After release, contact the Social Security Administration (SSA), report that you have been officially released, and ask whether your stopped benefit can be reinstated or whether you must file a new application. Have your release papers ready. The timing depends on the program: Title II retirement, survivors, and disability benefits generally restart no earlier than the month after official release, while SSI may be payable in the release month if you remain eligible and do not need a new application.
First, identify which benefit stopped
“Social Security” can mean two different programs with different rules. Title II benefits include Social Security retirement, survivors, and disability insurance benefits. Supplemental Security Income (SSI) is a separate, needs-based program. A person may have received one or both, and the steps and potential restart month depend on which benefit was suspended or terminated.

If you received both programs, treat them as separate requests when you contact SSA. A rule that applies to one benefit does not establish what will happen to the other. Ask SSA to identify each benefit on your record, its status, and whether it can be reinstated or requires a new application. If a spouse, child, or other eligible family member received benefits on a worker’s record, ask about that person’s payment separately as well.
| Issue | Title II: retirement, survivors, or disability | SSI |
|---|---|---|
| What confinement affects payment? | SSA generally suspends payments after conviction and more than 30 continuous days in a penal institution. | A person is ineligible for SSI for a full calendar month spent in a public institution. |
| Earliest normal restart point | The month after official release, if entitlement continues. | The release month may be payable if eligibility continues and a new application is not required. |
| When a new application is required? | SSA must review whether entitlement continues; the outcome depends on the person’s case. | After 12 consecutive months or longer of confinement, the person must file a new application and be approved. |
These rules are not interchangeable. SSA’s operational policy, POMS GN 02607.840 (revision dated May 5, 2026), specifies the month-after-release timing for Title II. For SSI, POMS GN 02607.875 (revision dated August 23, 2023) allows reinstatement in the release month or the earliest eligible day in that month when a new application is not required and all requirements are met.

What the confinement thresholds mean
For Title II, the general suspension rule applies after a person is confined for more than 30 continuous days due to a criminal conviction. It is not a rule that every short stay or every absence from home automatically stops a payment. The relevant facts include the type of institution, the conviction, and the length and continuity of confinement. If you are uncertain why your payments stopped or whether the rule applies, ask SSA to explain the action on your record.
SSI uses a different threshold: a full calendar month in a public institution makes a person ineligible for SSI for that month. The SSI 12-month rule is different again. Confinement lasting 12 consecutive months or longer can terminate SSI eligibility and require a new application after release. Do not treat the one-month payment rule as though it were the 12-month termination rule.
What to do after release
- Confirm the program. Check an old award letter, benefit notice, or payment record to see whether the stopped payment was retirement, survivors, disability insurance, SSI, or more than one benefit. If you cannot tell, ask SSA to identify the program when you contact the agency.
- Contact SSA and report your release. Call 1-800-772-1213 and ask for an appointment to report release and request reinstatement or, if required, a new application. If you use TTY, SSA’s prerelease FAQ lists 1-800-325-0778. You can also ask SSA what local appointment arrangements are available.
- Bring proof of official release. Keep your release documents and provide them to SSA. The agency’s prisoner guidance says it needs release documentation before it can act on a request. If you do not have the papers, tell SSA; its policy says the agency should help obtain proof when necessary. Ask what evidence may be accepted in your individual case rather than assuming a particular substitute will work.
- Ask which action applies to your record. For Title II, ask SSA to review reinstatement and continuing entitlement. For SSI, state how long you were confined and ask whether the 12-consecutive-month rule means you must submit a new application.
- Keep a record of the contact. Write down the date, the office or representative you spoke with, what documents SSA requested, and any next step or appointment. If SSA asks for additional evidence, confirm where and how to send it and keep copies of anything you submit.
Release does not by itself guarantee that payments will resume or establish eligibility. SSA must process the request and decide whether the program’s requirements are still met. Ask how SSA will notify you of its decision and what to do if a requested document or appointment is delayed.

Have your Social Security number available when possible, especially if you are calling before release. Ask what SSA needs next and whether the request is being handled as a reinstatement or a new application. These questions help keep the two programs’ different rules from being confused.
SSA says to provide proof of release and identifies official release papers as an example. Keep the documents available and ask whether SSA needs a copy or another form of evidence. If you have lost the papers, cannot get them immediately, or do not know which document confirms the official date, contact SSA rather than waiting to seek help. Explain what is missing and ask what evidence it can accept in your case. No particular substitute is guaranteed for every person.
When the payment can restart
Title II retirement, survivors, and disability benefits
For a Title II beneficiary whose payment was suspended because of qualifying confinement, SSA’s operating instructions say to reinstate monthly benefits beginning with the month after the correctional institution officially releases the person. SSA still reviews whether the person remains entitled to that benefit. For example, release does not resolve a separate eligibility issue or establish continuing entitlement on its own.
Do not assume that a release during a month makes that month payable under Title II. The operational rule is tied to the month after official release. The exact payment date after a decision is not guaranteed by the rule, so ask SSA about the status of your individual request rather than planning around an assumed deposit date.

