IRS Installment Agreement vs. Offer in Compromise: Which Fits Your Tax Debt?

An installment agreement repays your full IRS tax debt over time; an Offer in Compromise may settle it for less if your circumstances and financial information meet IRS standards.

If you can repay your full IRS tax debt over time, an installment agreement is usually the more direct option. An Offer in Compromise (OIC) asks the IRS to accept less than the full amount, and is generally worth exploring when you cannot pay in full or full payment would cause hardship. Neither option is guaranteed: the right choice depends on your income, allowable expenses, assets, filing compliance, balance and ability to pay.

What is the difference between an installment agreement and an OIC?

An IRS installment agreement lets you pay your tax liability over time. The debt is not reduced just because a plan is approved. An OIC is a proposal to settle an eligible tax debt for less than the full amount. The IRS reviews whether the offer fits an accepted ground for compromise and what your financial information says about your ability to pay.

As an Amazon Associate I earn from qualifying purchases.

The distinction is practical as well as procedural: a payment plan is a way to repay the full liability in installments, while an OIC asks the IRS to accept a reduced settlement. The IRS advises taxpayers to explore payment options first. Its Form 656-B (Rev. 4-2026) says it generally will not accept an offer if the taxpayer can pay the debt in full through an installment agreement and/or equity in assets.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That means the choice is not simply between a larger monthly payment and a smaller settlement. The IRS looks at whether full repayment is possible, how the taxpayer’s financial circumstances support an offer, and whether the eligibility requirements are met. An OIC is not an automatic alternative for anyone who would prefer to pay less, and an installment agreement does not erase or reduce the underlying liability.

Decision point Installment agreement Offer in Compromise
What happens if approved You pay the full tax liability over time. You pay the amount the IRS agrees to accept under the offer terms.
Central question Can you meet the applicable plan requirements and pay the full liability by the collection statute expiration date? Do you qualify for a compromise, and does the proposed amount reflect the IRS’s assessment of your ability to pay?
Published balance threshold IRS Topic 202 gives $50,000 or less in assessed tax, penalties and interest as the general eligibility threshold for an online long-term plan. Other plan terms and eligibility rules vary. No single balance threshold establishes eligibility. The IRS evaluates the grounds for compromise and the financial facts.
Costs cited by the IRS A direct-debit long-term plan has a $22 setup fee under current IRS payment guidance; qualifying lower-income taxpayers may receive a waiver. A short-term plan of 180 days or less has no setup fee. The IRS Tax Tip 2026-40, dated May 14, 2026, lists a $205 application fee and generally required initial payment. Low-income taxpayers who meet IRS certification guidelines are exempt from both.
What happens to the unpaid balance while the process runs Interest and applicable penalties generally continue on unpaid balances. Collection is generally restricted during specified pending and appeal periods, subject to exceptions. The IRS may file a federal tax lien while an offer is pending.
If the option does not work If an approved plan becomes unaffordable, contact the IRS to discuss other options, which may include an OIC or temporary collection delay. You may appeal a rejection within 30 days. If no additional tax debt was incurred, the IRS says an existing installment agreement will be reinstated without another fee.

These are starting points, not guarantees. A taxpayer may be able to request a plan but fail to qualify for a particular plan type, while OIC acceptance depends on the IRS’s review of the taxpayer’s full circumstances. Check current IRS guidance and forms before applying because fees, thresholds and online features can change.

Pay attention to what each threshold measures. The $50,000 online long-term plan figure includes assessed tax, penalties and interest. The $10,000 limit for a guaranteed installment agreement, by contrast, is tax owed excluding penalties and interest. Neither figure alone tells you what monthly payment the IRS will approve or whether an OIC is likely to be accepted.

When an installment agreement may fit

A plan is the more straightforward route when you can pay the full debt in installments and meet the terms for the plan you are requesting. It avoids asking the IRS to reduce the amount owed. Before choosing it, work out whether the scheduled payment is realistic alongside necessary living expenses and other obligations. A plan that you cannot maintain is not a useful solution.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Know which eligibility rule you are considering

The $50,000 figure in IRS Topic 202 applies to the general online long-term plan threshold: the assessed total of tax, penalties and interest must be $50,000 or less. It is not the same test as eligibility for a guaranteed installment agreement, and it should not be read as a promise that every taxpayer under that amount will be approved for any requested terms.

