In Summit Carbon Solutions, LLC v. Kasischke, the Iowa Supreme Court affirmed an injunction allowing Summit to enter Kent Kasischke’s property temporarily to conduct pipeline surveys. The November 22, 2024 decision rejected a facial constitutional challenge to Iowa’s survey-access law, held that supercritical carbon dioxide qualifies as a hazardous liquid under the law, and upheld Summit’s compliance with the notice requirements. It does not decide every possible dispute about how a survey is conducted or what happens if a particular entry causes damage.
What the Iowa Supreme Court decided
The court affirmed the Hardin County District Court’s order granting Summit Carbon Solutions access under Iowa Code section 479B.15. Summit sought to conduct preliminary civil, environmental, archaeological, and soil surveys along its proposed pipeline route; Kasischke refused access, and Summit pursued an injunction. Justice Waterman delivered the Iowa Supreme Court’s unanimous opinion in Summit Carbon Solutions, LLC v. Kasischke, No. 23-1186, filed November 22, 2024. The court’s 2024 description said the proposed network covered more than 2,000 miles across Iowa, Minnesota, Nebraska, South Dakota, and North Dakota, including more than 700 miles in Iowa across thirty counties. Those are figures describing the proposal as the court recounted it, not a current route or project-status update.
Why the court rejected the constitutional challenge
Kasischke argued that compelled entry for surveys took his right to exclude others, violating the Fifth Amendment to the U.S. Constitution and article I, section 18 of the Iowa Constitution. The court rejected this facial challenge, reasoning that section 479B.15 is a longstanding background limitation on property title. It characterized the statute’s authorization as temporary, limited access to survey a proposed route and determine a pipeline’s direction or depth.

The opinion stated: “We hold that land surveys allowed in Iowa Code section 479B.15 are longstanding background restrictions that permit temporary access onto private property without triggering a constitutional taking.” The holding addresses the statute on its face; it does not resolve every potential challenge to a particular survey’s notice, manner, or effects. Nor does temporary survey access itself grant the company permanent possession, a pipeline easement, or authority to build on the land.
Why Summit qualified under chapter 479B
Section 479B.15 grants survey-access rights to a pipeline company. Kasischke disputed whether Summit qualified when it planned to transport carbon dioxide in a supercritical state. The court held that the supercritical carbon dioxide Summit proposed to transport was a “hazardous liquid” under chapter 479B, making Summit a pipeline company for purposes of the statute. The opinion relied on affidavit testimony in the record for this appeal.

What Iowa Code section 479B.15 requires
The 2026 version of section 479B.15 allows a pipeline company to enter private land to survey and examine it to determine pipeline direction or depth after an informational meeting or, if no meeting is required, after filing a petition. It requires ten days’ written notice by restricted certified mail to the landowner and to any person residing on or in possession of the land. Consult the 2026 Iowa Code, section 479B.15.
The statute says qualifying survey entry is not trespass and “may be aided by injunction.” It also requires the pipeline company to pay actual damages caused by entry, survey, and examination. The Supreme Court affirmed the finding that Summit met the statutory notice requirements in this case. That fact-specific ruling should not be read as a general rule that notice to a tenant or another person in possession is unnecessary.

Why no separate irreparable-harm showing was required
Kasischke argued that Summit should have to prove irreparable harm or substantial injury under the ordinary equitable standard for an injunction. The court concluded that the statutory requirements were sufficient for injunctive relief in this case; Summit did not also have to make that separate showing. The opinion noted that Summit qualified as a pipeline company, held the informational meeting, filed a permit petition, provided the required notice to owners and any tenants, and gave ten days’ notice.

What the ruling means for landowners
- Survey access is not the same as a taking for construction. The case concerned temporary statutory access for surveys, not a final right to acquire the property or construct a pipeline.
- Notice and access depend on the statute and the facts. The 2026 text specifies who must receive restricted certified-mail notice and the ten-day period; the court upheld Summit’s compliance on this record.
- Damage claims remain distinct. Section 479B.15 requires payment of actual damages caused by entry, survey, and examination. The facial constitutional ruling did not eliminate that statutory remedy or decide every dispute about a particular entry.
- The decision does not update the project’s status. It addresses Summit’s survey-access request in 2024, not current permitting, construction, or route developments.
