On April 11, 2025, U.S. District Judge Jeannette A. Vargas allowed Treasury DOGE team member Ryan Wunderly to access specified Treasury payment records and systems—but only after he completed hands-on training required for comparable Treasury employees and submitted a financial disclosure report. The ruling modified an existing injunction for one person; it did not give the DOGE team unrestricted access.
What the judge allowed
In State of New York et al. v. Donald J. Trump et al., a case brought by 19 states in the Southern District of New York, Judge Vargas partially modified a preliminary injunction on April 11, 2025. The exception applied to Ryan Wunderly, a member of Treasury’s DOGE team. It covered Treasury payment records and systems, as well as other Treasury data systems containing personally identifiable information or confidential financial information of payees. Wunderly could not use the access immediately. Before access, he had to complete hands-on systems training typically required for Treasury employees with comparable access and submit an OGE 278 Financial Disclosure Report. The order did not authorize access to every Treasury record or to all federal systems. Order and conditions
Why the injunction was in place
On February 21, 2025, the court had barred Treasury DOGE-affiliated personnel from accessing covered payment records and systems containing personally identifiable or confidential financial information, pending further order. It also required Treasury to report on safeguards and operational processes, including training, vetting and clearances, mitigation measures, legal authority for employment or detail, and reporting lines. The court’s concern was whether those privacy and security safeguards were adequate. Judge Vargas wrote, “Without addressing these issues, the potential consequences of a cybersecurity breach could be catastrophic.” That warning described the risk the court wanted the government to address; it was not a finding that a breach had occurred. By April, the government had submitted additional information about Wunderly and the relevant safeguards. The court concluded that the concerns pertinent to him had been sufficiently addressed to permit a narrow, conditional change. The ruling did not declare all DOGE access lawful or safe in every circumstance. April 11 opinion

The May order broadened the conditional path beyond Wunderly, but access remained tied to the procedures specified by the court. Judge Vargas wrote that the government’s submissions “largely alleviate those concerns.” May 27 opinion

- July 7, 2026: The court observed that DOGE appeared to have dissolved and directed the parties to say whether live issues remained or the claims were moot. The executive order establishing DOGE had scheduled it to terminate on July 4, 2026. July 7 order
- September 23, 2026: The district court dismissed the access claims as moot after the executive order expired and the Treasury DOGE team was disbanded. It dismissed the remaining claims under Rule 12(b)(6) and closed the case. September 23 order
The mootness ruling did not decide the underlying access claims on their merits: the court dismissed those claims because the relevant DOGE structure and Treasury team no longer existed. The reviewed court record establishes the district court’s judgment and case closure, but not whether any appeal or later appellate decision followed. September 23 order