For a guaranteed installment agreement, the IRS describes a narrower set of requirements for an individual: tax owed must be $10,000 or less, excluding penalties and interest; the taxpayer must have timely filed and paid for the prior five years; must not have entered a qualifying agreement during that period; must be unable to pay in full when the tax is due; and must agree to pay the full amount within three years. These conditions are specific to the guaranteed agreement and are not a general description of every IRS payment plan.

For other installment agreements, terms and eligibility vary. Do not assume that meeting the online balance threshold qualifies you for the guaranteed agreement, or that a balance above the threshold means no payment arrangement is possible. Check the IRS’s current payment options for the plan that matches your balance and circumstances. The relevant test for an installment agreement is not only whether you can start paying, but whether the full liability can be paid by the collection statute expiration date.

Estimate whether the payments are manageable

Review the balance shown on your IRS account or notice, then compare a plausible monthly payment with your actual budget. Remember that a plan does not freeze the debt: interest and applicable penalties generally keep accruing while an amount remains unpaid. If a proposed payment leaves no room for essential expenses or predictable bills, reassess the plan before committing.

For a direct-debit long-term plan, current IRS payment guidance lists a $22 setup fee. Qualifying lower-income taxpayers may get the fee waived. A short-term plan lasting 180 days or less has no setup fee. Those setup-fee rules do not mean the debt itself stops growing while it is unpaid.

Compare the plan payment with a realistic budget rather than an unusually strong month. Consider whether you can make the payment consistently while covering necessities and other obligations. If your circumstances change after approval and the payment no longer works, contact the IRS; do not assume that missing payments will automatically revise the agreement. A new arrangement, an OIC or a temporary collection delay may be worth discussing, depending on the facts.

When an Offer in Compromise may be worth exploring

An OIC may be appropriate to investigate if you cannot pay the tax liability in full, or if paying it in full would cause economic hardship or be unfair in exceptional circumstances. The IRS evaluates the grounds for compromise along with financial information, including income, allowable expenses and equity in assets. Its assessment generally centers on reasonable collection potential: whether the amount offered is consistent with what the IRS believes it can collect from you.

This is not a discount request based simply on wanting a smaller bill. A low proposed amount is not automatically a strong offer. If the IRS determines that full payment is possible through an installment agreement or asset equity, it generally will not accept the offer. The facts matter more than the amount a taxpayer hopes to pay.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

In practical terms, being unable to pay the entire amount today does not by itself establish that an OIC is appropriate. The IRS considers the overall picture, including income, expenses it allows, and equity in assets, to assess ability to pay. A taxpayer with assets or income that support full repayment may not qualify for a reduced settlement simply because a lump-sum payment is difficult. Conversely, a taxpayer facing hardship may have grounds to explore compromise, but acceptance still depends on the IRS’s review.

Check the basic eligibility conditions first

The IRS’s OIC guidance says you must have filed required tax returns, received a bill for at least one tax debt included in the offer, made required estimated tax payments, and not be in an open bankruptcy proceeding. Employer taxpayers also face federal tax-deposit conditions. If a required return or estimated payment is missing, address that compliance issue rather than assuming an offer application will resolve it.

These are threshold conditions, not a promise that the IRS will accept the proposed amount. Before spending time preparing an offer, confirm that the included tax debt has been billed and that required filing and payment obligations are current. An open bankruptcy proceeding is a separate bar to OIC eligibility. Employers should pay particular attention to the additional federal tax-deposit conditions that apply to them.

Use the Pre-Qualifier as a screening aid, not a decision

The IRS OIC Pre-Qualifier can help check possible eligibility and prepare a preliminary proposal. Its result is not an acceptance, a guarantee of eligibility or a substitute for the IRS’s review. Use it to understand whether pursuing an offer appears plausible, then rely on current IRS instructions for the application and supporting financial information.

