What Nintendo won
The U.S. District Court for the Western District of Washington entered the joint stipulated final judgment in Nintendo of America Inc. v. Ryan Michael Daly on September 5, 2025. The filing awards Nintendo $2 million and imposes a permanent injunction. The parties stipulated to the order; it is not a jury’s verdict. Read the stipulated final judgment.
What the order says the case involved
The judgment identifies products and services marketed, distributed, and sold by Daly, including the MIG Switch, the MIG Dumper, mod chips, pre-modified consoles, and console-modification services. It describes the MIG Switch as enabling access to and play of unauthorized or pirated Switch game copies, and the MIG Dumper as enabling users to copy game cartridges to computers or external storage. The judgment states that the conduct violated provisions of the Digital Millennium Copyright Act and copyright law. See the judgment’s description of the devices and violations.
What the permanent injunction requires
The order bars Daly and those acting with him from offering, selling, promoting, distributing, or otherwise trafficking in covered circumvention devices and services. It also restricts related websites and requires Daly to surrender and transfer the Modded Hardware domain to Nintendo’s control. Covered devices and materials may be seized, impounded, or destroyed. The court retains jurisdiction to enforce the order: “The Court shall maintain continuing jurisdiction over this action for the purpose of enforcing this Final Judgment and Permanent Injunction.” Read the injunction.

What Nintendo alleged before the judgment
Nintendo’s June 2024 complaint alleged that Daly operated Modded Hardware, sold circumvention products and services, and distributed unauthorized Nintendo game copies. Those were allegations in the complaint; the later stipulated judgment records the agreed resolution and remedies. Read the complaint.

The $2 million judgment concerns Ryan Daly and Modded Hardware. A separate case against James Williams resulted in a $4.5 million default judgment, reported in September 2026, involving online shops offering pirated Switch games. Williams and Daly are different defendants, and the cases have separate records and procedural outcomes: Daly’s ended in a stipulated judgment, while Williams’s ended in a default judgment. A September 2026 Dutch court ruling against a seller of Switch circumvention devices is also separate: it was decided in another jurisdiction and is not part of the U.S. case against Daly. Read reporting on the Dutch ruling.
