How to Report a Change in Incarceration Status to Social Security

Report incarceration or release to Social Security by phone. Benefit rules differ for SSI and retirement, survivors, and disability benefits, and release does not guarantee automatic restart.

Call Social Security at 1-800-772-1213 to report that you or a family member has entered jail, prison, or another form of legal confinement, or has been released. If the person receives Supplemental Security Income (SSI), the recipient or representative payee generally must report a change within 10 calendar days after the month it happened. For a release, have official release papers available if possible. Social Security reviews each case; release does not guarantee that benefits will restart automatically.

How to report the change

  1. Identify the benefit. Find out whether the person receives Social Security retirement, survivors, or disability benefits (often called Title II benefits), SSI, or both. The rules differ, so tell Social Security about each benefit the person receives. If you are helping a family member, it is useful to establish which program or programs are involved before you call; an answer about one benefit does not automatically answer what happens to another.
  2. Call Social Security. Use 1-800-772-1213. The Social Security Administration (SSA) lists phone service Monday through Friday, 8 a.m. to 7 p.m. in most U.S. time zones, in English, Spanish, and other languages. The agency’s public incarceration guidance directs people to report the change by phone.
  3. Explain what changed. Say whether the person entered confinement or was released, give the relevant date, and identify the institution or release circumstances. These details help SSA review the effect on the person’s benefits. Confirm with SSA what information it needs for the specific benefit and case. If the change involved more than one event, explain the sequence and dates as clearly as you can rather than assuming SSA already has the details.
  4. For a release, ask how to provide proof. SSA identifies official release papers as proof of release. If the papers are not available, call and ask how SSA can verify the release; its operational guidance contemplates assistance in obtaining release documents. Do not treat a missing document as a reason to postpone telling SSA about the release.
  5. Ask what happens next. Ask whether SSA needs more information and what the person should expect regarding eligibility and payments. SSA must assess the benefit type, confinement or release details, and continuing eligibility before determining whether payments can resume. Ask specifically whether any additional documents are needed and how SSA will handle the individual case; do not assume a payment date based only on the date of release or the date of the call.

These instructions reflect SSA’s consumer-facing incarceration guidance, checked October 9, 2026. The agency’s direction is to report when you or a family member is incarcerated or released. The number and hours above are the public phone route and hours SSA lists; if a call is made outside those hours, use the listed hours to plan when to contact the agency.

What incarceration can mean for each benefit

Reporting is important, but the effect on payments depends on the benefit and circumstances. The following is a general comparison, not a decision about an individual case.

Benefit When confinement can affect payment What release may mean
Social Security retirement, survivors, or disability benefits (Title II) SSA’s general rule is that benefits stop when a person is convicted and confined in jail or prison for more than 30 continuous days. Eligible family members receiving benefits on that person’s record may continue receiving their benefits. SSA policy allows reinstatement after an official release, parole, or pardon in qualifying cases. A release report and review are still needed; payment is not guaranteed to restart automatically.
Supplemental Security Income (SSI) SSI is not payable for any full calendar month a recipient spends in a public institution. A confinement of 12 consecutive months or longer means the person must file a new SSI application and be approved again. Payments may be restarted after release, subject to SSA’s review of eligibility. Income, resources, and living arrangements can also affect SSI eligibility.

These are different thresholds: the Title II rule described above concerns conviction and more than 30 continuous days of confinement; the SSI rule concerns any full calendar month in a public institution. SSA’s public guidance and operational policy also address qualifying home-confinement arrangements, so do not assume that every setting has the same payment effect. If the circumstances do not fit the basic examples, describe the setting and status to SSA and ask how the rules apply.

Title II: conviction, length of confinement, and family benefits

The more-than-30-day rule is not simply a rule that every person who spends a certain number of days in any setting automatically loses every Social Security benefit. SSA describes the general suspension rule in terms of a person who is convicted and confined in jail or prison for more than 30 continuous days. The conviction, the length of continuous confinement, and the correctional setting are all relevant details to report. If the person is in a different status or setting, such as a qualifying home-confinement arrangement, ask SSA to assess it rather than applying the general rule on your own.

The effect on the incarcerated person’s own Title II payment is also different from the effect on eligible family members receiving benefits on that person’s record. SSA says qualifying family members may continue to receive their benefits when the worker’s or beneficiary’s own payment stops. That does not mean every family member qualifies in every case or that the incarcerated person’s payment continues. If more than one person’s payment is involved, ask SSA separately about the person’s own benefit and the family members’ benefits.

For a release, SSA operational policy allows reinstatement in qualifying cases after official release, parole, or pardon. These terms describe circumstances SSA may consider; they are not a guarantee that payment will resume without a report or review. Contact SSA with the actual status and date, provide release papers when available, and ask what further review is needed.

