How to Respond to a Court Summons for a Credit Card Debt

A summons deadline depends on the court and service method. Learn how to check the papers, review the claims, file and serve a response, and get local help.

If you’ve been served with a summons and complaint over a credit-card debt, read the papers immediately, identify the response deadline and required method, and follow the instructions for your court. The deadline and procedure vary by location and service method; missing a required response can lead to a default judgment. An answer does not mean you agree that the debt is valid.

What should you do first?

Keep every page of the summons and complaint. Record the case number, court, plaintiff, date and method of service, and the exact deadline and response instructions printed in the papers. Calendar the deadline and any hearing date. Do not assume that calling the creditor or collector changes a court deadline.

  1. Read the summons and complaint. Note whether the papers require a written response, an in-person answer, a court appearance, or more than one of these.
  2. Find the official instructions for that court. Use the court named in the papers and look for its official debt-lawsuit, civil-case, or self-help guidance. Confirm the correct form, filing method, service requirements, and deadline.
  3. Get help promptly if you need it. Contact local legal aid, a legal clinic, or a consumer-debt attorney, especially if the deadline is near, you do not recognize the account, a judgment may already have been entered, or you think the debt may be too old to sue on. Availability and eligibility vary by location.

There is no single answer deadline or procedure for every U.S. credit-card case. The examples below illustrate why you must check the rules for the court named in your papers; they are not deadlines to apply outside those courts.

Court guidance Example deadline and procedure
California Courts (undated page, accessed 2026) Describes filing an Answer and serving the opposing attorney within 30 days. Its guidance says a late Answer may still be possible if no default has been entered.
Arizona Judicial Branch (undated page, accessed 2026) Describes filing an Answer within 20 calendar days from service and responding to each allegation.
New York State Unified Court System, NYC Civil Court (undated page, accessed 2026) Describes answering in person: within 20 days if the summons was personally handed to you, or within 30 days for specified other service methods.

These differences are examples, not a nationwide rule. The summons, applicable court rules, and official local instructions control your case.

What does an Answer do?

An Answer is your formal response to the complaint. The Consumer Financial Protection Bureau (CFPB) says responding does not mean you agree that you owe the debt or that it is valid. California Courts explains that an Answer requires the other side to prove its case; Arizona Courts describes it as a response to the creditor’s claims.

Address each allegation truthfully using the court’s required form and instructions. Do not deny everything automatically or copy defenses that do not fit your facts. If you are unsure how to respond to an allegation, get local legal advice as soon as possible.

How should you check the claims?

Compare the complaint with your own account and payment records. The Federal Trade Commission (FTC) says the plaintiff must prove that you owe the debt, that the amount is correct, and that the plaintiff has the legal right to collect it. Check the facts that bear on those issues:

  • Identity and account: Is the named defendant you, and does the account information match an account you recognize?
  • Plaintiff’s right to collect: Is the plaintiff the original creditor or a debt buyer? Check whether the complaint and records identify who owns the account and has the right to sue.
  • Amount claimed: Compare the balance with statements and payment records. Look for payments or credits that may be missing, and check how fees and interest are described.
  • Account history: Gather statements, payment confirmations, collection letters, and other records that could help you assess the allegations.

These checks can help you understand what you can admit, deny, or say you cannot verify based on your knowledge. They do not determine the outcome of the case; the court process and evidence matter.

How do you file and serve a response?

Follow the process for the court and case type in your summons. Some courts require a written Answer filed with the court and served on the opposing attorney; others may have an in-person answering process. Do not assume that sending a letter to the collector counts as filing an Answer.

  1. Use the official form and instructions for the court handling your case.
  2. Complete the response as instructed, addressing the complaint’s allegations and raising only defenses that have a factual and legal basis.
  3. File and serve the response by the methods and within the time required by that court. California’s guidance, for example, describes filing and separately serving the opposing attorney; NYC Civil Court’s example describes answering in person.
  4. Keep copies of everything you submit and proof of filing and service. Attend any required hearing or court date, and respond to later court notices.

The summons may require a written response, an appearance, or both. If you cannot tell what is required, contact the court clerk or local legal help promptly; do not privately contact the judge.

What if the debt is old?

A statute of limitations may provide a defense, but the deadline and how it is calculated depend on the jurisdiction, the type of debt, and sometimes the law named in the credit agreement. The CFPB said in 2024 that many state debt-limitation periods fall between three and six years, while some may be longer. That general range cannot establish whether a particular credit-card claim is time-barred.

The CFPB also says the period’s starting point can vary and that a defendant may need to raise expiration as a defense. Under Regulation F, a covered debt collector may not sue or threaten to sue on a time-barred debt. That rule concerns covered debt collectors; it should not be assumed to apply identically to every original creditor or plaintiff. A court may still enter judgment if a defendant fails to appear and raise an available defense.

Because payments or acknowledgments can affect the calculation in some states, seek local legal advice before paying or acknowledging an old debt. Do not assume that age alone makes a claim disappear.

Is a debt-validation dispute the same as answering the lawsuit?

No. A collector’s validation notice and a court summons are separate. The CFPB describes a general 30-day written dispute period for information in a debt-collection validation notice; a timely written dispute can trigger a pause in collection of the disputed amount under the applicable rule. That period is not the deadline to answer a lawsuit. Follow the court deadline even if you have disputed the debt with the collector.

What if you missed the deadline?

Do not assume that you have no options, but act immediately. Contact the court clerk, local legal aid, or an attorney to find out whether a default has been entered and what steps, if any, remain available in your jurisdiction. California Courts says an Answer may still be possible there if no default has been entered; that is California-specific guidance, not a guarantee for other courts.

Where can you get help?

The CFPB and FTC recommend seeking legal assistance. Search for legal aid or a legal clinic serving the area where the case was filed, or contact a consumer-debt lawyer. Ask promptly about deadlines, eligibility, fees, and whether the provider handles debt-collection lawsuits in that court.
