Poland’s consumer-protection authority, UOKiK, announced on March 27, 2024, that it had fined Amazon EU SARL PLN 31,850,141 over practices it said infringed consumers’ collective interests. The authority cited how orders and contracts were formed, product availability and delivery-date claims, and disclosure of Amazon’s “Guaranteed Delivery” terms. UOKiK said the decision was not final when announced; whether it was later appealed or decided by a court is not established by the sources cited here.
Why did Poland fine Amazon?
UOKiK, Poland’s Office of Competition and Consumer Protection, said Amazon EU SARL had infringed collective consumer interests. Amazon EU SARL is based in Luxembourg and was identified by the authority as one of the traders selling on Amazon.pl. The decision was directed at that company, not every Amazon entity or every independent seller using the marketplace.
UOKiK announced a penalty of PLN 31,850,141. Its notice does not state a US-dollar conversion or the exchange-rate date behind the assignment’s approximate $7.8 million figure, so the sourced amount is the zloty figure. Read UOKiK’s March 27, 2024 decision announcement.
What practices did UOKiK challenge?
When an order became a contract
UOKiK said Amazon treated a customer’s order and its confirmation as an offer from the consumer, with the sales contract formed only after Amazon sent a shipping notification. The authority said that explanation was difficult to find at checkout, in contrast with prominent purchase controls such as “Buy Now.”

Availability and delivery-date messages
The authority challenged countdown messages and limited-stock figures that it said could create pressure to order quickly. It also said some stated delivery dates were missed and some products could not be dispatched or were delayed, including because they were out of stock. In UOKiK’s account, availability and shipping information could be indicative, but the way it was presented did not make that qualification sufficiently clear.
UOKiK President Tomasz Chróstny said: “If a trader gives a specific delivery date, they must meet it.” He also characterized the urgency tactics as “dark patterns,” saying they used pressure to encourage consumers to order as soon as possible. These are the authority’s statements about its decision, not a claim that every Amazon delivery was late.

Guaranteed Delivery terms
UOKiK described Amazon’s “Guaranteed Delivery” service as allowing consumers to request a refund of the delivery fee if an item did not arrive within a specified time. The authority said the service’s rules were not sufficiently visible before purchase and were not included in order confirmations, potentially leaving consumers unaware of the remedy. This describes the service as UOKiK addressed it in the 2024 decision; it should not be taken as a statement of Amazon’s current policy.
Customer complaints cited in the case
UOKiK said it received complaints from customers who had paid for goods they did not receive. It also cited repeated cancellations of orders for popular e-book readers as an example from its investigation. The notice does not quantify those complaints, so they do not establish how often such problems occurred across all orders.

Was the fine final, and was Amazon able to appeal?
No—not when UOKiK announced it. The authority said the decision was not final and Amazon could appeal. The available cited sources do not establish whether an appeal was filed or whether a court later ruled on the matter, so the later procedural status remains unresolved here.

The case focused on how purchase timing, stock availability, delivery expectations and a delivery-fee remedy were communicated—not on a general finding that all orders on Amazon.pl were unreliable. For consumers, the practical issues UOKiK identified were whether the displayed delivery date was presented as definite, when the contract would form, and whether the conditions for a delivery-related remedy were clear before checkout.
