For a typical U.S. individual federal return, report capital-asset sales and exchanges on Form 8949 when required, transfer the applicable totals to Schedule D, and use Schedule D to determine whether you have an overall capital gain or loss. If your losses exceed your gains, you may generally deduct up to $3,000 of net capital loss against other income ($1,500 if married filing separately), subject to your total net loss. Report the allowed amount on line 7a of Form 1040, Form 1040-SR, or Form 1040-NR, as applicable. Any eligible unused loss can generally be carried forward.

This guide covers U.S. federal individual income tax reporting, with a focus on 2025 tax-year forms and instructions available during 2026. Use the forms and instructions for the tax year you are filing; state returns, business and entity returns, and transaction-specific rules may differ.

Which forms report capital losses?

For many individual returns, the reporting sequence is Form 8949, then Schedule D, then the applicable individual income tax return. Form 8949 lists covered transactions and helps reconcile amounts reported to the IRS with the amounts that belong on your return. Schedule D brings together the relevant transaction totals, other required entries, and any capital loss carryover to calculate your overall capital gain or loss.

  • Form 8949: Use it to report transactions that require transaction-level detail or an adjustment. Its 2025 instructions discuss proceeds reported on Form 1099-B, Form 1099-DA, or Form 1099-S.
  • Schedule D: Transfer applicable Form 8949 totals here, include other entries and worksheets that apply, and calculate the overall result.
  • Form 1040, Form 1040-SR, or Form 1040-NR: If you have a deductible net capital loss, report the allowed amount on line 7a of the applicable return.

Not every transaction needs to be listed on Form 8949. The 2025 instructions allow certain transactions to be reported directly on Schedule D when specific conditions are met. That is an exception with requirements, not a general shortcut: check the current Schedule D and Form 8949 instructions before skipping Form 8949.

How much capital loss can you deduct against other income?

When total capital losses exceed capital gains, the general individual federal deduction against other income is limited to the lesser of your net capital loss or the annual amount for your filing status below. These are the limits stated by the IRS for 2025; apply the instructions for the tax year on your return.

Filing status General maximum net capital loss deduction for 2025
Not married filing separately $3,000
Married filing separately $1,500

The limit applies to the net loss after capital gains and losses are combined, not to each losing transaction separately. The IRS describes the deductible amount as the lesser of the applicable limit or the total net loss shown on Schedule D, line 16. A loss does not automatically create a deduction simply because an asset was sold for less than its purchase price; the transaction must be reportable and the loss deductible under the applicable rules.

How to report capital losses step by step

  1. Collect transaction records. Gather brokerage statements and other records showing the asset, acquisition date, sale or exchange date, proceeds, basis, and any potential adjustment. Compare these with information returns such as Form 1099-B, Form 1099-DA, or Form 1099-S. The purpose of Form 8949 includes reconciling reported proceeds and basis with what belongs on the return.
  2. Determine which transactions belong on the return. Identify capital-asset sales and exchanges and review whether a reported transaction needs an adjustment or special handling. Do not assume that every amount shown on an information return is automatically a deductible capital loss; asset use and transaction facts matter.
  3. Sort transactions by holding period. Short-term transactions go in Part I of Form 8949; long-term transactions go in Part II. Use the applicable year’s instructions and your records to determine the correct category rather than guessing from a statement’s shorthand or grouping all sales together.
  4. Check whether direct Schedule D reporting is allowed. Some transactions with basis reported to the IRS and no adjustments may qualify for an exception to Form 8949. Confirm that the transaction satisfies the precise exception requirements in the 2025 instructions, or the instructions for the year being filed. If it does not, report it through Form 8949 as instructed.
  5. Complete Form 8949 where required. Enter the transaction information and any required adjustment using the form’s current-year instructions. The 2025 instructions explain how to handle amounts reported on Forms 1099-B, 1099-DA, and 1099-S; use the instructions rather than assuming that a broker’s reported basis or proceeds need no review.
  6. Transfer applicable totals to Schedule D. Carry the Form 8949 totals to the corresponding Schedule D parts, add other required Schedule D entries, and complete any applicable worksheets. Short-term and long-term amounts remain separately categorized on the forms before Schedule D determines the overall result.
  7. Include any prior-year capital loss carryover. Report the carryover on Schedule D as directed. Use the Capital Loss Carryover Worksheet in Publication 550 or the Schedule D instructions to determine the amount and its short-term and long-term components.
  8. Determine the deductible loss and report it. If Schedule D shows an overall net loss, apply the annual limit for your filing status and report the deductible amount on line 7a of the applicable Form 1040, Form 1040-SR, or Form 1040-NR. If the loss exceeds the amount currently deductible, calculate any carryforward using the IRS worksheet.

