The rules involve both a central framework for online money games and state or union-territory law; an app being available, advertised or usable does not prove that using it is lawful where you are. Before depositing money, check the current law and court position for your location—and do not treat this article as a legal ruling on a particular app.
What is the legal position on betting apps in India?
India’s legal position has changed over time and cannot be reduced to a single state-by-state list. A December 2022 answer in Parliament described betting and gambling as State subjects and said states had enacted laws addressing gambling, including online gambling, within their jurisdictions. That is useful historical context, but it predates the central measures reported in 2026 and is not a complete guide to current law in any state.
The Ministry of Information and Broadcasting reported in March 2026 that the Promotion and Regulation of Online Gaming Act, 2025 prohibits online money games. News On AIR reported on 1 May 2026 that the Promotion and Regulation of Online Gaming Rules, 2026 came into force that day, operationalising the Act. Its report describes the prohibition as covering online money games based on chance, skill, or a mixture, along with related advertising and financial transactions. These reports point to a central restriction as well as state-level rules; they do not establish the present status of every app or resolve how every provision applies in every situation.
The legal position can depend on the service, whether money or something of value is involved, your location, the applicable central and state rules, and any relevant court decision. The available government summaries do not provide enough verified detail to determine whether a named app is lawful for a particular user. For a specific decision, check the current statute and Gazette Rules, official state or union-territory sources, and the latest court record, or consult a qualified lawyer.

Why app availability and promotions are not proof of legality
- An app store listing or working website: Access does not establish that a service complies with the law where you live.
- Offshore hosting or branding: An operator’s location does not, by itself, establish that use from India is lawful or that you have effective consumer protections.
- An endorsement or advertisement: The Central Consumer Protection Authority’s 6 March 2024 advisory says betting and gambling are prohibited in most regions and warns against promoting activities prohibited by law. The Ministry of Information and Broadcasting’s advisory list includes a 5 June 2026 notice concerning celebrity and influencer endorsements and advertisements, including surrogate advertising, for offshore betting and gambling platforms.
- A payment method that works: A successful deposit or withdrawal does not certify that the app or the transaction is lawful. News On AIR’s 1 May 2026 account of the Rules also describes restrictions on financial transactions linked to prohibited online money games.
The CCPA’s statement that betting and gambling are prohibited in most regions appeared in its 2024 advisory and should not be mistaken for a complete account of the framework reported in 2026. The CCPA grounded its advisory in the Consumer Protection Act, 2019 and the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022. Its position is relevant to promotions, but it does not decide whether a specific app is lawful in your location.
How to assess an app before risking money
- Identify your location. Start with the state or union territory where you will use the service. Do not assume that a rule described for another location applies to you.
- Check what the service offers. Determine whether it involves paying money or staking something of value for a possible return. The government’s 2026 summaries describe the central prohibition in terms of online money games, including games based on chance, skill, or both; an operator’s label for its product is not a legal determination.
- Use current official sources. Look for the applicable central Act and Gazette Rules, your state or union-territory laws and official notices, and current court decisions. The 2022 parliamentary answer and CCPA’s 2024 advisory are older than the 2025 Act and 2026 Rules, so they cannot settle today’s question on their own.
- Separate official information from operator claims. Marketing, influencer posts, app-store descriptions, and customer-service assurances are not substitutes for legislation, official guidance, or legal advice.
- Do not use a workaround to force access. Avoid relying on VPNs, alternate payment routes, or offshore accounts to bypass a restriction. Such a workaround does not make the underlying activity lawful and can add account, payment, and recovery risks.
Financial and consumer risks if you proceed
Even apart from the legal question, depositing money can expose you to losses and disputes over account access, withdrawals, or transactions. Do not use borrowed money or funds needed for bills, rent, debt payments, or emergencies. Never share one-time passcodes, banking credentials, or remote access to your device with an operator or someone claiming to help you.

If you have already paid and a withdrawal or account dispute arises, keep the app name, transaction records, messages, and screenshots. Contact your bank or payment provider promptly about the transaction and ask what dispute or fraud-reporting options are available. Do not pay an additional “release” or “recovery” fee to an unknown party without independently verifying who is requesting it.

The CCPA’s 2024 advisory says the misleading-advertising guidelines apply across media and warns that advertisements or endorsements for activities prohibited by law may be scrutinised. The advisory identifies advertisers, publishers, intermediaries, social platforms, endorsers, and other stakeholders as potentially subject to measures. The MIB’s 5 June 2026 listing of an offshore betting and gambling advertising notice is a further reason not to treat a celebrity endorsement or a polished promotion as evidence of legality or safety. These advertising materials do not, on their own, determine the legal status of every app or user.
