How to Locate and Request Online Probate Court Records

Start with the court that handled the estate, check whether its portal covers probate records, and contact the clerk when a case or document is not available online.

To find probate records online, start with the court in the county or jurisdiction where the estate was handled, then search that court’s official probate index or docket. If the portal does not cover probate cases or lacks the document you need, contact the court clerk to ask how to inspect the file or order a copy. Court systems differ, and no search result online does not prove that no probate case exists.

How do I find probate records online?

  1. Identify the court that handled the estate. Probate files are maintained by the court system responsible for the estate. Depending on where the decedent lived or the estate was administered, it may be called a probate court, Surrogate’s Court, or another name. In New York, for example, wills and other probate records are filed with county Surrogate’s Courts; use the New York court locator to find the relevant county court. The court’s location and local rules determine where to search.
  2. Open the court’s official case search or docket. Search by the decedent’s name; add a case number or approximate dates if you have them. Use the court’s own portal or follow its instructions for requesting a search from the clerk. In the District of Columbia, DC Courts’ Remote Public Access provides decedent-estate docket information. The court says the online docket information is the same information mailed in response to a search request.
  3. Check whether the portal includes probate and what it displays. Some portals do not include probate cases at all; others show docket entries but not document images. Arizona’s eAccess, for example, excludes Superior Court probate records. A portal’s search scope and document availability are not the same thing.
  4. Follow the court’s access rules. Electronic access can depend on your role, approval, or the document’s status. Connecticut Probate Courts limit eFiling access; self-represented users need court approval and an access code to access electronic documents. Documents marked sealed require a court order to unseal. Check the Connecticut Probate Courts’ eFiling guidance before assuming you can view a file online.
  5. If the case or image is missing, contact the clerk. Give the decedent’s full name and any alternate spellings, approximate dates, case number if known, and the exact document you want. Ask whether the file is paper, stored offsite, restricted, or available for inspection on a public-access computer. Then ask how to request a copy and whether certification is available.

What can an online probate search show?

A docket is a record of case activity; a document image is a copy of an item in the court file. A system may provide one without the other. For example, DC Remote Public Access supplies docket information, while the court provides a separate route for requesting copies. Connecticut’s system limits electronic document access, and Arizona eAccess does not include probate records. Confirm what the specific court portal covers before treating a partial result as the complete file.

How can I request a copy of a will or probate document?

When a document is not available to view or download online, ask the probate clerk which request methods the court accepts. Depending on the court, you may be able to request a copy online, by mail, or in person. Specify whether you need an ordinary copy or a certified copy; certification may have a separate process and charge.

Example: Miami-Dade County, Florida

The Miami-Dade Clerk’s probate-copy instructions describe online, mail, and in-person requests for certified probate copies. For a mail request, the clerk asks for the case number or book and page, year, party names, a self-addressed stamped envelope, and applicable payment. Its published page lists $1 per page and $2 per document for certification for mail requests, with a possible search fee if the year or case number is unknown. These are Miami-Dade figures, not a national rate; confirm current fees and payment instructions with the clerk before sending a request.

Example: District of Columbia

DC Courts provides a separate copy-request route for probate matters. Open cases and cases no more than ten years old are kept on site, while some older closed files are held in storage and must be retrieved. Contact the Probate Division to confirm current charges, retrieval arrangements, and expected timing. The court’s page says using Remote Public Access avoids the $10 mailed search fee; verify the current terms directly with the court.

What if the probate case isn’t online?

A missing result can mean the portal does not cover probate, the file is offline or in storage, or access is restricted. It is not reliable proof that no estate was opened. Contact the clerk for the county or court that handled the estate and ask whether it can search its own index or paper files. Arizona directs people seeking Superior Court probate records to the Clerk of Superior Court in the county where the case was filed; Connecticut notes that documents marked offline may need to be viewed through the paper file or a public-access computer.

In New York, probate records such as wills are kept by county Surrogate’s Courts. The records may be available at the courthouse, where appointments or fees may apply. Use the state’s court locator to contact the appropriate county court and ask about its procedures before visiting.

What should I confirm before submitting a request?

  • Correct court and county: Confirm which court handled the estate and whether it maintains the record.
  • Search details: Ask what information the clerk needs, such as full names, dates, case number, or book and page.
  • Record format and access: Find out whether the record is an online image, paper file, offsite file, sealed document, or otherwise restricted.
  • Copy type: State whether you need a plain copy or a certified copy, and confirm certification availability.
  • Request channel and delivery: Verify whether the court accepts online, mail, or in-person requests and how it delivers copies.
  • Current charges and timing: Ask about search, copy, certification, and retrieval fees, accepted payment methods, and expected processing time before paying or mailing anything.
