The U.S. Department of Justice alleges that Uber and its drivers discriminated against riders with disabilities by refusing rides, imposing certain fees, and failing to make reasonable policy changes. The lawsuit, filed September 11, 2025, is still proceeding: a court denied Uber’s motion to dismiss on March 5, 2026. That ruling lets the case continue; it does not decide whether the allegations are true.
What is the Justice Department alleging in its Uber disability lawsuit?
DOJ filed the case under Title III of the Americans with Disabilities Act (ADA) in the U.S. District Court for the Northern District of California. Title III bars disability discrimination by private transportation companies such as Uber, according to DOJ. The department announced the suit on September 12, 2025. The complaint alleges that Uber and its drivers routinely refuse rides to people with disabilities, including blind riders traveling with service animals and people using mobility devices such as stowable wheelchairs. Fees and policy changes at issue
The complaint also alleges that riders were charged cleaning fees tied to service-animal shedding and cancellation fees after drivers allegedly denied them service. DOJ says Uber failed to reasonably modify its policies; one example cited is refusing a front-seat option when a rider with a mobility disability needs it. The suit asks the court to order Uber to stop the alleged discrimination and change its policies, among other remedies.
What does DOJ want the court to order?
DOJ says it seeks $125 million for individuals who experienced the alleged discrimination and previously submitted complaints to Uber or DOJ. This is the amount demanded in the September 2025 lawsuit, not money awarded by a court or paid under a settlement. The department also seeks declaratory and injunctive relief, individual damages, a civil penalty, policy changes, and training for Uber staff and drivers. DOJ’s September 12, 2025 release states the requested relief.

What is the current status of the case?
The United States filed its response to Uber’s motion to dismiss on February 6, 2026, and the court denied that motion on March 5, 2026, according to DOJ’s case page. The case has therefore proceeded beyond the dismissal stage on the record reported there. Denial of a motion to dismiss is a procedural ruling, not a decision that the allegations are true or a final judgment on the merits.
How is this different from DOJ’s 2021 Uber lawsuit?
DOJ’s earlier case concerned a different alleged practice: wait-time fees charged to passengers who needed more than two minutes to board because of a disability. The department filed that Title III suit in November 2021; it was resolved in July 2022. DOJ said the agreement would offer several million dollars to more than 65,000 riders and establish fee waivers and a refund process. That resolution belongs to the 2021 wait-time-fee case, not the 2025 lawsuit over alleged ride refusals, service-animal and mobility-device access, fees, and policy changes.