The word “officially” matters. If you are moved to a halfway house or another location but remain under Department of Corrections control, you may still be in custody. SSA’s reentry material says a person may remain in custody until officially released or placed on parole. Ask facility staff to confirm the official release date and make sure the evidence you give SSA reflects it. A change in address, temporary leave, or move to a less restrictive setting should not be assumed to be the official release.
SSI
SSI uses a different timing rule. If the person remains eligible and a new application is not required, SSA may reinstate benefits for the release month, or the earliest day in that month on which all eligibility requirements are met. This does not mean every person receives a payment automatically on release: the person must report the release, and SSA must confirm eligibility.
If confinement lasted 12 consecutive months or longer, SSI eligibility is terminated under the rule described in SSA’s prisoner guidance. The person must apply again and receive a new approval; asking only for reinstatement is not enough. A new application may require SSA to assess the person’s current circumstances and eligibility.
For example, someone whose SSI eligibility was not terminated under the 12-month rule may ask SSA to reinstate the benefit after release, but still needs to satisfy ongoing SSI requirements. A person confined for 12 consecutive months or longer cannot rely on release alone to restore the old SSI payment: SSA must receive and approve a new application. These are different situations, so tell SSA the length of confinement and ask which process applies.
If you are still incarcerated or preparing to leave
Ask facility staff whether the institution coordinates with SSA through a prerelease agreement. SSA’s correctional-institutions guidance describes advance work on an application or reinstatement so that the agency can begin processing before the expected release. Its 2026 SSI Spotlight says that a person likely to meet SSI requirements may be able to apply several months before anticipated release. That is an opportunity to start the process early, not a promise of a decision or payment by a particular date.
- Tell facility staff the benefit you received before confinement and that you want to contact SSA before release.
- Ask whether the facility has an SSA prerelease arrangement and who can help initiate contact or prepare the paperwork.
- If there is no facility agreement, SSA’s FAQ says to call once you know the anticipated release date, explain that you are in an institution and want to apply, and have your Social Security number available.
- Ask how the facility and SSA will confirm the official release date and how you will provide release documents after leaving.
Beginning work before release may reduce avoidable delays, but it does not guarantee eligibility, a particular processing time, or uninterrupted payments. A facility representative can help with contact and paperwork; SSA makes the benefit decision.
The prerelease route can be especially useful if a new SSI application may be needed, or if SSA must review whether a prior benefit can be reinstated. The SSI procedure may let a person likely to qualify begin applying several months before the anticipated release. Ask facility staff whether they can coordinate with SSA, what information they can help provide, and what the person must do after the official release. Starting early is a chance to begin the work, not a guarantee that benefits will be approved or available by a specific date.

If the facility does not have an arrangement with SSA, do not assume there is no way to begin. SSA’s FAQ says a person who knows the anticipated release date can call, explain that they are in an institution and want to apply, and have their Social Security number available. Ask SSA what can be done before release and what must wait until the official date is confirmed.
Make sure SSA has the official release date
The relevant date is official release, not necessarily the day a person moves to a different location. SSA’s reentry material cautions that someone who moves to a halfway house while still under Department of Corrections control may remain in custody until officially released or placed on parole. If your status or date is unclear, ask facility staff for the official release date and provide SSA with the documentation that reflects it.
This distinction matters because the Title II restart month is calculated from official release, and the SSI release-month rule also depends on when the person is released and meets all other requirements. Do not rely on a transfer, work-release arrangement, or change in housing as proof that SSA will treat confinement as ended.
If you have been told different dates by different people, ask which date appears on the official release documentation and tell SSA about any uncertainty. The agency’s operational policy makes official release the relevant date for Title II timing. For SSI, release alone still does not settle whether all requirements are met or whether a new application is necessary. SSA can review the individual record and tell you what documentation it needs.
Check continuing eligibility, not just the release paperwork
Title II benefits
For Title II, SSA reviews whether the person remains entitled under the relevant retirement, survivors, or disability rules. SSA’s general reentry guidance notes that potential Title II eligibility depends on sufficient covered work, but a request to restart a previously paid benefit is evaluated against the person’s own record and circumstances. Provide any information SSA requests and ask whether the agency needs an updated application or other evidence.

It removes the confinement issue that led to suspension, but SSA still has to consider the underlying benefit and whether entitlement continues. If SSA says the prior payment cannot simply be reinstated, ask what specific application or evidence is needed and whether the issue concerns your continuing eligibility or a new claim.
If you need to make a new disability claim rather than reinstate an existing benefit, SSA’s disability standard includes being unable to do prior work, being unable to adjust to other work because of medical condition or conditions, and having a condition that has lasted or is expected to last at least one year or result in death. SSA does not pay partial or short-term disability benefits. Release from incarceration alone does not prove that these conditions are met.

