On September 30, 2026, a federal judge rejected motions to dismiss Apple’s case, allowing certain claims to proceed—but the ruling did not decide that OPPO or anyone else stole trade secrets.
What OPPO said about Apple’s lawsuit
After Apple filed suit in California in August 2025, an OPPO spokesperson said the company had reviewed the complaint and “found no evidence establishing any connection between these allegations and the employee’s conduct during his employment at OPPO.” The spokesperson added:
“OPPO respects the trade secrets of all companies, including Apple, and OPPO has not misappropriated Apple’s trade secrets. OPPO will actively cooperate with the legal process, and we are confident that fair judicial proceedings will clarify the facts.”
That is OPPO’s public denial, reported by MacRumors on August 23, 2025; it is not independent evidence about what happened.

What Apple alleges
Apple sued former employee Chen Shi, OPPO and InnoPeak Technology in the U.S. District Court for the Northern District of California. Apple’s complaint alleges that Shi worked on Apple Watch health-sensing technology, obtained confidential information before leaving Apple, and disclosed information to OPPO and InnoPeak. Those claims are allegations, not established findings.
In its September 30, 2026 order, the court recounted Apple’s allegations that Shi downloaded 63 documents from a protected Box folder shortly before leaving, attended meetings with Apple Watch technical team members, and presented some information to OPPO and InnoPeak engineers. The number and conduct describe what Apple alleged; the court did not find after trial that these events occurred. The complaint and the court’s order set out the pleadings and procedural ruling.

What the September 2026 ruling decided
On September 30, 2026, District Judge Eumi K. Lee denied defendants’ motions to dismiss Apple’s second amended complaint. The court concluded that some claims were sufficiently pleaded to continue, including Apple’s breach-of-contract claim against Shi, its identification of at least one alleged trade secret with adequate specificity at this stage, and its claim that Zijing Zeng induced misappropriation.
A motion to dismiss tests whether the complaint’s allegations are legally sufficient to proceed, not whether they are true. The ruling did not determine that the information ultimately qualifies as a trade secret, that any defendant misappropriated it, or that Apple is entitled to damages or an injunction. The defendants were ordered to file responsive pleadings by October 21, 2026.

Where the case stands
As of October 4, 2026, the latest procedural development located was Judge Lee’s September 30 order. The case is moving beyond the dismissal stage, but the central factual dispute remains unresolved: Apple accuses the defendants of misappropriation, while OPPO denies it and says it will cooperate. A separate October 29, 2025 discovery order addressed disputes over document production and expedited discovery; it predates and does not alter the September 2026 ruling.
