MGM Resorts agreed in January 2025 to a $45 million class-action settlement over separate data incidents from around July 2019 and September 2023. The settlement received final court approval on June 18, 2025. The ordinary deadline to submit a U.S. claim was June 3, 2025, and the settlement administrator says approved cash-payment claims were sent on December 12, 2025.
The settlement did not mean a court found MGM legally responsible. MGM denied wrongdoing and liability, and the lawsuits were resolved without a trial. Separate proposed Canadian proceedings are not covered by the U.S. settlement.

What MGM settled
More than a dozen U.S. class-action lawsuits were coordinated around claims arising from two different incidents:

- an incident occurring in or around July 2019; and
- a cybersecurity incident disclosed by MGM on September 12, 2023.
The principal U.S. proceedings included In re MGM International Resorts Data Breach Litigation, Case No. 2:20-cv-00376-GMN-NJK, and Owens v. MGM Resorts International, Case No. 2:23-cv-01480-GMN-NJK. The settlement resolved disputed civil claims; it was not an admission or judicial finding of wrongdoing.

The court granted final approval and entered judgment on June 18, 2025. MGM’s 2025 Form 10-K says the settlement fund was paid by MGM’s insurance carriers in February 2025.
What happened in the two incidents?
The 2019 incident
MGM’s settlement materials describe unauthorized access to personal information in or around July 2019. Depending on the individual, the information could have included a name, address, telephone number, email address, date of birth, driver’s-license number, passport number, Social Security number or military identification number.
Those categories did not apply to everyone. In particular, the settlement materials indicate that varying amounts of information were accessed, so it would be inaccurate to say that every affected customer had a Social Security number or passport number exposed.

On September 12, 2023, MGM said it had detected a cybersecurity issue affecting certain systems, notified law enforcement and shut down some systems as part of its response. In an October 5 update, the company said it had notified relevant customers and arranged credit-monitoring and identity-protection services for them.

MGM later reported in its SEC filing that unauthorized third parties accessed certain U.S. systems and obtained personal information for some customers. The filing identified names, contact information, gender, dates of birth and driver’s-license numbers; for a limited number of customers, Social Security numbers and passport numbers were also accessed.
The 2023 operational attack and the legal question of whose data was compromised are not exactly the same issue. For settlement purposes, the class generally depended on whether MGM notified the person about one or both incidents.
What information was potentially exposed?
The official U.S. settlement website lists these possible categories:
- name;
- address;
- telephone number;
- email address;
- date of birth;
- driver’s-license number;
- passport number;
- Social Security number; and
- military identification number.
Exposure varied by person. “MGM customer” does not automatically mean that every category was involved, and the available information does not support treating all affected records as containing government identification numbers.

How much was the settlement?
The gross U.S. settlement fund was $45 million. That is not the amount each claimant received. The fund also covered court-approved attorneys’ fees and costs, settlement administration expenses and service awards, with distributions governed by the settlement terms.
The listed benefits were:

The $75, $50 and $20 figures were estimates, not guaranteed payments. Final amounts could depend on the number and validity of claims and the settlement’s distribution rules. The structure also did not necessarily compensate every person for inconvenience, anxiety, future identity-theft risk or every type of alleged damage.
Who was covered?
The U.S. settlement generally covered people in the United States whose private information was compromised in one or both incidents and whom MGM sent a breach notice. Judges overseeing the cases and their immediate families were excluded.

Important U.S. dates and current status
- May 19, 2025: deadline to opt out or object.
- June 3, 2025: deadline to submit a claim.
- June 18, 2025: final approval and entry of judgment.
- December 12, 2025: approved cash-payment claims were sent, according to the settlement website.
- December 16, 2025: financial-account-monitoring enrollment emails were scheduled to begin.
As of August 18, 2026, the ordinary U.S. claim deadline has passed. A person who did not submit a claim by June 3, 2025 generally should not expect a new claim form to produce a payment through this settlement.
What should a claimant do now?
- Check prior settlement records. Look for the claim confirmation, payment method selected and any administrator correspondence.
- Use the official website. Go directly to mgmdatasettlement.com rather than clicking an unsolicited link.
- Be suspicious of requests for secrets. A settlement message should not require a password, bank login, cryptocurrency payment or software installation.
- Monitor your identity independently. If you received an MGM breach notice, review financial accounts and credit reports. A credit freeze or fraud alert may provide additional protection.
- Do not assume late filing is available. Identity-protection steps do not reopen the expired claim deadline.
The settlement website’s contact information is the appropriate starting point for questions about an existing claim or payment. Do not provide sensitive information to a phone number or website that cannot be verified through the official domain.

The court-approved settlement ended the covered U.S. litigation for settlement class members who remained in the case. The final judgment released covered claims against the released parties and permanently barred remaining class members from bringing released claims.
That does not mean every possible claim against every party was eliminated. Whether a particular person can pursue an individual case can depend on class membership, whether they opted out, the effective date and the precise claims released. Anyone considering separate litigation should obtain advice from a qualified attorney rather than rely on a general settlement summary.

Canada is a separate proceeding
The Canadian cases are not the same settlement as the U.S. case. The proposed Canadian global settlement described on the Canadian settlement website involved a total fund of CAD $4 million and different class definitions:
- Dahan: the 2023 incident, covering people in Canada;
- Zuckerman: the 2019 incident, covering people in Quebec; and
- Thandi: the 2019 incident, covering people in Canada outside Quebec.
The proposed Canadian benefits included reimbursement for credit monitoring, documented losses of up to CAD $20,000 and fixed payments for certain undocumented losses:
- CAD $150 for people covered by one incident; and
- CAD $300 for people covered by both incidents.
The notices also described possible increases to CAD $500 and CAD $1,000 if funds remained, but payments were subject to deductions and possible pro-rata adjustments.
The Canadian page listed approval hearings for May 20, 2026, in Quebec and May 25, 2026, in British Columbia. Based on the available settlement materials, that procedural information does not by itself establish the post-hearing approval outcome. Canadian residents should use the Canadian administrator’s notices and court orders, not the U.S. deadlines or payment amounts, to determine what applies.
What the $45 million does—and does not—mean
The settlement confirms that the parties chose to resolve the U.S. lawsuits rather than continue through trial. It does not establish that MGM violated the law, was negligent or was found liable. The settlement FAQ states that MGM denied the claims and denied wrongdoing or liability.
It also does not mean every MGM guest received compensation, every affected person was paid $75 or all types of harm were covered. The payment depended on eligibility, the information involved, claim validity and the settlement’s allocation rules.
