Nintendo’s Tariff Lawsuit: What Its Case Against the U.S. Government Seeks

Nintendo of America’s March 2026 lawsuit seeks refunds of certain IEEPA duties. The latest visible docket entry addresses reliquidation of qualifying import entries, not a complete refund award.

Nintendo of America Inc. filed a lawsuit in the U.S. Court of International Trade on March 6, 2026, seeking refunds of certain tariffs imposed under executive orders invoking the International Emergency Economic Powers Act (IEEPA). The filing asks for repayment with interest; it does not show that Nintendo has received a refund. The latest docket entry available in the reviewed listing is a July 22, 2026 order concerning certain qualifying import entries, not a ruling granting Nintendo a complete refund.

What Nintendo is suing over

Nintendo of America Inc. is the plaintiff in Nintendo of America Inc. v. United States of America et al., U.S. Court of International Trade case 1:26-cv-01540. The company filed its complaint on March 6, 2026, against the United States and federal agencies and officials, including Treasury, Homeland Security, Commerce, the Office of the U.S. Trade Representative and Customs and Border Protection (CBP). The docket listing identifies the parties and filing date: Justia’s docket report.

The complaint challenges duties imposed through executive orders issued by President Donald Trump that invoked IEEPA, a 1977 federal law. Nintendo alleges that it imported goods from affected countries and paid those duties. Those statements are allegations in the complaint, not findings that the court has established.

What Nintendo wants—and what the filing does not prove

Nintendo asks the court for relief that includes a prompt refund of IEEPA duties it says it paid, with interest. Filing for a refund is not the same as receiving one: the complaint itself does not establish that any money has been returned to Nintendo. The request and allegations appear in the complaint filed with the Court of International Trade.

The complaint’s opening paragraph also alleges that more than $200 billion in tariffs had been collected on imports from nearly all countries. That is a figure asserted by Nintendo in its filing, not an independently verified finding in the cited materials.

How the lawsuit relates to the Supreme Court decision

Nintendo’s complaint says the Supreme Court issued its decision in Learning Resources, Inc. v. Trump on February 20, 2026, affirming the lower-court ruling and striking down the IEEPA duties. It also says the presidential order ending collection took effect on February 24, 2026. This chronology is the account given in Nintendo’s complaint; the subsequent case-specific docket proceedings are separate from that broader legal context.

What the latest visible docket entry says

The latest entry shown in the reviewed Justia docket listing is an order dated July 22, 2026. It directs CBP to reliquidate certain qualifying entries: entries liquidated more than 80 days earlier on which Nintendo made estimated IEEPA-duty deposits, subject to specified importer-identification and CAPE-declaration conditions. The order says the action remains stayed except for the specific actions it directs.

That limited order should not be read as a grant of every refund Nintendo requested. It concerns qualifying entries and particular procedural steps. The docket page also cautions that it may not include newer activity available through PACER, so July 22 is the latest status visible in that listing—not a verified account of the case as of October 2026.

What Nintendo has said publicly

In a comment to TechCrunch, Nintendo said: “We can confirm that we have filed a request. We have nothing else to share on the topic.” The publication’s March 6, 2026 report describes the filing and quotes the company’s response: TechCrunch’s report on Nintendo’s tariff-refund lawsuit.
