable rule, so “20 years” should not be read as one retention period for every document in every circumstance.

These are records maintained by licensed dealers, not a single universal federal registry of every firearm transfer. The Department of Justice says dealer records can help trace a recovered firearm to its first retail purchaser and can help identify straw purchasing. Those tracing functions do not change the recordkeeping rules for the ordinary same-state transfer between unlicensed people described by ATF.
Proposed retention changes are not current requirements
ATF released a records-retention notice on May 6, 2026, as a proposed rulemaking. It discusses possible 20- or 30-year periods for specified records, including forms used to facilitate private-party transfers. Those options are proposals, not requirements established by the notice. Check the current regulation and ATF guidance before relying on a particular retention period.

Can you sell a gun to someone in another state?
Do not carry over the same-state private-transfer rule to a buyer who resides in another state. ATF guidance describes routing the firearm to an FFL in the buyer’s state, which handles the buyer’s paperwork and applicable background-check process before delivery. Limited rules may permit an interstate transfer of a long gun through a dealer under specific conditions; they are not a general permission for direct private delivery across state lines. Because state law also matters, confirm the correct route with an FFL and check the laws in both states before proceeding.
Does the law change if you sell firearms regularly?
Yes, the seller’s activity can raise a separate federal licensing question. A person who repeatedly sells firearms predominantly to earn a profit may meet the federal definition of a dealer and need a federal firearms license. That is distinct from the rules for an occasional private disposition, and the answer depends on the facts and the law currently in effect.

ATF’s “Final Rule: Definition of ‘Engaged in the Business’ as a Dealer in Firearms” page was last updated May 12, 2026. It describes the 2024 rule implementing the broader definition in the Bipartisan Safer Communities Act and identifies a preliminary injunction protecting named plaintiffs and a May 2026 proposal to rescind the rule. The cited material does not establish the ultimate status of the litigation or proposal as of October 4, 2026. Do not treat the proposal as a rule already in force or assume the injunction applies to everyone; check ATF’s current rule page and relevant court status before relying on the rule’s application to a particular seller.

What should you check before arranging a transfer?
- Confirm whether the transaction is in-state or interstate. The federal baseline for two unlicensed same-state residents is not a guide to direct delivery across state lines.
- Check current state and local requirements. Look for official state statutes, state police or attorney general guidance, and local rules that may require a check, permit, dealer transfer, waiting period or record.
- Do not transfer if the federal prohibited-person rule applies. The absence of a required private-sale NICS check does not remove the seller’s obligation not to transfer when they know or have reasonable cause to believe the recipient is prohibited.
- Ask an FFL about a dealer-facilitated transfer if the legal route is unclear. Confirm the dealer’s availability, procedures and fee directly rather than assuming that every dealer offers the service.
- Store any firearm securely. DOJ says dealers provide child-safety locks with handgun transfers and offer secure-storage options. A lock or storage device is a safety measure, not a substitute for following transfer law.
