How to Respond to a Section 148 Notice When Reasons or Supporting Material Are Missing

A missing reason or attachment is not a reason to ignore a Section 148 notice. Check the deadline, document what is missing, request it in writing and follow the applicable return and objection process.

Do not ignore a Section 148 notice or assume that asking for missing reasons pauses the response deadline. Check the notice date, assessment year and return deadline; request the recorded reasons and missing documents in writing; preserve proof of your request; and follow the return procedure that applies to your notice. The effect of a missing document depends on the applicable law and facts, so an omission does not automatically establish that every notice is invalid.

The practical questions are what exactly is missing, what the notice and earlier section 148A paperwork say, and what you must do while waiting for a response. Work through those questions in writing and keep a copy of each item. This is general procedural information, not a determination that any particular notice is valid or invalid. Get case-specific Indian tax advice if a deadline is near, the notice is unclear, or the reasons and material raise substantive issues.

Start by checking the notice and the deadline

Read the notice itself before deciding what to do. Record when it was issued and served, the assessment year it identifies, the date by which it directs you to file a return, and whether a copy of the order under section 148A(3) is attached. Keep the notice, service information and any attachments together. Do not rely only on a message alert or a summary from someone else: compare the actual notice and its attachments with what you received.

The Income Tax Department’s displayed section 148 text says the notice must be issued along with a copy of the order passed under section 148A(3). It also says the return must be furnished within the period specified in the notice, subject to a maximum of three months from the end of the month in which the notice is issued under that displayed text. Because statutory wording and exceptions have changed, use the deadline and applicable law for your particular notice rather than relying on a general calculation. The date printed on a notice, the date it was served, the assessment year and the legal version applicable to the case are distinct details; write each one down instead of treating them as interchangeable. Read section 148 on the Income Tax Department site.

  • Note the issue date and the date and method of service.
  • Confirm the assessment year and the return deadline stated in the notice.
  • Check for the section 148A(3) order and any other attachments.
  • Keep a copy of everything received and proof of when you received it.

Use a simple comparison checklist before contacting the Assessing Officer. First, compare the notice date with the service evidence you have. Second, confirm that the assessment year is consistent across the notice and any earlier section 148A papers. Third, copy down the return deadline exactly as stated rather than calculating a new one from a generic description. Fourth, inventory the attachments and note whether the section 148A(3) order is present. Fifth, locate any earlier show-cause notice, your reply, and the information supplied with that notice. Finally, list the exact reasons or supporting items you believe are absent. This comparison helps you make a focused request and gives you and your adviser a record of what was actually received.

If there are several notices, replies or attachments, organize them by date and keep the original files or copies intact. A missing attachment is easier to identify when you can say which notice it should relate to and what was enclosed with the notice you received. If a document is mentioned but you cannot tell whether it was supplied elsewhere, record that uncertainty rather than describing it as definitely withheld. The sources establish the importance of the relevant notice and material, but they do not settle every factual dispute about service or delivery.

Request the missing reasons and material in writing

Send a dated request to the Assessing Officer identified in the notice. Identify the notice and assessment year, state when it was served, and list exactly what you have not received. Ask for the recorded reasons for issuing the section 148 notice and a copy of the section 148A(3) order if it was not attached. If information or documents appear to have been relied upon but were not supplied, identify those items as specifically as you can and request copies.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use an official submission channel available for your case and retain the acknowledgment, portal receipt or other proof of delivery. A written, itemized request creates a clear record of what was missing and when you asked for it. The statutory sections and Supreme Court procedure cited below do not establish that making this request, by itself, extends or suspends the return deadline. Do not wait for a reply before checking the return requirement in the notice and taking steps to meet it.

Make the request concrete. Instead of saying only “send all documents,” separate the items: the recorded reasons; the section 148A(3) order; any information or documents you believe were relied upon but were not supplied; and, if relevant, the earlier show-cause notice and its accompanying information. State whether an item was not attached, was incomplete, or is mentioned in another document but was not provided. This distinction makes it clearer what response you are seeking. It also avoids implying that every underlying document is necessarily required in every case, which the cited material does not establish.

Keep a copy of the request exactly as filed, including any attachments, and note the date, channel and acknowledgment number. If the channel provides a downloadable receipt or status page, save it with the notice record. If you send a further request because the first one did not resolve the omission, refer to the earlier submission date and identify only what remains outstanding. These are practical recordkeeping steps; they do not create a new statutory deadline or establish that an unanswered request changes the legal position.

Example wording for a request

Adapt this to the facts and the submission channel you are using. Remove any item that is not actually missing, and describe the documents accurately:

Subject: Request for recorded reasons and documents — notice under section 148, assessment year [assessment year]

I received the notice under section 148 dated [notice date] on [service date]. The notice does not include [identify the missing item or items]. Please provide the recorded reasons for issuing the notice, a copy of the order under section 148A(3), and copies of the information or documents relied upon that have not been supplied. [If relevant: The earlier section 148A show-cause notice and/or the information stated to accompany it was not received; please provide or identify the relevant material.] Please confirm receipt of this request.