SSI
SSI is for qualifying people who are 65 or older, blind, or disabled and have limited income and resources. After release, SSA must consider the applicable ongoing financial and other eligibility requirements. A person who needs a new application after 12 consecutive months or longer of confinement must be approved under the application process; release by itself does not restore SSI.
For a new SSI application, SSA must determine whether the person meets the program’s requirements based on their circumstances. For a request to reinstate SSI without a new application, the person still must meet ongoing requirements. Having received SSI before confinement does not itself prove that those requirements remain satisfied after release. If you are unsure which path applies, state how long you were confined and ask SSA whether the existing eligibility can be reinstated or a new application is necessary.

What happens to benefits for eligible family members?
A worker’s Title II payment being suspended does not automatically end benefits that eligible dependents receive on that worker’s record. SSA says those family members may continue to receive benefits during the worker’s confinement, subject to their own eligibility. If a family member’s payment also stopped, contact SSA about that person’s record rather than assuming the worker’s suspension explains it.
This is separate from the worker’s request after release. Ask SSA to review the worker’s benefit and any family member’s benefit as distinct matters. The fact that a dependent may continue receiving a payment does not mean the worker’s own payment has restarted, and the worker’s suspension does not by itself show that a dependent has lost eligibility.
Ask about Medicare separately
SSA’s reentry page flags a possible Special Enrollment Period for formerly incarcerated people. Medicare enrollment rights, premium liability, and coverage dates depend on the individual’s record and circumstances; the incarceration benefit restart rules do not determine them. If Medicare is relevant, ask SSA to review your dates and record separately.
Do not assume that restarting a Social Security or SSI payment automatically resolves Medicare enrollment or coverage. Ask SSA specifically about Medicare and provide the dates it requests. A review of the individual record is needed to determine any enrollment opportunity, premium responsibility, or coverage dates.

- “My checks stopped while I was incarcerated. How do I restart my benefits?” Report the official release to SSA, provide release evidence, and ask whether your benefit can be reinstated or requires a new application.
- “Do I need to wait until I am out to start?” Not necessarily. Ask about facility prerelease coordination as soon as you know an expected release date.
- “What if I cannot find my release papers?” Contact SSA anyway, explain the problem, and ask what evidence it can accept and whether it can help obtain proof.
- “Will my check arrive as soon as I leave?” No specific payment date is guaranteed. SSA must receive and process the request and determine whether you remain eligible or need a new application.
- “Does a halfway-house transfer count as release?” Not necessarily. If you remain under Department of Corrections control, you may remain in custody until officially released or placed on parole. Confirm the official date with facility staff.
- “What if I received both SSI and Social Security?” Ask SSA to review each program separately. They have different confinement rules, restart timing, and application requirements.

When can Title II benefits restart?
SSA’s operating policy says Title II retirement, survivors, or disability benefits generally restart beginning with the month after official release, if continuing entitlement requirements are met. A particular payment date is not guaranteed.
Can SSI restart in the month I am released?
It may be payable in the release month, or from the earliest eligible day in that month, if you still meet SSI requirements and a new application is not required. Contact SSA; payments do not restart automatically.
Do I have to apply again for SSI after a long confinement?
If you were confined for 12 consecutive months or longer, SSA says you must file a new SSI application and be approved. Release alone does not restore SSI eligibility.
Can I start the process before release?
Ask facility staff whether the institution has an SSA prerelease arrangement. SSA says the SSI prerelease procedure may allow a likely eligible person to apply several months before anticipated release. If there is no facility agreement, call SSA once you know the anticipated release date.
What if I do not have my release papers?
Contact SSA and explain that the documents are missing. SSA normally asks for proof of release and says it should help obtain proof when necessary. Ask what evidence can be accepted in your individual case.
Does moving to a halfway house mean I have been officially released?
Not necessarily. A person who remains under Department of Corrections control may still be in custody until officially released or placed on parole. Confirm the official date with facility staff.
Can my family keep receiving benefits while my Title II payment is suspended?
Eligible dependents may continue receiving benefits on the worker’s Title II record during confinement, subject to their own eligibility. Ask SSA about each person’s record separately.

Will Medicare restart when my benefit does?
Medicare enrollment, premium liability, and coverage dates require a separate review of your individual record. Ask SSA about Medicare rather than assuming the benefit restart rules determine coverage.
The Bottom Line
Report your official release to SSA, provide release evidence, and ask whether each stopped benefit can be reinstated or needs a new application. Title II generally restarts no earlier than the month after official release if entitlement continues; SSI may resume in the release month, but confinement of 12 consecutive months or longer requires a new SSI application and approval.
