What matters can include whether the borrower knew the information was wrong, whether it was material to the lender’s decision, the circumstances in which it was provided, and the law that applies. If you find an error, tell your loan officer or lender promptly, provide the accurate information and supporting documents, and keep a record of what you sent. Do not sign documents you know are inaccurate.
How a mortgage mistake differs from possible fraud
A mortgage mistake is inaccurate information: for example, a transposed digit, a forgotten account, or an outdated figure. A mistake can still matter to a lender and may need to be corrected, but the inaccuracy alone does not establish that a borrower committed fraud.

The FBI describes mortgage fraud as a material misstatement, misrepresentation, or omission relied on by an underwriter or lender. Its borrower-focused examples include overstating income, claiming a job that does not exist, leaving debts off an application, and saying a home will be owner-occupied when it is actually intended as an investment. Those examples illustrate why a lender may care about an answer; they do not mean that every discrepancy proves criminal intent.
Intent and materiality are important, but there is no universal rule that lets a borrower determine legal liability from a single form entry. The Consumer Financial Protection Bureau’s commentary to Regulation Z says that fraud or material misrepresentation is determined under applicable state law and that omissions may count when the required consumer intent exists. The facts, the timing, what the borrower knew, and the law governing the issue all matter. Calling an inaccurate statement a mistake does not settle the question either.

Questions that help put an error in context
| Question | Why it matters |
|---|---|
| Is the information actually inaccurate? | A discrepancy may come from a typo, a changed circumstance, misunderstood wording, or a false statement. First establish what the correct information is. |
| Did the borrower know it was wrong when it was given? | An accidental error and a knowingly false answer are different circumstances. A borrower’s description is relevant, but it does not alone determine the legal outcome. |
| Could the information affect underwriting or funding? | The FBI’s description focuses on a material statement or omission relied on by an underwriter or lender. Whether a particular item is material depends on the facts. |
| Was the error corrected promptly? | Prompt disclosure helps the lender assess the accurate information before proceeding. It is prudent, but it does not guarantee that every consequence is erased. |
| What stage is the loan in, and what law applies? | An application issue, an error in closing papers, and a servicing dispute after closing involve different processes. Legal standards also depend on the applicable law and context. |
These questions are explanatory, not a legal checklist or a way to predict a lender’s decision. If the discrepancy is significant, deliberate, or disputed, consider getting advice from a qualified attorney rather than trying to decide for yourself whether it meets a legal definition.
Application details that deserve careful checking
Income, employment, debts, identity, and intended occupancy are common trouble spots identified in FBI mortgage-fraud guidance. Review these answers against the documents and facts they are meant to describe, and flag changes that occur while the lender is processing the application.
- Income: Check that figures are accurate and supported by the information the lender requests. Do not inflate earnings to qualify for a loan.
- Employment: Confirm employer details and current employment status. Do not claim a job or income source that does not exist.
- Debts: Review liabilities carefully rather than assuming that an account can be left out. Ask the loan officer how to report an item if you are unsure where it belongs.
- Identity: Check names and other identifying information against the relevant identification documents.
- Occupancy: Make sure the stated plan for using the property reflects your actual intention. An owner-occupancy statement can be important to the lender.
These are not the only entries worth checking. Read the application as a whole, including supporting information and any statement prepared for you to review. Look for incomplete answers as well as numbers that seem wrong: a blank or omitted item can be significant depending on what was requested and the circumstances. If your situation changes during processing, such as an employment or income change, ask the lender how to update the file rather than assuming that an earlier answer remains adequate.
If a question is unclear, ask the lender to explain it before answering. Do not guess, change figures to make an application look stronger, or rely on someone else to sign or certify a statement you have not reviewed.
What to do when you find an error
Before signing the application
- Read the application and its supporting documents carefully, including entries prepared by someone else on your behalf.
- Identify each inaccurate or incomplete item and establish the correct information.
- Ask the lender or loan officer to correct the application before you sign, and review the revised version to confirm the change.
- Do not sign blank forms or statements you know are inaccurate. The FBI’s official mortgage-application video advises borrowers to review loan documents for completeness and accuracy before signing.
The FBI special agent speaking in that video puts the advice plainly: “Before you sign a mortgage application or any other loan documents, carefully review them to make sure they are complete and accurate.” Reviewing is not just a formality. If a broker, loan officer, or other person filled in answers for you, compare them with what you told that person and ask about anything you do not recognize. Do not assume that signing means the lender will later catch every mistake.

After submission but before closing
- Contact your loan officer or lender as soon as you discover the error. State which application entry or supporting document is wrong.
- Provide the corrected information and any supporting documents the lender requests. Do not alter or destroy the original records.
- Ask the lender to confirm that it received the correction and updated the loan file. Keep copies of your message, attachments, and any response.
- Answer follow-up questions accurately. CFPB mortgage-application guidance explains that a lender may request additional information or clarification while processing an application.
A clear correction can be short and factual: identify the entry, explain what is inaccurate, give the correct information, and ask what documentation is needed. For instance, if a figure was transposed, state the figure as it appeared and the correct figure; if a debt was omitted, tell the lender about it and ask how it should be documented. Do not speculate about why the entry is wrong if you are not sure. Keep a copy of what you sent and make a note of when and to whom you reported it.
Correcting the record quickly gives the lender a chance to evaluate the accurate information. It does not promise approval, prevent delay, or resolve every legal issue; those outcomes depend on the facts and the lender’s review.

