Evaluate an AI mortgage tool by the work it performs, the authority it has over a decision, the evidence that it works for your applicants and workflow, and your ability to control it after launch. A lender remains responsible for credit decisions and required notices: an opaque model does not excuse an inaccurate adverse-action explanation. For a covered automated valuation model (AVM) use, the applicable quality-control standards also require specific controls. Treat vendor demonstrations as the start of diligence—not proof of compliance or performance.

Start with the tool’s role, not its AI label

“AI mortgage software” can describe systems doing very different jobs: extracting information from applications, summarizing documents, flagging missing items, communicating with applicants, estimating property values, assigning risk scores, recommending underwriting outcomes, or supporting pricing. The risk depends on the system’s actual function and its place in the lending process—not on the name a vendor gives it.

Before comparing products, document the use case and decision path. Identify what data enters the system, what transformations it performs, what output it produces, who reviews that output, and what happens downstream. Record whether the system is advisory or can affect a credit decision, pricing, collateral valuation, applicant communication, or processing priority. A tool that only identifies a missing document has a different decision role from one whose score materially shapes an underwriting outcome.

Map each use to the real mortgage workflow. The CFPB mortgage origination examination procedures cover disclosures and terms, appraisals, and underwriting. Use those process areas to locate the system’s inputs, outputs, human handoffs, and effects on the borrower; do not assess an abstract score detached from how a loan is originated.

  • Authority: Does it organize information, recommend an action, or contribute to an actual decision? Who has authority to accept, reject, or override its output?
  • Data path: What sources are used, how are they transformed, and where are outputs stored or passed on?
  • Consumer impact: Could an error delay an application, change a valuation, affect terms, or contribute to a denial?

These answers define what evidence to request, what to test in a pilot, and which controls must continue after deployment. They also keep a broad vendor claim from being mistaken for proof about your particular use.

Can a lender use AI to deny a mortgage?

The cited CFPB guidance does not create a blanket exemption from existing creditor duties for decisions made with AI. A lender may use complex algorithms in credit decisions, but it must still provide specific, accurate principal reasons for adverse action. The CFPB’s Circular 2022-03 says the obligation applies regardless of the technology used; not understanding the creditor’s own method is not a defense.

CFPB Director Rohit Chopra put the point plainly in the Bureau’s September 19, 2023 announcement on credit denials involving AI: “Creditors must be able to specifically explain their reasons for denial. There is no special exemption for artificial intelligence.”

For procurement, the practical question is not whether a vendor can produce an explanation in a demo. It is whether the lender can identify the actual principal factors considered in a real decision and generate a notice that accurately reflects them. A generic reason code, broad category, vendor-generated explanation, or item selected from a sample checklist is not necessarily sufficient if it does not match the actual reason. An explanation feature is useful only if the lender can validate it against the decision process and use it reliably in its own notices and review procedures.

Build a use-case-specific evidence package

Ask the vendor for evidence tied to the task, applicant population, and operating conditions you have defined. A general benchmark or marketing statement may be a useful lead, but it does not establish performance for your applicants, data, integrations, or process. NIST’s AI Risk Management Framework Core describes measurement practices that include assessment, benchmarking, monitoring, uncertainty, documentation, and independent review.

Ask how the system was developed and evaluated

  • What are the sources and provenance of training, tuning, and evaluation data? What use rights and restrictions apply?
  • What population and operating context does the evidence represent? Where does that differ from the lender’s intended use?
  • How was evaluation designed, and what benchmark was selected? Why is that benchmark relevant to this task?
  • What uncertainty, known limitations, failure modes, and out-of-scope cases have been documented?
  • How does performance change when inputs are missing, conflicting, unusually formatted, or outside the conditions represented in testing?
  • What has changed across model, data, or workflow updates, and what evidence supports each material change?

Examine outcomes and errors, not just a headline metric

Request performance results that expose the error patterns relevant to the system’s role. Depending on the task, that may mean checking extraction errors against source documents, incorrect flags, missed exceptions, valuation uncertainty, or the relationship between recommendations and subsequent human decisions. Ask for results segmented in ways that let the lender evaluate differences in outcomes and errors, subject to appropriate legal, privacy, and statistical review. A single aggregate figure can hide performance that varies across the applicants, properties, or workflow conditions that matter to the institution.