What the OIC application costs and requires

The IRS Tax Tip 2026-40, published May 14, 2026, lists a $205 application fee for an OIC, plus an initial payment in most cases. Taxpayers who meet the IRS low-income certification guidelines do not have to pay the fee or make the initial payment. Confirm the current Form 656-B instructions for the terms you intend to propose; fee amounts and requirements can change.

Payment timing depends on the offer type. A lump-sum offer generally requires 20% of the proposed amount with the application. A periodic-payment offer generally requires the first installment with the application and additional payments while the IRS reviews the offer. These are application-payment rules, not a statement that the IRS has accepted the offer.

Preparing an offer requires a complete and accurate picture of your finances. The IRS considers income, allowable expenses, asset equity and ability to pay. Gather records that support the amounts you report and make sure required returns and payments are current. Do not choose a proposed amount solely because it is affordable in the short term; the offer must also meet the IRS’s standards for compromise.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Application payments and fees are distinct from the amount eventually accepted under an offer. The 20% lump-sum payment or first periodic installment is due with the application under the applicable offer terms, and periodic payments generally continue during review. Read the current Form 656-B instructions carefully so you understand which payment schedule you are proposing and what must accompany the submission.

Low-income treatment depends on meeting the IRS certification guidelines, not simply describing yourself as low income. Eligible taxpayers may be exempt from both the $205 application fee and required initial payment. Check the current instructions to determine whether you meet the guidelines and how to certify; do not assume a waiver applies without confirming the requirements.

How to choose and take the next step

  1. Confirm the debt and filing status. Review IRS notices or your IRS online account to identify the tax periods and balances involved. Check that required returns have been filed and that required estimated payments are current.
  2. Decide whether full repayment is realistic. Make a workable budget and consider how quickly you can pay the full liability. For an online long-term plan, compare your assessed balance with the $50,000 threshold in IRS Topic 202; do not confuse that general threshold with the separate guaranteed-agreement criteria.
  3. Consider an installment agreement if full repayment is feasible. Review available plan terms and setup costs through current IRS payment guidance or your online account. Choose a payment you can sustain, rather than a number that only works in an unusually good month.
  4. Consider an OIC if full repayment is not feasible or would create hardship. Review the IRS’s compromise grounds, run the Pre-Qualifier if useful, and read the current Form 656-B instructions. Assess income, allowable expenses and asset equity honestly before deciding what to propose.
  5. Compare the true costs and consequences. Include any applicable setup or application fee, required initial payments, the continuing accrual of interest and penalties on unpaid balances, and the collection and lien rules that may apply.
  6. Submit only after checking the current requirements. Follow the current IRS process and forms for the option selected. Keep copies of the submission and payment records, and respond to IRS requests for information.

If you have a complicated financial situation, substantial assets, multiple tax periods or uncertainty about what to disclose, a credentialed tax professional may be able to help assess the options and prepare an application. Verify a representative’s credentials. No representative can guarantee that the IRS will approve an installment agreement on requested terms or accept an OIC.

When reviewing your options, keep the goals distinct. A plan is aimed at paying the full liability by installments; an OIC is a request for the IRS to accept a compromise based on an eligible ground and ability-to-pay review. In either case, use the current IRS process and instructions rather than relying on a company’s advertised settlement estimate or an old fee figure. The IRS’s online account, payment guidance, Pre-Qualifier and current forms are the official places to start.

Collection delays and tax liens

If you cannot afford payments now, ask whether you qualify for currently-not-collectible status or another temporary collection delay. A delay does not erase the debt, and interest and penalties may continue. The IRS’s guidance on understanding an LT16 notice describes temporary delay as a collection option rather than debt forgiveness.

An OIC can affect collection timing, but it does not automatically remove a federal tax lien. The IRS says collection is generally restricted during specified pending and appeal periods, with exceptions, and it may file a lien while an offer is pending. An existing lien is released only after the offer terms have been satisfied. Do not treat filing an offer as immediate lien removal.

Collection timing and the balance owed are separate issues. A temporary delay may provide breathing room when a taxpayer cannot afford payments, but it does not settle the debt or stop the possibility of continued interest and penalties. Similarly, restrictions that apply while an offer is pending or during an appeal do not mean collection is suspended in every circumstance, and they do not guarantee that a lien will be removed. Check the IRS’s current guidance for the specific collection status and notice involved.