SSI: calendar months and continued eligibility

SSI uses a different confinement rule. The payment restriction applies for any full calendar month the recipient spends in a public institution. A calendar month runs from the first day through the last day of that month, so the rule is not interchangeable with the Title II rule of more than 30 continuous days. The exact dates and setting matter, and SSA should review the person’s case.

Release can make restart consideration possible, but it does not by itself show that the person still meets all SSI requirements. SSA notes that income, resources, and living arrangements can affect SSI eligibility. Those factors may have changed during confinement or around release. Tell SSA about the release and ask what information it needs to determine whether the person qualifies and whether payments may restart.

Long confinement has an additional consequence for SSI: after 12 consecutive months or longer in confinement, the person must file a new SSI application and be approved again. This is more than a routine restart of the old payment. The person should contact SSA about the application and eligibility steps rather than expecting a release report alone to restore SSI.

When to report an SSI change

Under SSA’s 2026 Program Operations Manual System guidance for SSI, a report is generally due within 10 calendar days after the month in which the change occurred. For example, if a reportable change occurs in April, the general deadline is 10 calendar days after April ends. The deadline applies to the reporting of the change; it is not a promise about when a payment will stop or restart.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The SSI recipient or representative payee generally has responsibility for reporting. A representative payee is someone who receives and manages benefits on behalf of a recipient. If the recipient cannot make the report, the payee should not assume that someone else has already told SSA; confirm who is handling the report and contact the agency promptly. If you are a family member assisting with the call, explain your relationship and ask SSA how the report should be made for that case.

This is an SSI reporting deadline, not a single deadline to apply to every Social Security benefit. SSA separately asks people to report incarceration or release. For a Title II benefit, do not use the SSI deadline as a reason to wait or to assume that a report made by that point resolves the case. Report the event promptly, then ask SSA what applies to the specific benefit.

If a change happens near the end of a month, the general SSI rule still measures the reporting period from the end of that month. For instance, a reportable event on April 2 and one on April 29 both fall in April for purposes of the general “10 calendar days after the month” wording. This example explains the calendar calculation; SSA determines whether a particular event is reportable and how it affects the person’s case.

Planning for release from custody

If the correctional facility has an SSA prerelease agreement, the person or a facility representative may begin contacting SSA as much as 90 days before the scheduled release. This is an opportunity to coordinate ahead of release, not a replacement for reporting the change or establishing eligibility. The point of starting before release is to give the person and facility a chance to contact SSA and ask about the process before the scheduled date arrives.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask the facility whether it has an SSA prerelease agreement and whether it can help contact SSA or obtain release documentation. The agreement is a condition for using this early-contact option; it is not a promise that a benefit will be approved or restarted. If the facility does not have an agreement, do not assume that the person is barred from reporting or asking SSA about next steps. If no agreement is in place, or the release is unexpected, contact SSA directly using the phone number above.

When release is scheduled, the person or facility representative can ask SSA what proof and information it will need. SSA identifies official release papers as proof for release. Because SSA reviews cases individually, an early conversation does not guarantee that every question can be resolved before the person leaves custody. Follow up with SSA about any documentation still needed once release occurs.

What to prepare before calling

Having the relevant details at hand can make it easier to explain the change. SSA determines what documentation or additional information is needed for an individual case. This list is a preparation aid, not a claim that SSA requires every item in every case.

  • The person’s benefit type: Title II, SSI, or both. If you are unsure, say so and ask SSA to help identify which benefit or benefits the call concerns.
  • Whether the person entered confinement or was released, and the date of that change. If there were multiple events, note the dates in order.
  • The institution or, for a release, the circumstances of release. Be ready to explain the status as accurately as possible, including whether the report concerns confinement, release, parole, or pardon.
  • Official release papers, if reporting a release and the papers are available. If they are not, tell SSA that and ask how it can verify the release.
  • Any questions about payment status, next steps, or documents SSA still needs. It can help to ask what the agency is reviewing and what you should do after the call.

Keep the call focused on the change and on what SSA needs to decide the case. You do not need to guess at the legal or benefit outcome before contacting the agency. Give the dates and circumstances you know, identify uncertainties honestly, and ask SSA which additional details or evidence are relevant.

Common reporting problems

The person does not have release papers

Do not assume that the release cannot be reported. Call SSA, explain that the papers are unavailable, and ask how the agency can verify the release. SSA’s operational guidance contemplates help obtaining release documents. The public guidance identifies release papers as proof, but SSA can tell you what to do in the individual case if they cannot be provided at the time of the call.

The person has more than one kind of benefit

Tell SSA about both benefits if the person receives Title II and SSI. Their confinement rules differ, so a decision about one benefit does not establish what happens to the other. For example, a determination about Title II’s conviction and continuous-confinement threshold is not a determination about SSI’s full-calendar-month rule. Ask SSA to address each benefit and any separate eligibility questions.

