India GST Refund Reforms: Automation, Provisional Refunds and Proposed Timelines

India’s proposed GST refund reforms would automate selected claims and shorten acknowledgement timelines, but the proposed changes should not be mistaken for operative rules or a guaranteed payment date.

The proposed GST refund reforms are not a guarantee of an automatic payout or a fixed payment date. Official 2026 material describes recommendations for automated refunds in selected cases, a shorter acknowledgement window and a provisional payment route. It does not, by itself, establish that the changes have commenced. Check the final notifications and effective dates before relying on the proposed timelines for a claim.

What the GST refund reforms propose

The Goods and Services Tax Council’s recommendations, reported by the Press Information Bureau (PIB) in 2026, propose amendments to section 54 of the CGST Act and relevant rules. The package addresses three claim categories: excess electronic cash ledger balances, zero-rated supplies and inverted duty structure (IDS) refunds. The recommendations describe a phased shift toward system-led processing, not an automatic approval for every applicant.

Claim or process Proposed change Important limit
Excess electronic cash ledger balance Automatic sanction of the full eligible refund by the system, without officer intervention. Applies to the eligible excess balance claim; it does not make other refund categories automatic.
Zero-rated supplies and IDS Risk-based provisional sanction of 90% of the claimed amount for selected claims. The recommendation specifies risk identification and evaluation; the process described retains final officer scrutiny.
Zero-rated supplies, Phase 2 Automated acknowledgement and full sanction of the eligible refund after pending dues are adjusted, based on risk evaluation. The published description of Phase 2 concerns zero-rated claims. Do not assume it extends to every IDS claim.
Application data RFD-01 would capture information in system-readable form, with scanned uploads dispensed with for zero-rated and IDS claims. This is a proposed form and process change, not evidence that current filing requirements have already changed.

Other proposed calculation changes

The recommendations also propose removing the 1.5-times domestic like-goods value ceiling used for turnover of zero-rated goods under Rule 89(4)(C). They would clarify that the ₹1,000 minimum threshold applies to the combined CGST, SGST/UTGST and IGST refund amount. These are proposed changes; apply the operative rule in force for the relevant claim period.

Which timelines are proposed, and which appear in the published rule?

The key distinction is between the revised periods described in the PIB FAQ and the published CBIC rule text. The FAQ presents the shorter periods as proposed; the published Rule 91 text reviewed sets a different existing limit for a provisional order.

Stage Proposed reform described in 2026 official material Published rule baseline in the CBIC text reviewed
Acknowledgement or deficiency memo Within 10 days for the relevant categories, reduced from 15 days; if neither document is issued within 10 days, the application would be deemed acknowledged. The proposed 10-day window should not be treated as operative unless the final amendment and commencement date establish it.
Provisional refund order, FORM GST RFD-04 The PIB FAQ describes system issuance within three working days after acknowledgement. Rule 91 states that the proper officer is to issue the provisional refund order within a period not exceeding seven days from acknowledgement, subject to the rule’s conditions.
Interest for delayed refund This is not a new proposed acknowledgement or provisional-payment deadline. Section 56 provides an interest framework for eligible delayed refunds beyond 60 days from receipt of the application, subject to applicable rates and prescribed conditions.

The three-working-day proposal and seven-day Rule 91 period refer to different sources and legal positions; they are not interchangeable. The 60-day interest provision is a separate statutory safeguard, not a promise that a claim will be paid on day 60.

What does deemed acknowledgement mean?

Under the proposal, if the officer issues neither FORM GST RFD-02 (acknowledgement) nor FORM GST RFD-03 (deficiency memo) within 10 days, the system would treat the application as acknowledged. That procedural status would start the processing timeline. It would not mean the system has approved the claim, confirmed eligibility or sanctioned money.

Who may qualify for the 90% provisional route?

The PIB FAQ describes the proposed automated 90% provisional route for low-risk zero-rated and IDS claims after acknowledgement. Risk classification is material: the proposal is not a universal advance payment for all claims. Statutory withholding restrictions under section 54(10) and (11) continue to matter where applicable, and a claim may be subject to officer scrutiny rather than the proposed automated route.

Exclusions and scrutiny flags identified in the FAQ

  • Certain notified persons dealing in commodities such as areca nuts, pan masala, tobacco and manufactured tobacco substitutes, and essential oils.
  • Applicants who have not completed Aadhaar authentication under Rule 10B.
  • Specified linked proceedings or forms, including a DRC-01 against an RFD-06; an APL-03 without a corresponding APL-04; or an APL-07 against an appellate order while an APL-04 is pending.
  • For IDS claims, goods notified under Notification No. 5/2017-Central Tax (Rate), as amended, are identified as restricted from refund of unutilized ITC.
  • Rule 91’s published text also includes conditions concerning prosecution for specified tax evasion, GST compliance rating where available, and pending appeal, review or revision on refund issues.

The exact effect depends on the current amended rule and the taxpayer’s facts. A low-risk classification does not override a statutory restriction or a pending-proceeding condition.

How the proposed application workflow would work

  1. File: Submit FORM GST RFD-01 electronically through the Common Portal for the relevant refund category.
  2. Wait for acknowledgement or deficiency notice: Under the proposed timeline for relevant claims, the officer issues RFD-02 or RFD-03 within 10 days. If neither is issued, the system would deem the application acknowledged.
  3. Provisional stage, if eligible: For qualifying low-risk zero-rated and IDS claims, the proposal provides for 90% provisional sanction through RFD-04, with payment advice in FORM GST RFD-05. The PIB FAQ gives three working days from acknowledgement as the proposed RFD-04 period.
  4. Final processing: The described process proceeds to proper-officer scrutiny and FORM GST RFD-06. The provisional amount is accounted for in the final order; outstanding-demand adjustments may also be relevant.
  5. If a deficiency memo is issued: Correct the deficiencies and file a fresh RFD-01 rather than treating the original application as carried forward. The FAQ says amounts debited from the electronic credit or cash ledger are re-credited after the deficiency memo.

Non-low-risk claims remain subject to proper-officer scrutiny under the process described in the FAQ. A deficiency memo requires correction and refiling, rather than a presumed approval.

What to check before relying on a refund date

  • Claim category: Is it an excess cash ledger balance, a zero-rated supply refund or an IDS claim?
  • Legal commencement: Has a final amending notification taken effect for the period and claim involved?
  • Application status: What are the RFD-01 filing date and any RFD-02 acknowledgement or RFD-03 deficiency memo date?
  • Risk and exclusions: Does the proposed low-risk route apply, and are any commodity, authentication, proceeding or statutory withholding restrictions relevant?
  • Stage and amount: Is the claim at provisional or final processing, and are pending dues or other adjustments involved?

These checks matter because the official 2026 release and FAQ describe recommendations and proposals, while the CBIC rules set the published baseline. Confirm current notifications, rule amendments and portal instructions before treating a proposed period as binding in an individual case.