The example is a way to identify what you are asking for, not a legal form that guarantees a particular result. Keep the tone factual. Avoid stating that the notice is void solely because an item is missing, or asserting that the request automatically pauses your return deadline. If you are unsure whether a document was supplied earlier or whether a particular statutory version applies, say so and seek advice rather than making a categorical assertion.

Follow the return-and-objection procedure

The Supreme Court’s 2024 judgment reproduces the procedure in GKN Driveshafts (India) Ltd. v. Income Tax Officer: the taxpayer files a return in response to the section 148 notice and may then seek the reasons for issuing it. The Assessing Officer is bound to furnish the reasons within a reasonable time. Once the reasons are received, the taxpayer may file objections; the Assessing Officer must dispose of those objections by a speaking order before proceeding with the assessment. The judgment reproduces the statement: “The assessing officer is bound to furnish reasons within a reasonable time.” That is the procedural direction described in the cited judgment; it does not supply a fixed number of days for every case. Read the Supreme Court judgment dated October 3, 2024.

  1. Respond to the return requirement. Follow the deadline and filing directions in your notice and the law that applies to it. Do not treat a request for reasons as a substitute for filing or as an automatic deadline extension. If you are uncertain how to comply, seek timely professional advice rather than allowing the stated deadline to pass without a plan.
  2. Seek the reasons and missing items. Make the written request promptly, if you have not already done so, and preserve proof of submission. Identify the notice, assessment year, service date and each specific missing item.
  3. Review what is supplied. Compare the reasons and documents received with the notice, the section 148A process, and your own records. Note whether the reply answers each part of your request and whether any document referred to in the reasons is still unavailable.
  4. Submit specific objections if appropriate. Identify the particular reasons or facts you dispute rather than relying only on a general statement that documents were missing. Keep the objections tied to the reasons and material actually provided; do not assume that a missing item, by itself, establishes the merits of an objection.
  5. Seek disposal before the assessment proceeds. Under the procedure reproduced by the Supreme Court, objections are to be disposed of through a speaking order before the Assessing Officer proceeds with the assessment. Keep the objections and any order disposing of them with your records.

The sequence matters because the GKN procedure distinguishes asking for reasons from objecting to them. Before you have the reasons, you can identify the absence and request the material. After receiving the reasons, you can assess what they say and decide whether to make objections. If you do object, identify the particular point and explain why it is disputed based on the facts available to you. The GKN procedure gives taxpayers an opportunity to object and requires a speaking order before the assessment proceeds; it does not prescribe a universal objection template or establish the outcome of an objection in any specific case.

For an official account of the preliminary process, section 148A says that the show-cause notice before a section 148 notice is to be accompanied by information suggesting that income has escaped assessment. It also describes considering the taxpayer’s reply and issuing an order on whether it is a fit case for a section 148 notice. The text and exceptions have changed over time, so the version applicable to your notice matters. If you took part in that earlier process, compare your copy of the show-cause notice, the information that accompanied it, your reply, and the resulting order with the documents now supplied. If you did not receive or cannot locate one of those items, state that precisely in your written request rather than assuming what the file contains. Read section 148A on the Income Tax Department site.

Distinguish the missing item before deciding what it means

Different omissions raise different questions. The displayed section 148 text expressly addresses the section 148A(3) order accompanying the notice. The section 148A text addresses information accompanying the earlier show-cause notice. The GKN Driveshafts procedure addresses obtaining recorded reasons and filing objections after they are supplied. These points should not be collapsed into a claim that every supporting document must always be provided with every section 148 notice.

What appears to be missing What to check or request What the cited material establishes
The section 148A(3) order Check the notice attachments and request a copy if absent. The Income Tax Department’s displayed section 148 text says a copy of this order must accompany the section 148 notice.
Information accompanying the earlier section 148A show-cause notice Check the show-cause notice, its service record and the information supplied with it. The displayed section 148A text says that show-cause notice is to be accompanied by information suggesting escaped income.
The recorded reasons for issuing the section 148 notice Request the recorded reasons in writing; after receiving them, consider specific objections. The Supreme Court’s 2024 judgment reproduces the GKN Driveshafts direction that reasons be furnished within a reasonable time and objections be disposed of by a speaking order before assessment proceeds.
Other supporting information or documents Identify the item and ask whether it was relied upon, and request a copy if appropriate. The cited material does not establish a universal rule requiring every underlying document to be furnished in every case, or a single remedy for every omission.

This distinction can help frame the next question accurately. If the section 148A(3) order is absent, the specific point to note is that the displayed section 148 text says a copy is to accompany the notice. If the information that should have accompanied a prior show-cause notice is at issue, focus on that earlier notice and its delivery history. If the recorded reasons are what you lack, the GKN procedure is the starting point for requesting them and, once furnished, considering objections. If the concern is another underlying document, identify it and ask whether it was relied upon, while recognizing that the sources reviewed do not establish a universal disclosure rule for every such document.

If the material is still missing

If a requested order, reason or document remains unavailable, make a further written record identifying what is still outstanding and when you first requested it. Preserve both submissions and any response. Seek case-specific Indian tax advice promptly if the deadline is close, the notice or service date is unclear, or the reasons or material raise substantive issues. If a deadline is approaching, raise that urgency with the adviser; do not assume that a pending request alone protects you from the return requirement.