How Form 8949 and Schedule D fit together

Form 8949 and Schedule D serve different purposes. Form 8949 provides transaction-level detail and the means to reconcile reported information; Schedule D aggregates the relevant figures and calculates the overall capital result. A taxpayer who uses a Form 8949 exception still needs to follow Schedule D’s instructions for reporting those qualifying transactions.

Use Form 8949 when detail or an adjustment is required

When a transaction belongs on Form 8949, report it in the part that matches its holding-period category. Keep supporting documents for the figures and adjustments entered. If an information return reports proceeds or basis that differ from what you determine belongs on the tax return, follow the current form instructions for reconciling the amounts; do not simply omit a discrepancy.

Use a direct Schedule D exception only when it applies

The 2025 instructions permit direct Schedule D reporting for some transactions when basis was reported to the IRS and there are no adjustments, but both conditions and any other stated requirements must be met. A transaction that appears similar may not qualify if an adjustment is needed. When in doubt, consult the precise instructions for the transaction and tax year rather than treating the exception as blanket permission to skip Form 8949.

What happens to capital losses you cannot deduct this year?

An eligible net capital loss that exceeds the amount deductible in the current year can generally be carried forward to a later year. It is not necessarily lost, but the carryforward must be computed and reported correctly. The IRS provides a Capital Loss Carryover Worksheet in Publication 550 and a worksheet in the Schedule D instructions to calculate the amounts carried forward, including their short-term and long-term components.

Keep prior-year returns and supporting records. The carryover calculation depends on prior-year amounts, and the worksheet requires the relevant information from those returns. Do not estimate the carryforward from the amount of a prior-year sale alone or assume that the full unused economic loss is available unchanged: use the IRS worksheet and the applicable-year instructions.

When is an economic loss not a deductible capital loss?

A financial loss and a deductible tax loss are not always the same. The rules depend on the asset and the transaction. In particular, losses on personal-use property are generally nondeductible. The fact that an item was sold for less than it cost does not by itself establish a deductible capital loss.

The Form 8949 instructions also address certain Form 1099-K transactions where an offsetting adjustment is needed so that a reported nondeductible loss is not claimed as a deduction. If a payment platform or other payer reports a transaction, determine what the payment represented and how it should be treated before entering a loss. Do not treat the information return alone as proof that the transaction produced a deductible loss.

Other transaction-specific questions—including whether an asset is a capital asset, whether a particular loss is deductible, whether an adjustment is required, and the correct holding-period category—cannot be resolved from the general filing sequence alone. Consult the instructions that apply to the facts and tax year or get qualified tax help when the treatment is uncertain.

What to verify before filing a 2025 return

  • Confirm you are using the forms and instructions for the tax year you are filing. IRS forms, instructions, line references, and rules can change by year.
  • Check that every transaction is classified as short-term or long-term using the records and applicable instructions.
  • Reconcile transaction proceeds and basis with Forms 1099-B, 1099-DA, or 1099-S, and enter adjustments as directed.
  • Use a direct Schedule D exception only if the transaction meets all conditions stated in the current instructions.
  • Review whether personal-use property or a transaction reported on Form 1099-K creates a nondeductible loss that should not reduce taxable income.
  • Carry forward any prior-year loss using the IRS worksheet, with prior returns available to support the calculation.
  • Check that the Schedule D result, filing status, deduction limit, and Form 1040-family line are consistent.

The 2025 Form 8949 instructions were listed by the IRS as posted January 22, 2026. Digital-asset reporting is changing across tax years, and those 2025 instructions refer to Form 1099-DA; check the revision for the actual year being filed rather than relying on an earlier form or a prior-year workflow.