Ask who performed the validation, whether it was independent of development, what data and assumptions it used, and what conclusions or limitations were recorded. The lender needs enough documentation and access to judge the evidence rather than simply accept a vendor’s assurance. The appropriate depth depends on the risk, use, and institution; the OCC’s revised model-risk guidance, dated April 17, 2026, emphasizes a risk-based approach rather than prescribing one identical process for every model or organization.

Test adverse-action explanations before a credit-impacting launch

If a system contributes to a credit decision, make notice accuracy a deployment gate. Test the complete path from input and model output through human review and the lender’s notice process. Confirm that the stated principal reasons reflect factors actually considered—not merely factors associated with the outcome or available as convenient labels.

  1. Trace the decision: For each test case, preserve the relevant inputs, transformations, output, reviewer action, override if any, and downstream decision.
  2. Include difficult cases: Test borderline outcomes, decisions with multiple contributing factors, data errors, missing information, and cases in which a reviewer disagrees with the system.
  3. Check reason fidelity: Compare the resulting principal reasons with the factors actually considered in the case. Investigate any generic, misleading, incomplete, or unstable explanation.
  4. Exercise the notice workflow: Confirm who reviews the reasons, how errors are corrected, and how a final notice is generated and retained.
  5. Repeat after changes: Re-run relevant tests when the model, data, decision logic, integrations, or workflow changes.

The CFPB’s 2023 announcement cautions that sample reasons do not satisfy the law if they fail to accurately reflect the actual reason. Build the test around that standard rather than treating a vendor’s list of supported reason codes as proof.

Apply AVM controls when the use is covered

If an automated valuation model is used in a covered mortgage credit decision or securitization determination, assess the institution’s policies, procedures, and controls against the interagency final rule. The CFPB’s AVM rule summary identifies quality-control standards addressing confidence in estimates, protection against data manipulation, conflicts of interest, random sample testing and reviews, and compliance with applicable nondiscrimination laws.

Ask both the vendor and internal owners how the controls work in practice. Establish who reviews confidence or uncertainty, who checks for manipulation and conflicts, how samples are selected and reviewed, and how nondiscrimination compliance is addressed. Identify what evidence the vendor supplies and how the institution evaluates it; outsourcing the valuation function does not answer who owns the lender’s controls. Confirm the exact use falls within the rule’s coverage rather than applying the AVM requirements indiscriminately to every tool that processes property information.

Evaluate the human and operational workflow

A useful pilot tests exceptions and recovery, not only routine examples. Map how the system behaves when documents are missing, inputs conflict, a result is uncertain, an integration fails, or a reviewer identifies an error. For each handoff, define who acts, what information they see, how they document the action, and how a borrower can correct information or escalate a problem where appropriate.

Set operating controls before the pilot

  • Define which outputs require human review and which cases must be routed to an exception queue.
  • Specify who can override a result, what reason must be recorded, and how overrides are monitored.
  • Set escalation paths for suspected errors, consumer-impacting incidents, data problems, and service outages.
  • Identify who can pause or roll back deployment and what fallback process staff use while the system is unavailable.
  • Require approval and testing for material changes to models, data, prompts, integrations, or workflow logic, as applicable to the system.
  • Determine which logs and records are needed to investigate errors, validate performance, explain decisions, and respond to examination.

Measure the workflow benefit alongside the controls needed to achieve it. For example, if the intended benefit is fewer manual document checks, define how the pilot will measure that task and how staff will identify missed or misclassified documents. Do not let a processing-time improvement stand in for evidence that decisions, consumer treatment, and exception handling remain acceptable.

NIST organizes lifecycle risk management into Govern, Map, Measure, and Manage. Its framework presents GOVERN as cross-cutting across the other functions, rather than a one-time approval step. The NIST AI RMF is voluntary and is being revised; check the current framework status and version when using it. It is a useful organizing framework, not a substitute for applicable legal requirements or institution-specific controls.