Do not assume that a missing attachment automatically voids the notice, and do not assume that the omission is harmless. The result can depend on the notice date, the statutory version in force, the type of case and the full record. Statutory wording and exceptions have changed over time, so a conclusion based on one version may not answer a case governed by another. The existence of a procedural requirement in the displayed statutory text is important, but the cited material does not establish a single automatic consequence for every failure to supply an item.

A 2026 judgment surfaced in connection with discussion of a document not referred to in recorded reasons, but the available judgment material does not support a broad conclusion about every dispute over withheld supporting material. Do not cite it as establishing a general rule without reviewing the full judgment and the facts relevant to your case. The fact that a judgment mentions a document issue is not, by itself, enough to determine what remedy applies in a different notice or under a different statutory version. Read the May 12, 2026 judgment before relying on it for a particular issue.

Keep a usable record of the response

Organize the documents so you or your adviser can establish what was issued, received, requested and answered. A simple chronology can prevent confusion over deadlines and missing items. Use one folder or electronic file for the notice process, and retain the original notices, submitted documents, attachments, acknowledgments and responses together.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The section 148 notice, envelope or electronic service details, and all attachments.
  • The assessment year, notice issue date, service date and stated return deadline.
  • Any section 148A show-cause notice, your reply, the information supplied with it and the section 148A(3) order.
  • Your request for reasons and documents, along with its submission receipt or delivery proof.
  • The reasons or material later supplied, any objections you file, and the speaking order disposing of them.

A chronology can be as simple as a dated list: notice issued; notice received; return deadline shown; request submitted; acknowledgment retained; reasons or documents received; objections submitted, if any; and speaking order received. Record the source for each date, such as the notice itself, service information or submission receipt. This is not a replacement for legal advice or a statutory filing; it is a way to make the case history easier to verify when you need to explain what happened.

When you review the file, compare what you requested with what was supplied. Mark each item as received, still missing, or unclear, and note the date of any follow-up. This prevents a general statement that “documents are missing” from obscuring which document remains outstanding. It also helps an adviser quickly distinguish a missing order from absent recorded reasons or a question about material supplied during the earlier section 148A stage.

Frequently asked questions

What if I received a section 148 notice without reasons?

Do not ignore the notice. Check the assessment year, service details and stated return deadline, then make a dated written request to the Assessing Officer for the recorded reasons and keep proof of submission. Under the GKN Driveshafts procedure reproduced by the Supreme Court, the taxpayer may seek reasons, which the Assessing Officer is to furnish within a reasonable time. The available sources do not establish that asking for reasons automatically pauses or extends the return deadline, so continue to address the return requirement that applies to your notice.

Can I ask for the documents relied on in a reassessment notice?

You can identify the information or documents you believe were relied upon but not supplied and request copies in writing. Be specific about the item and whether it is missing from the section 148 notice or from the earlier section 148A show-cause process. The statutory text expressly addresses the section 148A(3) order accompanying the section 148 notice and information accompanying the earlier show-cause notice. The material reviewed here does not establish that every underlying document must be furnished in every case.

Does a request for reasons extend my return deadline?

The cited statutory text and procedure do not establish that making a request alone extends or suspends the deadline. Section 148, as displayed by the Income Tax Department, says to furnish the return within the period specified in the notice, subject to the stated maximum under that text. The applicable wording and exceptions can depend on the notice date and case. Follow the notice and applicable law, and seek case-specific advice if you cannot determine how to comply.

What if the section 148A(3) order was not attached?

Record that the order was absent from the notice attachments and request a copy from the Assessing Officer in writing. The Income Tax Department’s displayed section 148 text says that the notice must be issued along with a copy of the section 148A(3) order. Whether a particular omission invalidates a particular notice, and what remedy follows, depends on the applicable statutory version and case record; do not assume an automatic outcome.

What happens after I receive the recorded reasons?

Review them alongside the notice and the material available to you. If appropriate, submit specific objections identifying the particular reasons or facts you dispute. The Supreme Court judgment reproduces the GKN Driveshafts procedure that the Assessing Officer must dispose of objections by a speaking order before proceeding with the assessment. The cited judgment does not supply a fixed objection deadline or guarantee the result of an objection in a particular case.

Does every missing supporting document make a section 148 notice invalid?

No universal conclusion is established by the material reviewed. The statutory text expressly addresses certain items, including the section 148A(3) order with the section 148 notice and information with the earlier show-cause notice. Other underlying documents raise a separate question, and the cited sources do not establish a universal disclosure rule or one remedy for every omission. A dated chronology of issue, service, request, response and objection events can help you or your adviser identify what is missing and what deadline applies.

The Bottom Line

Check the actual notice, record the deadline and what is missing, and make a dated written request for the recorded reasons, the section 148A(3) order and any identified supporting material. Keep proof, follow the return procedure that applies, and consider specific objections after the reasons are supplied. A request alone is not shown to extend the deadline, and the effect of an omission depends on the applicable statutory version and case record.