The person expects payments to resume immediately

Report the release and ask SSA what it needs to review the case. A release makes restart consideration possible; it does not itself establish continuing eligibility or an automatic payment date. SSA may need to review the benefit type, the circumstances of confinement and release, and continued eligibility. If the person has not received a payment, ask SSA whether it is waiting for information or making an eligibility determination rather than assuming the report alone triggers immediate payment.

A family member’s payment is tied to the incarcerated person’s record

For Title II benefits, eligible family members receiving benefits on the person’s record may continue to receive them even when the incarcerated person’s own benefits stop. Ask SSA how the person’s specific record and family benefits are affected. Do not infer that a family member’s payment is suspended just because the primary beneficiary’s payment is affected, or that every family member is automatically eligible to continue receiving payments.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The person’s circumstances do not match the usual example

Do not decide on your own that a rule does or does not apply because the person is in a setting other than a conventional jail or prison, or because the person’s status is not a straightforward release. SSA’s operational policy includes qualifying home-confinement arrangements and reinstatement situations involving official release, parole, or pardon. Explain the actual circumstances to SSA and ask for a case-specific determination.

The family is unsure whether to call before release

If the facility has an SSA prerelease agreement and release is scheduled, contact may begin up to 90 days in advance through the person or a facility representative. That planning window is separate from the deadline for reporting an SSI change after it occurs. If there is no agreement, the release is unplanned, or you are uncertain about the process, contact SSA directly rather than waiting for a later notice.

A practical way to think through the report

Three questions help keep the report clear: Which benefit? Which event and date? What proof or follow-up does SSA need? First separate Title II from SSI, including whether the person receives both. Next tell SSA whether the change is entry into confinement or release and provide the date and setting. For a release, have official release papers ready if possible. Then ask what SSA will review, whether it needs more documentation, and what the person should do next.

These questions matter because the rules use different measures. The general Title II suspension rule addresses conviction and more than 30 continuous days in jail or prison. The SSI rule addresses any full calendar month spent in a public institution, and a confinement period of 12 consecutive months or longer requires a new SSI application and approval. A prerelease agreement may permit contact as much as 90 days before a scheduled release, while the SSI reporting rule generally gives 10 calendar days after the month of a change. None of those time periods should be substituted for another.

SSA’s current public Incarceration guidance and its FAQ dated October 7, 2022, provide consumer-facing information about these issues; SSA’s 2026 POMS SI 02301.005 sets out the SSI reporting timeframe. The agency’s operational policies address additional reinstatement and setting-specific details. SSA determines each person’s eligibility and payment timing, so use the rules as a guide to the questions to ask—not as a substitute for contacting the agency about the individual case.

Frequently Asked Questions

How do I report that someone was released from jail or prison to Social Security?

Call Social Security at 1-800-772-1213 and report the release, its date, and the circumstances. Have official release papers available if possible. If you do not have them, ask SSA how it can verify the release and what else it needs. A release report does not guarantee automatic payment restart.

Will SSI restart after someone is released from prison?

SSI payments may be restarted after release, but SSA must review the person’s continuing eligibility, including factors such as income, resources, and living arrangements. If the person was confined for 12 consecutive months or longer, they must file a new SSI application and be approved again.

When does incarceration stop Social Security benefits?

The general Title II rule is that benefits stop when a person is convicted and confined in jail or prison for more than 30 continuous days. For SSI, payment is unavailable for any full calendar month spent in a public institution. The rules differ, and SSA should assess the person’s circumstances.

How long do I have to report an SSI change?

An SSI recipient or representative payee generally must report a change within 10 calendar days after the month in which it occurred. This is the SSI reporting deadline; it is not a promise about when a payment changes or restarts.

Can Social Security benefits be arranged before release?

If the facility has an SSA prerelease agreement, the person or a facility representative may begin contacting SSA as much as 90 days before a scheduled release. This allows advance coordination but does not guarantee eligibility or payment. Without an agreement, contact SSA directly.

Can family members keep receiving benefits on an incarcerated person’s record?

Eligible family members receiving Title II benefits on that person’s record may continue receiving their benefits even when the incarcerated person’s own benefits stop. SSA must determine how the specific record and family benefits are affected.

The Bottom Line

Report an incarceration or release promptly by calling Social Security at 1-800-772-1213. Identify whether the person receives Title II benefits, SSI, or both, and provide the dates and circumstances. For release, have official papers available or ask SSA how it can verify the release. SSI has a general reporting deadline of 10 calendar days after the month of a change; a facility with an SSA prerelease agreement may begin contact up to 90 days before scheduled release. Because benefit rules and restart requirements differ, only SSA can determine the person’s eligibility and payment timing.