Assess vendors and contract protections

Vendor diligence should establish what the lender can inspect and control throughout the relationship. Ask what applicant or loan data the provider retains, whether it reuses that data, how subcontractors are involved, and how the provider manages model and data changes. Determine whether the lender can export records needed for validation, consumer explanations, monitoring, and examination.

Translate answers into written contractual and operational commitments. Depending on the system’s risk and role, address change notification, access to documentation and logs, audit rights, incident disclosure, service levels, business continuity, exit assistance, and the return or deletion of data. Clarify how the lender will receive enough information to investigate a performance issue and what happens if the provider cannot supply agreed evidence.

The OCC’s April 17, 2026 bulletin discusses model development and use, validation and monitoring, governance and controls, and third-party products. It rescinds specified prior OCC model-risk issuances, is non-prescriptive, and excludes generative and agentic AI from its scope. It is guidance—not a new binding AI rule or product certification. Apply its risk-based principles in context, and do not assume its stated scope resolves obligations that may apply under other laws, regulations, or supervisory expectations.

Compare shortlisted tools on the same dimensions

Use a common evaluation record for each candidate. The following dimensions synthesize the cited risk-management and regulatory materials; they are not a regulator-issued checklist or legal opinion.

Dimension What to compare Evidence or decision to capture
Workflow fit Exact task, borrower and property population, decision role, integration point, and downstream effects Documented process map, system boundaries, decision authority, and intended-use limits
Evidence Data provenance, independent validation, uncertainty, benchmark relevance, segment-level performance, and update history Evaluation materials, known limitations, error analysis, and rationale for relevance to the lender’s use
Consumer protection Adverse-action reason fidelity, fair-lending review, privacy and data handling, and applicant correction or escalation paths Test results and documented review processes appropriate to the system and use
Operations Human review, exception handling, resilience, monitoring, logging, change control, and rollback Named owners, operating procedures, escalation routes, fallback arrangements, and records
Vendor governance Auditability, documentation access, subcontractors, incident notice, contract rights, exit, and continuity Contract commitments and practical evidence the lender can obtain and retain
Total operational fit Integration effort, staff training, measurable workflow benefit, and controls needed to sustain safe use Pilot criteria, implementation responsibilities, and ongoing resource requirements

Turn the framework into pilot acceptance criteria

Before a pilot begins, state what evidence will count as success, what failures stop the pilot, and who makes those calls. Criteria should be specific to the tool’s task and risks; the official materials do not establish a universal performance threshold for all mortgage AI systems.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Scope: List the approved task, data, applicant and property contexts, users, and prohibited or untested uses.
  • Evidence: Identify the validation materials and performance results required, including the conditions and segments the team will examine.
  • Decision controls: For credit-impacting systems, require successful adverse-action reason tests using difficult cases before production use.
  • AVM controls: Where the use is covered, identify evidence and owners for each applicable quality-control standard.
  • Workflow: Define exception routing, override documentation, correction and escalation paths, outage handling, and rollback authority.
  • Change management: Specify which changes require notice, reassessment, approval, or renewed testing.
  • Records and accountability: Name owners for monitoring, incident response, vendor evidence, and retained records.

A pilot should expose whether the vendor can support the lender’s required controls and whether staff can operate them. If evidence is unavailable, a failure cannot be explained, or the workflow cannot recover safely, treat that as an unresolved risk—not as an issue to defer automatically until after launch.

Keep oversight active after deployment

Approval is not the end of evaluation. Monitor performance and exceptions against the use case, investigate shifts in data or workflow, and review material changes before relying on them. Revisit whether the system is still used for the approved purpose and whether the lender can still obtain the records and explanations required to oversee it. Set escalation and pause criteria in advance so a serious failure does not depend on informal judgment in the moment.

NIST’s lifecycle framing and the OCC’s risk-based model-risk guidance both support ongoing governance, validation, monitoring, and controls suited to use. Because the OCC bulletin is non-prescriptive and excludes generative and agentic AI, institutions should not treat it as a complete rulebook for every AI system. Determine the applicable obligations and oversight expectations for each deployment.
