Ticketmaster and Live Nation have not been ordered to break up. The U.S. Justice Department’s 2024 complaint sought divestiture, but DOJ later reached a settlement whose proposed terms still require court approval. A coalition of states continued litigating and won a jury verdict on some antitrust claims in April 2026. What happens next—including whether the verdict stands and whether any remedy changes the companies’ structure—depends on further court action.
What is the status of the case?
The case has split into two tracks. DOJ and a group of state attorneys general sued Live Nation and its wholly owned subsidiary Ticketmaster in May 2024. In March 2026, DOJ entered a settlement; its proposed final judgment, filed June 12, describes federal settlement terms. A coalition of states rejected that resolution and continued through trial. On April 15, 2026, a jury found for the litigating states on remaining claims, according to Tennessee Attorney General Jonathan Skrmetti. The DOJ case docket lists the proposed judgment and related filings.
Those events do not amount to a breakup order. The federal settlement is proposed, not effective unless approved under the Tunney Act, and the state verdict is subject to post-trial proceedings. Live Nation’s June 30, 2026 SEC filing said post-trial motions were scheduled for argument on July 31, 2026. The sources available here do not establish the outcome of that hearing or whether the proposed federal judgment was later approved, so the live docket is needed for a definitive current status.
What did the jury find?
Tennessee’s attorney general said the jury found that Ticketmaster unlawfully maintained monopoly power in ticketing services at major concert venues. He also reported findings that Live Nation had monopoly power in large amphitheaters and unlawfully required artists using those amphitheaters to use Live Nation’s event-promotion services. The state coalition said jurors found fans had been overcharged. A separate court phase was to address remedies and financial penalties. The primary materials cited here do not include the verdict form itself, so these findings are attributed to the state coalition’s account.

The verdict should not be read as proof of every allegation in the original complaint. Live Nation said on April 15 that “The jury’s verdict is not the last word on this matter.” The company said it would renew its motion for judgment as a matter of law, challenge damages testimony and appeal unfavorable rulings.
Damages figures have different meanings
Live Nation said the damages award applied to fan purchases—not broker purchases—at 257 venues, about 20% of its total tickets, in certain states over five years. The company described the amount as $1.72 per ticket and estimated aggregate single damages below $150 million before trebling. These are the company’s descriptions and estimate, not a final court-determined total.
Separately, Live Nation’s June 30 SEC filing reported a $280 million initial fund under the federal settlement terms for damages and civil-penalty claims by plaintiff states. The company said six additional states later settled claims for shares totaling approximately $18.6 million. The same filing recognized $450 million for the six months ended June 30, 2026 as its best estimate of ultimate loss associated with settling states and the jury damages award. That accounting estimate is neither the jury’s damages figure nor a judgment.

What did the original lawsuit allege?
The May 23, 2024 complaint alleged that Live Nation and Ticketmaster’s positions across concert promotion, venue relationships and primary ticketing reinforced one another in a self-reinforcing “flywheel,” suppressing competition. The complaint alleged practices including:

- Long-term exclusive venue ticketing contracts.
- Retaliation or threats directed at venues and potential competitors.
- Acquisitions of smaller promoters and conduct involving Oak View Group.
- Tying artists’ use of some Live Nation-controlled large amphitheaters to purchasing Live Nation promotion services.
These were plaintiffs’ allegations, not findings that the jury necessarily resolved in full. The complaint also discussed ticketing fees and dynamic pricing. Those subjects should not be conflated: a ticket’s face value, added fees and resale price are distinct, and the materials cited here do not establish a comprehensive allocation of who sets or receives every charge.
What changes does DOJ’s proposed settlement contain?
The proposed final judgment describes an open distribution and ticket-authentication system. Under the proposed terms, major concert venues that use Ticketmaster’s back-end could distribute primary tickets through eligible third-party providers. It would also allow venues to select Ticketmaster’s back-end without other Ticketmaster products, or to use multiple primary-ticketing back-ends.

These are proposed conduct and access terms, not an ownership separation. They should not be described as operative requirements unless and until court approval is confirmed. The proposal’s focus on distribution, authentication and primary-ticketing back-ends is not equivalent to divestiture of a business.

DOJ’s complaint requested divestiture among a broader set of remedies, but a request is not a court order. The state coalition continued its case after DOJ settled. After the verdict, Skrmetti said, “Next up, the judge will decide the appropriate remedies, and a breakup is absolutely on the table.” That was the attorney general’s view at the time, not a ruling by the court.
The eventual result could depend on whether the verdict survives post-trial motions and appeals, what remedies the court orders for the states, and whether the federal proposed judgment receives Tunney Act approval. The state remedy process and the federal settlement are distinct tracks; neither should be treated as a completed breakup.

How to read future developments
When a new ruling or settlement update appears, check what it actually changes rather than treating every antitrust development as a corporate breakup:
- Status: Is the measure proposed, approved, ordered, appealed or stayed?
- Structure or conduct: Does it change ownership, or regulate business practices and access?
- Part of ticketing: Does it cover venue contracts, primary sales, the back-end, distribution, authentication, promotion or resale?
- Coverage: Which venues, providers, tickets or states qualify?
- Next steps: What approval, compliance, damages or appeal process remains?
The DOJ’s case docket is the key source for federal filings. The state coalition’s verdict account and Live Nation’s SEC filings provide the respective state and company accounts; they are not substitutes for a court order.