If your application is rejected or your plan becomes unaffordable

If an OIC is rejected

The IRS says you may appeal an OIC rejection within 30 days. Review the rejection notice for the reason and the instructions for requesting review. If you have an existing installment agreement and incurred no additional tax debt, the IRS says it will reinstate that agreement without another fee. The 30-day appeal period makes it important to read the notice promptly.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not let the appeal deadline pass while deciding what to do. The rejection notice should explain the basis for the decision and how to request an appeal. If you appeal, address the stated reason and follow the notice’s process. If you decide not to appeal, revisit whether another payment option or a temporary collection delay fits your circumstances. Rejection does not itself mean that every other IRS option is unavailable.

If an installment agreement stops fitting your budget

Contact the IRS rather than silently missing payments or assuming the terms will adjust automatically. Depending on your circumstances, another plan arrangement, an OIC or a temporary collection delay may be relevant. Reassess your budget and ability to pay before proposing a change.

Watch for promises of guaranteed tax-debt relief

The IRS warns taxpayers about “OIC mills” that overpromise results and charge high fees. An outside company cannot make the IRS accept an offer. Be cautious of claims that a particular settlement is assured before the IRS has reviewed your eligibility and financial information. The IRS recommends using its own Pre-Qualifier and checking the credentials of anyone you hire to assist.

Professional help can be useful for a complex case, but it is optional and should not be confused with a guarantee of relief. If you hire someone, verify the person’s credentials and be wary of high-pressure claims that you have been preapproved or that the IRS will accept a particular amount. The decision depends on the IRS’s own review of the applicable requirements and your financial information.

Frequently Asked Questions

Is an installment agreement or an Offer in Compromise better?

Neither is better for everyone. An installment agreement may fit if you can pay the full liability over time and meet the applicable plan terms. An OIC may be worth exploring if you cannot pay in full or full payment would cause hardship, and the IRS’s review supports compromise.

Does owing $50,000 or less mean I qualify for an IRS payment plan?

IRS Topic 202 gives $50,000 or less in assessed tax, penalties and interest as the general threshold for an online long-term plan. It is not a guarantee of approval for every plan or requested term. The guaranteed installment agreement has separate requirements, including a $10,000 tax limit excluding penalties and interest for individuals.

How much does an IRS Offer in Compromise cost?

The IRS Tax Tip 2026-40, dated May 14, 2026, lists a $205 application fee plus an initial payment in most cases. Qualifying taxpayers who meet IRS low-income certification guidelines are exempt from both. A lump-sum offer generally requires 20% with the application; a periodic-payment offer generally requires the first installment and further payments during review. Check current Form 656-B instructions.

Can I apply for an OIC if I have not filed all required returns?

The IRS says required returns must be filed, required estimated tax payments made, and a bill received for at least one debt included in the offer. An open bankruptcy proceeding prevents OIC eligibility. Employer taxpayers also have federal tax-deposit conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does filing an OIC remove a federal tax lien?

No. The IRS may file a lien while an offer is pending, and an existing lien is released only after the offer terms are satisfied. Collection is generally restricted during specified pending and appeal periods, subject to exceptions, but filing does not automatically remove a lien.

What if I cannot afford any payment right now?

Ask the IRS whether you qualify for currently-not-collectible status or another temporary collection delay. A delay does not erase the tax debt, and interest and penalties may continue.

Can I appeal if the IRS rejects my OIC?

The IRS says you may appeal a rejection within 30 days. Read the rejection notice promptly for its reason and the process for requesting review. If you have an existing installment agreement and incurred no additional tax debt, the IRS says it will reinstate that agreement without another fee.

Does the IRS OIC Pre-Qualifier guarantee acceptance?

No. The Pre-Qualifier can check possible eligibility and help prepare a preliminary proposal, but it does not guarantee eligibility or acceptance and does not replace the IRS’s review.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Bottom Line

Choose an installment agreement when full repayment is realistic and the plan terms fit your budget. Explore an OIC when you cannot pay in full or full payment would cause hardship, but expect the IRS to review your eligibility, income, allowable expenses and asset equity. Confirm current IRS requirements and fees before applying; neither option guarantees a particular result.
