In March 2026, a federal court sentenced the company to a $50 million fine and five years of probation. The criminal sentence is separate from Motorola’s civil lawsuit, where damages, royalties, payments and other issues have followed their own course.
What Hytera admitted in its guilty plea
According to the U.S. Department of Justice’s summary of the plea agreement, individuals acting to benefit Hytera agreed in 2008 to take documents and source code related to Motorola’s digital mobile radio (DMR) technology. Some of that information was later used to develop Hytera products, some of which were sold in Illinois. The agreement said the individuals knew or reasonably believed that some information was Motorola’s protected trade secret and that taking it could potentially injure Motorola. DOJ’s January 2025 plea announcement describes the conduct covered by the company’s plea.
The plea was to one count of conspiracy to steal trade secrets. It should not be treated as an admission to every allegation in the earlier indictment. In 2022, prosecutors alleged a broader scheme running from 2007 through 2020, including the recruitment of former Motorola employees and the use of proprietary information to develop products, train employees, and market and sell products internationally. Those were indictment allegations, not facts admitted in the later plea. DOJ emphasized at the time that an indictment is not evidence of guilt and defendants are presumed innocent. The indictment announcement sets out those allegations.
What sentence did Hytera receive?
On March 9, 2026, DOJ announced that the court imposed a $50 million criminal fine and five years of probation. The probation requires Hytera to maintain an effective compliance program and report annually to the government. The $50 million is the imposed fine; DOJ’s January 2025 release had described a plea agreement allowing for a fine of up to $60 million, before sentencing determined the actual amount.

DOJ also reported that Judge John J. Tharp, Jr. found Hytera caused Motorola to lose $214 million in profits. The court ordered no additional restitution because Hytera’s payments arising from the civil judgment offset restitution in full. The sentence announcement does not explain the judge’s reasons for choosing the fine and probation term. DOJ’s March 2026 sentencing announcement provides the sentence and restitution information.
How the criminal case differs from Motorola’s civil lawsuit
The plea resolved a federal criminal charge against Hytera. Motorola’s civil lawsuit, filed in 2017, addressed its own trade-secret and copyright claims and has separate damages and collection proceedings. The figures in the two tracks are not interchangeable: the criminal fine is a penalty imposed by the court, while civil damages and royalties arise from the lawsuit. These figures and procedural details come from Motorola Solutions’ 2025 Form 10-K, a company filing. It also reports ongoing civil issues including copyright recalculation, asset turnover, injunctions and royalties; those proceedings may change after the filing date.

Motorola’s press release says a court found continued use of trade secrets and source code in Hytera’s H-Series products, and it reports royalty rates of $80.32 per radio and $378.16 per repeater. Those are Motorola’s account of the civil ruling, not terms of Hytera’s criminal plea. The H-Series royalty dispute should therefore be kept distinct from the DMR information and conduct described in the plea agreement. Motorola’s release presents its characterization of the royalty ruling.
