Nintendo Sues the U.S. Government Over IEEPA Tariffs: What the Case Means

Nintendo of America’s trade-court claim and a separate customer class action seek different remedies. The latest located order covers certain entries but does not award a final refund.

Nintendo of America is seeking tariff refunds from the U.S. government, but the latest located court order does not award money or resolve the case. A separate lawsuit by Nintendo customers asks for restitution from the company, based on allegations that tariff costs were passed on through higher prices. The two cases involve different plaintiffs, defendants and remedies.

What Nintendo is challenging

Nintendo of America—not its Japanese parent—is the plaintiff in a case filed March 6, 2026, in the U.S. Court of International Trade. The complaint challenges duties imposed under executive orders invoking the International Emergency Economic Powers Act (IEEPA) and asks the government to refund duties Nintendo says it paid, with interest and related relief. Nintendo’s filing said the measures had resulted in the collection of more than $200 billion in tariffs on imports from nearly all countries. That figure is the company’s allegation about tariffs collected broadly; it is not an estimate of Nintendo’s own potential refund.

Two lawsuits, two different refund questions

The customers’ theory is not a claim against the government for customs duties. It is a separate effort to obtain relief from Nintendo if the plaintiffs can prove their allegations and legal entitlement to restitution.

What the latest located court order does—and does not—do

The docket records that Nintendo’s case was stayed on March 9, 2026, reassigned to Judge Richard K. Eaton on July 14, and subject to an order on July 22. The order directed U.S. Customs and Border Protection (CBP) to reliquidate specified Nintendo entries that had been liquidated for more than 80 days and on which Nintendo made estimated IEEPA deposits. That direction is conditional on CBP accepting Nintendo’s CAPE declarations. The docket also says the action remains stayed except for the order’s specific directions. Public docket

Reliquidation is not the same as a final ruling that all challenged duties must be refunded. The order concerns specified entries and sets out a condition; it does not establish that every Nintendo entry qualifies, guarantee payment, or determine a final refund amount.

Why customers have a separate dispute

The consumer complaint alleges that Nintendo passed tariff costs to customers through higher retail prices, including reported changes involving original Switch products and Switch 2 accessories. The complaint argues buyers should receive restitution if Nintendo also recovers tariff costs from the government. These are the plaintiffs’ allegations, not established facts or a ruling that customers are owed money. Consumer complaint

Ars Technica reported that Nintendo moved to dismiss the consumer case. The company’s reported position is that purchasers voluntarily paid advertised prices and have no legal entitlement to any government refund Nintendo may receive. What is known about the possible money

The cited sources do not establish a final dollar amount for Nintendo’s recovery or any amount that might be paid to customers. The more-than-$200-billion figure in Nintendo’s complaint refers to tariffs collected on imports broadly, not to Nintendo’s payments. Any consumer recovery would also depend on the separate class action and its outcome; the trade-court order does not decide that dispute.

What to watch next

  • In the trade case, whether CBP accepts the CAPE declarations and carries out the order for the specified entries, and what subsequent docket entries say about the stay.
  • In the customer case, whether the court acts on Nintendo’s reported motion to dismiss and how the plaintiffs’ allegations are addressed.
  • Any later filings or rulings that clarify eligibility, amounts, or whether customers can recover from Nintendo. Neither case’s outcome is established by the cited sources.
