No: the quantities in CBDT jewellery seizure guidance are not an automatic ceiling on how much family jewellery a taxpayer can explain in an assessment. In Ankur Sharma v. DCIT, the Delhi Bench of the Income Tax Appellate Tribunal (ITAT) directed deletion of a ₹20,44,870 addition, but its decision turned on the family’s circumstances and declared income—not on a blanket exemption for jewellery above the CBDT quantities.
What did the ITAT decide?
In its order pronounced on 6 October 2023, the Delhi ITAT held that CBDT Instruction No. 1916 and the related 2016 press release concern seizure of jewellery during searches. The quantities discussed in that guidance should not be mechanically treated as a cap on jewellery that may be explained when assessing a taxpayer’s holdings.

The order put the point plainly: “It is never envisaged that the Assessing Authority should restrict the amount of eligible jewellery to the quantity mentioned in the circular.” The tribunal directed the assessing officer to delete the ₹20,44,870 addition to Ankur Sharma’s income and allowed his appeal for assessment year 2019–20. Why did the tax department treat part of the gold as unexplained?
During an income-tax search at the family’s Ghaziabad residence, officers found 3,877.5 grams of gold jewellery valued at ₹1,46,15,635. The assessing officer accepted 2,250 grams for nine family members by reference to the CBDT guidance discussed in the order. The officer treated the remaining 1,627.5 grams, valued at ₹61,34,610, as unexplained.

That amount was divided equally among three family members, resulting in an addition of ₹20,44,870 to each person’s income. Sharma challenged his share. The addition was made under section 69A read with section 115BBE of the Income-tax Act, 1961.
The family said the jewellery had accumulated over generations through inheritance, weddings and customary gifts. The lower authorities noted that the family had not furnished purchase bills, wealth-tax records or valuation certificates establishing the jewellery’s source and acquisition date. Those concerns formed part of the dispute; the tribunal also considered the family’s reported income history and circumstances.

What the CBDT quantities do—and do not—mean
Seizure guidance
The ITAT characterized Instruction No. 1916 and the 1 December 2016 press release as guidance concerning seizure of jewellery during searches. It said an assessing authority should not mechanically restrict the quantity of eligible jewellery to the quantities mentioned there when deciding whether the holdings are explained.
Assessment evidence
The ruling does not make those quantities a statutory possession limit, nor does it mean that exceeding them automatically creates a tax liability—or that any amount above them is automatically accepted. The question in an individual assessment remains whether the taxpayer’s explanation for the jewellery, its ownership and its source is credible in light of the record and circumstances.

Why this is not an automatic exemption
The deletion was specific to Sharma’s case. The tribunal considered the family’s explanation, reported income history and circumstances; it did not establish a universal rule that family jewellery is explained merely because it is inherited, gifted or held for a long time. Missing records mattered to the lower authorities’ assessment, so the decision should not be read as making documentation irrelevant.
For anyone responding to a search or assessment, records that help show ownership and provenance—such as bills, inheritance documents, gift records, valuation material or earlier tax and wealth records where available—may help explain the facts. The order does not prescribe a mandatory checklist, and the useful evidence will depend on how the jewellery was acquired and the circumstances of the case.
