On October 7, 2026, the U.S. Department of Housing and Urban Development (HUD) announced an investigation into Wells Fargo initiatives and commitments intended to increase Black homeownership. HUD said the efforts may violate the Fair Housing Act and characterized the bank’s approach as sorting homeowners and offering products or terms according to race. The announcement is an investigation—not a final finding of liability or a court ruling. HUD’s announcement does not establish whether Wells Fargo violated the law.
What is HUD investigating at Wells Fargo?
HUD says it is examining initiatives and commitments meant to boost homeownership among Black Americans. In describing its concern, the agency said the bank may have differentiated among homeowners or offered products or terms according to race. Those are HUD’s allegations and characterization, not facts established through completed proceedings.

HUD Assistant Secretary for Fair Housing and Equal Opportunity Craig Trainor argued in the announcement that the Fair Housing Act does not permit racial discrimination merely because a program is described as a special purpose credit program or as advancing racial equity. That is an administration official’s legal and policy position; the announcement does not resolve how the law applies to Wells Fargo’s programs.
What has been reported about the initiatives?
HUD’s October 7 release, which references a Wall Street Journal report, says Wells Fargo had fulfilled about 40% of an initial $60 billion lending commitment by the time it commissioned a racial-equity assessment in late 2023. The release also reports that about 5,100 customers refinanced, with average monthly payment savings of about $100. These are figures relayed by HUD from the reported account, not findings from the investigation.

The same HUD release attributes to Pew Research Center a comparison showing that 24% of Black households and 73% of White households owned the home they lived in, in 2024. HUD cited the gap as context for its announcement; it does not, by itself, establish the terms or legal status of any Wells Fargo initiative.
HUD also reported that Wells Fargo scaled back its mortgage business broadly in early 2023 while reiterating a racial-equity pledge. The announcement does not set out the full terms or current status of each initiative, or explain which particular products, terms, or eligibility rules are under review.

How did federal policy change in 2026?
In August 2026, HUD announced that it and six other federal agencies—the CFPB, DOJ, FDIC, NCUA, OCC, and FHFA—had jointly rescinded a 2022 interagency statement on special purpose credit programs under the Equal Credit Opportunity Act and Regulation B. HUD said creditors should not rely on that statement, prior guidance, or related issuances going forward. The rescission announcement describes an agency policy change; it does not decide liability in the Wells Fargo matter or, by itself, settle the legal interpretation of a particular program.
Trainor said in the August announcement that no regulation or interagency statement could defeat the Fair Housing Act’s prohibition on race- and color-based discrimination in residential real-estate-related transactions. That statement reflects HUD’s position accompanying the policy change, rather than a ruling on the lender investigation.

Earlier, on March 13, 2026, Executive Order 14393, “Promoting Access to Mortgage Credit,” directed agencies to consider changes concerning mortgage credit and regulation. The order’s stated focus is mortgage availability and affordability; it is not a finding about Wells Fargo or the initiatives HUD is investigating.
Is this the same as HUD’s Washington State investigation?
No. HUD separately announced an investigation of Washington State’s Covenant Homeownership Program on March 24, 2026. HUD describes that state program as offering down-payment and closing-cost assistance through a zero-interest secondary loan, with eligibility based on specified ancestry criteria and an income ceiling of 120% of area median income. Those are details of HUD’s account of the Washington program, not Wells Fargo’s initiatives. The two investigations involve different operators and program terms, and neither announcement should be treated as a final adjudication. HUD’s Washington announcement provides the agency’s description of that separate case.

What does the Federal Reserve research show—and not show?
A February 2026 Federal Reserve paper examined fair-lending legal actions from 1991 through 2023. Its authors report that settlements were followed by lower denial rates and higher mortgage-origination rates for Black applicants in their historical dataset, as well as evidence of spillover effects at other banks in the same city. The paper is preliminary research and says it does not necessarily represent the views of the Federal Reserve Board. It studies legal actions across lenders; it does not establish what happened in the Wells Fargo investigation or predict its outcome.
What remains unknown?
HUD’s announcement does not provide Wells Fargo’s response, the full terms or present status of each initiative, the documents HUD requested or reviewed, or a timetable or outcome for the investigation. Without those details or a completed agency or court determination, the announcement alone is not a basis for concluding that Wells Fargo violated the law.
