How to Respond to a GST Show-Cause Notice: Documents, Deadlines and Process

A GST show-cause notice does not always use the same reply form or deadline. Learn how to identify the applicable process, prepare a supported response and preserve filing proof.

Start by identifying the notice’s statutory provision, allegations and stated response date: there is no single form or deadline for every GST show-cause notice. For demand notices covered by rule 142 of the CGST Rules, the notice summary is in FORM GST DRC-01 and the representation is made in FORM GST DRC-06. Other types of GST notices may follow different procedures.

First identify which GST notice you received

“GST show-cause notice” is a broad description, not a procedure by itself. Read the document and any electronic summary to find the issuing authority, the provision cited, the tax period, the allegations, the amount claimed, the response date and the filing instructions. Keep the complete notice and its annexures as received.

The distinction matters because the form, channel and time limit depend on the process invoked. The CBIC-hosted CGST Rules provide for an electronic summary in FORM GST DRC-01 for covered demand notices under rule 142, and FORM GST DRC-06 for the taxpayer’s representation. A document called a show-cause notice is not automatically a DRC-06 case.

What to establish Covered rule 142 demand notice Other GST notice or process
Procedural basis Confirm that rule 142 applies and identify the relevant demand provision. Follow the provision and procedure identified in that notice; its particulars are not established by the rule 142 forms.
Form identified in the cited materials DRC-01 is the electronic notice summary; DRC-06 is the reply or representation form. Not stated in the rule 142 materials; the applicable provision may specify another form or process.
Response date Use the date and instructions in the notice, then verify them against the applicable current provision. Not stated in the rule 142 materials; check the notice and governing provision.

What to check before drafting your reply

Make a short case sheet from the notice before writing. Note its reference number and issue date, the GSTIN and taxpayer name, the issuing authority, the statutory section or rule, the tax period, each allegation, the amount claimed, and the stated response date and filing instructions. Preserve proof of when and how it was served if available.

For every allegation, compare the department’s assertion with the relevant records. Depending on the issue, these may include returns, invoices, account ledgers, reconciliations, payment records, contracts, delivery evidence or earlier correspondence. These are practical ways to test the allegations, not a fixed legal checklist: use records that actually support or explain the point in dispute.

How to prepare a DRC-06 response

For a notice covered by rule 142, use FORM GST DRC-06 for the representation. The CBIC-hosted form is titled “Reply to the Show Cause Notice.” It asks for the taxpayer’s GSTIN and name, notice reference and issue date, financial year, reply text, list of uploaded documents, personal-hearing preference, and verification and authorised-signatory details.

  1. Organise the allegations. Number them to match the notice. For each one, state the relevant facts, your position, the supporting record and the correction or relief sought.
  2. Reconcile disputed figures. If the amount or calculation is wrong, provide a clear schedule showing the department’s figure, the figure you say is correct, how you calculated it and which source records support the calculation.
  3. Prepare relevant attachments. Give each file a clear, consistent name, include it in the form’s uploaded-document list and refer to it by that name in the relevant part of the reply. Avoid unrelated records that do not support a material point.
  4. Complete the hearing and verification fields. Select the personal-hearing option that reflects your request and complete the form’s verification and authorised-signatory details.
  5. File using the applicable route. Follow the instructions in the notice and the current rules for that notice type. The CBIC-hosted ACES page describes online filing of show-cause notice replies as a system capability, but does not establish one current portal sequence for every GST notice.
  6. Keep proof of filing. Save the submitted reply, uploaded attachments, acknowledgement and any portal reference or other delivery proof.

The form asks for an uploaded-document list; it does not prescribe one evidence bundle suitable for every case.

Which documents might support a GST notice reply?

Select documents by allegation rather than uploading everything in your files. A working folder may include the items below when they are relevant:

  • The complete notice, electronic summary, annexures, documents relied on by the department, and available proof or date of service.
  • Returns and reconciliations for the periods identified in the notice.
  • Relevant tax invoices, credit or debit notes, purchase or sales registers, contracts or delivery evidence.
  • Electronic liability, credit and cash ledger extracts and payment challans, if payment or credit is disputed.
  • Earlier replies, departmental letters, audit material or orders that relate to the same issue.
  • A calculation schedule linking the amount in dispute to the taxpayer’s underlying records.
  • An indexed attachment list that matches the files uploaded and the references in the reply.

This is a practical preparation aid, not a statutory document list. The records needed depend on the allegations.

What deadline applies?

Do not assume there is one reply deadline for all GST show-cause notices. The applicable period can depend on the provision, notice form, tax period, notice wording and any later amendment or extension. Use the response date stated in your notice as an immediate filing target, and check it against the current official law applicable to the cited provision. If the notice gives no clear period, or its date appears inconsistent with that provision, promptly seek clarification or qualified advice rather than assuming extra time.

Allow enough time before the stated date to assemble records, review the response and resolve upload or document problems. A filed reply should be supported by the relevant attachments and proof of submission, not merely prepared by the deadline.

When can a payment route apply instead?

The CBIC-hosted rule text describes a conditional route for specified demand cases: where the relevant tax and interest—and, for the cited statutory route, any required penalty—are paid within 30 days of service, the taxpayer intimates payment in FORM GST DRC-03 and the officer issues FORM GST DRC-05 to conclude proceedings in the circumstances described by the provision.

This is not a general instruction to pay every disputed demand or a substitute for checking the notice. Before relying on it, establish that the cited section and facts qualify, verify the tax, interest and any penalty, and consider the consequences of payment for your position. The 30-day period belongs to that specified payment treatment; it is not a universal reply deadline.

How to request a personal hearing

DRC-06 includes a yes-or-no personal-hearing option. For the covered proceedings under sections 73 and 74, the retrieved CBIC-hosted Act text says an opportunity of hearing is granted when the person makes a written request or when an adverse decision is contemplated. If you seek a hearing, mark the request in the form and state it clearly in the written reply. Keep a copy of the request and any hearing notice.

The same cited sections limit adjournments to up to three when sufficient cause is shown. An adjournment is not automatic, so explain the reason promptly and follow any directions in the hearing notice.

When to get professional help

Consider asking a qualified GST practitioner or indirect-tax lawyer to review the matter when it alleges fraud or suppression, involves a large or multi-period demand, disputes input tax credit, relies on extensive third-party records, raises limitation or jurisdiction issues, or could affect an appeal strategy. Before engaging someone, confirm their relevant experience, the work included, fees and the deadlines they will help you manage.