Contact the lender or settlement agent immediately. CFPB guidance says even simple errors can delay closing. Check the names, property address, loan and down-payment amounts, interest rate, and whether any pages are missing. Ask for an explanation and corrected documents before signing; do not assume a figure is harmless just because the rest of the paperwork looks right.
Compare the final papers with the terms and figures you understood you had agreed to, and point to the specific line or page that needs attention. A name or address mismatch may need correction just as a number does. If a page is missing or a term is unclear, ask the lender or settlement agent to explain it and provide complete, corrected papers. Avoid signing a document with blank spaces or amounts you did not previously agree to. Because the CFPB notes that even simple closing-document errors can delay closing, raise the issue as soon as you see it rather than waiting until the signing appointment is over.
After closing: distinguish servicing errors from application issues
If the problem is an error in how the loan is being serviced—rather than an inaccurate application statement—contact the servicer and describe the problem. CFPB guidance on disputing servicing errors says written notice may provide additional protections. If the servicer designates a special address for error notices, use it. Continue scheduled payments while the issue is reviewed. That servicing process is separate from correcting information supplied during origination.

Be specific about what appears wrong and what you are asking the servicer to review. Keep a copy of any written notice and records related to the issue. Do not treat a servicing dispute as a substitute for telling the original lender about a mistake in the application or closing documents; those concerns arise at different stages and may need to go to different parties.

Warning signs that call for a pause and verification
The FBI’s Denver Field Office advisory, dated April 11, 2018, describes warning signs associated with mortgage fraud. A red flag is a reason to slow down and verify facts; it is not proof that a crime occurred.
- Someone pressures you to sign quickly or approaches you unsolicited about a mortgage transaction.
- A document has blank spaces or contains amounts you did not previously agree to.
- A deal promises implausible profits or involves a suspiciously rapid resale of a property.
- You are asked to accept terms you do not understand or to make a statement that does not match your situation.
Before proceeding, confirm names against identification, ask questions about terms you do not understand, and check relevant professional credentials with the appropriate regulator. Review title history when relevant. Protect your email, banking, and mobile accounts with strong passwords and two-factor authentication; account security matters because criminals may try to redirect transaction communications or funds.
If you are unsure whether a message or request is legitimate, verify it using a contact method you already trust, such as a known lender or settlement-agent phone number, rather than replying with sensitive information to an unexpected message. The FBI advisory specifically emphasizes securing email and financial accounts because transaction communications can be targeted. Do not let pressure turn an unresolved question into a signature or a transfer of information you cannot verify.
Possible consequences—and what cannot be assumed
There is no single automatic consequence for every inaccurate mortgage entry. A lender may seek clarification or additional documents during processing, and an error can delay a transaction. The result depends on what happened, when it is identified, how important the information is to the loan decision, and what the applicable law and contract provide.

One specific rule should not be generalized to every home loan. In the high-cost mortgage context addressed by Regulation Z, a creditor may terminate and accelerate the balance of a loan or open-end credit plan when there is consumer fraud or material misrepresentation. The CFPB’s official interpretation ties the determination to applicable state law and recognizes that omissions may qualify when the required intent exists. This is not a rule that allows a lender to call every mortgage due because of any clerical error.
The FBI Denver advisory stated on April 11, 2018, that mortgage fraud could be punishable by up to 30 years in federal prison and a $1,000,000 fine. That is the advisory’s stated maximum, not a typical outcome or a penalty for an ordinary typo. Applicable offenses, sentencing, and current law depend on the facts and law in effect; anyone facing a serious allegation should seek legal advice.
An undated FBI mortgage-application video transcript says that more than half of the mortgage fraud cases the FBI works involve application fraud, but it provides no date or underlying dataset. It should not be treated as a current prevalence statistic. The sources cited here do not establish a verified current figure for how common mortgage application fraud is.

Frequently Asked Questions
I made a mistake on my mortgage application. What should I do?
Contact your loan officer or lender promptly, identify the specific inaccurate or incomplete entry, provide the correct information and any supporting documents requested, and ask for confirmation that the file was updated. Keep copies of your message and documents. Prompt correction is prudent, but it does not guarantee approval or erase every possible consequence.
Is incorrect information on a mortgage application automatically fraud?
No. An inaccurate entry alone does not establish fraud. The FBI describes mortgage fraud in terms of a material misstatement, misrepresentation, or omission relied on by an underwriter or lender. Intent, materiality, circumstances, and applicable law matter; a borrower should not assume either that every mistake is fraud or that calling an entry a mistake resolves the issue.
What if I discover an error in closing documents?
Contact the lender or settlement agent immediately and point to the specific item. Check names, property address, loan and down-payment amounts, interest rate, and whether pages are missing. Ask for an explanation and corrected documents before signing. CFPB guidance notes that even simple errors can delay closing.
What should I do if the problem appears after closing?
First distinguish a servicing error from an inaccurate application statement. For a servicing problem, contact the servicer and describe the error. A written notice may provide additional protections; if the servicer has a designated address for error notices, use it. Continue scheduled payments while the issue is reviewed.
Where can I report suspected mortgage fraud or a scam?
The FBI invites reports to a local FBI office, and its Denver Field Office advisory identifies tips.fbi.gov. Preserve relevant records and avoid sharing additional sensitive information through a channel you have not verified. Reporting a suspicion is separate from contacting your lender to correct your own application.
The Bottom Line
Bottom line: An inaccurate answer is not automatically mortgage fraud, but it should be corrected rather than ignored. Tell the lender or loan officer promptly, provide accurate information and requested documentation, and keep a record. Review every document before signing, raise closing errors immediately, and use the servicer’s process for post-closing servicing disputes. If you suspect a scam, preserve records and report it to the FBI; if you face a material dispute or allegation, seek qualified legal advice.
