How to Reply to a GST Notice and Avoid Missing the Response Deadline

GST notices do not share one reply deadline or form. Identify the cited provision, follow the notice’s instructions, support your response with records and save filing proof.

To reply to a GST notice in India, first identify the provision, notice form and deadline stated in the complete notice, then prepare a point-by-point response with supporting records and submit it through the channel specified in the notice and current GST Portal instructions. There is no single response period or reply form for every GST notice. Record the service date and stated due date immediately; do not assume a standard 30-day window.

What should you do as soon as a GST notice arrives?

  1. Save the complete notice. Download or scan every page and attachment, and preserve any evidence showing when and how it was served. A summary or portal alert may not contain all the allegations or directions.
  2. Record the key details. Note the GSTIN, issuing officer, case or reference number, tax period, cited section, notice form, proposed tax, interest and penalty, requested documents, hearing information and response date.
  3. Set an earlier reminder. Work toward filing before the stated due date, leaving time to resolve portal or document problems.
  4. Check the applicable procedure. Use the section and form cited in the notice to identify the reply form and submission method. If the deadline is missing, unclear or appears inconsistent with the applicable procedure, seek qualified advice or contact the issuing office promptly rather than relying on an assumed default period.

Do not treat the words “GST notice” as enough to determine what to file. The Central Goods and Services Tax Act, 2017 and its rules establish different routes for different proceedings; the notice and its attachments tell you which route is being used.

Which form do you use to reply to a GST notice?

These examples illustrate why the cited provision and notice form matter. They do not cover every GST proceeding, and you should verify the notice against the current law and portal instructions.

The material cited here does not establish one universal response period for every ASMT-10 notice. Check the date in your notice and the applicable current procedure.
Demand proceeding with a DRC-01 summary CGST Rule 142 describes DRC-01 as an electronic summary accompanying specified notices. It prescribes DRC-06 for the reply or representation. Do not confuse a payment option or payment period in a particular route with the deadline to file a reply. Follow the deadline for your proceeding.
Section 63 notice to an unregistered taxable person, in ASMT-14 CBIC’s assessment-rules guidance describes a section 63 notice in ASMT-14 and an ASMT-15 order that may follow. That CBIC guidance specifies 15 days to respond to the ASMT-14 notice. It is a route-specific example, not the deadline for all GST notices; check the current notice and law.

The CGST Rules material describing DRC forms may be an older amended compilation, so confirm the current rule and form before filing. The form named in an online summary is not a substitute for reading the underlying notice and attachments.

How do you find a GST notice on the portal?

Sign in to the GST Portal and look for the logged-in area for additional notices or orders. GSTN material describes this area as a place to access additional notices and orders, including DRC-01. Portal labels and screens can change, so use the current portal guidance if the menu names do not match older instructions.

Download the available documents rather than relying only on an alert or summary. Keep the notice, attachments, proof of service, your submitted reply and the portal acknowledgment or reference number together in one case file.

How should you draft a point-by-point reply?

  1. Break the notice into allegations or questions. Number each issue and identify the period and amount involved, if stated.
  2. State your position on each point. Say whether you accept it, dispute it or need clarification. Avoid broad denials that do not address the facts raised.
  3. Explain the factual and legal basis. Connect your explanation to the records and the provision relevant to the issue. Do not make admissions casually or assert facts you cannot support.
  4. Reconcile amounts to records. Where figures differ, show how the amounts in the notice compare with the relevant returns, invoices, payments, reconciliations or input-tax-credit records.
  5. Label and cross-reference attachments. Give each document a clear name or number and refer to it beside the point it supports. Upload relevant evidence rather than an unexplained bulk collection.

Sections 73 and 74 of the CGST Act concern show-cause proceedings for specified tax demands. The Act distinguishes cases involving fraud, wilful misstatement or suppression from other cases. That distinction can affect the legal route and makes it especially important not to treat a demand notice as a routine discrepancy query.

How do you file the reply and keep proof?

Use the form and submission channel directed by the notice and current GST Portal instructions. For specified demand proceedings summarized in DRC-01, Rule 142 identifies DRC-06 for the reply or representation. For a scrutiny discrepancy notice, GSTN identifies ASMT-11 as the taxpayer reply form for ASMT-10.

Before submitting, check that the response addresses each point, that attachments open and are legible, and that you have selected the correct proceeding and tax period. After filing, save the final response exactly as submitted and the portal acknowledgment or reference number. If the portal does not accept the reply, preserve evidence of the error and seek help immediately; do not assume that an attempted upload counts as a filed response.

Is the 30-day payment period the reply deadline?

Not necessarily. Rule 142 describes DRC-03 payment intimation and DRC-04 acknowledgment, and, in specified circumstances under sections 73 or 74, payment within 30 days may be intimated in DRC-03, followed by DRC-05 concluding proceedings. This is a rule-specific payment route, not a general instruction to pay every notice and not a universal period for replying. Check whether that route applies to your notice before deciding whether or how to pay.

When should you get professional help?

Ask a qualified GST practitioner or tax lawyer to review the matter promptly if it involves a fraud, wilful-misstatement or suppression allegation; substantial proposed tax, interest or penalty; conflicting reconciliations; multiple periods or registrations; a personal hearing; a limitation issue; or an order already issued. An order is a different stage from a notice, so check the document’s nature and any available response or appeal route without delay.

Practical deadline checklist

  • Complete notice and attachments saved.
  • Service date, stated due date, section, form and proceeding recorded.
  • Applicable reply form and submission channel checked against current instructions.
  • Response organized by allegation, with relevant records labelled and attached.
  • Internal filing reminder set before the due date.
  • Submitted reply and portal acknowledgment retained.

The safest approach is to work from the actual notice, not a generic deadline found online. The correct form and time limit depend on the proceeding and the applicable current rules.
