How to Estimate the Tax Bill Before Selling Timber

A timber sale tax estimate starts with the contract and adjusted depletion basis—not a universal tax rate. Learn how standing sales, cutting contracts and section 631(a) elections affect the calculation.

There is no single tax rate for a timber sale. To estimate your federal tax, first identify how the deal is structured, calculate the adjusted depletion basis of the timber involved, and determine the income’s tax character. Then combine that result with your tax-year income, filing status, deductions and other relevant facts. The steps below provide a planning estimate, not a personalized tax calculation; state and local treatment also depends on where you live and where the timber is located.

Start with the transaction, not a tax rate

“Selling timber” can mean several different transactions. You might sell standing timber outright, enter a cutting contract while retaining an economic interest, cut timber yourself under a section 631(a) election, or sell logs or other products after cutting. Those routes can differ in when income is recognized, how gain is characterized and which records or forms are relevant.

As an Amazon Associate I earn from qualifying purchases.

Before estimating tax, read the signed agreement and identify what is being sold, who owns the timber during cutting, how the buyer pays, and when the timber is treated as sold or cut under the applicable rules. A lump-sum payment, pay-as-cut terms, or money paid in advance may affect the analysis. Do not assume that the words “timber sale” in a contract establish the tax treatment by themselves.

Arrangement Key question Federal tax framework described by the IRS
Outright sale of standing timber Did the landowner sell the standing timber, and when and how is payment made? Some outright sales by landowners can qualify for capital-gain treatment under rules similar to qualifying section 631(b) dispositions. The transaction details matter.
Cutting contract with retained economic interest Does the seller own the timber, meet the more-than-one-year holding-period condition, and have an expected return conditioned on cutting? A qualifying disposition may receive section 1231 treatment. The amount realized less adjusted depletion basis is reported with section 1231 items on Form 4797 and evaluated under the applicable rules.
Seller cuts timber under section 631(a) Is the taxpayer eligible to elect, and has an election already been made? The election can treat cutting as a sale or exchange in the cutting year. Gain or loss is measured using beginning-of-year fair market value and adjusted depletion basis; the later sale of the cut timber generally produces ordinary business income or loss.
Sale of cut logs or other products Did the seller cut the timber and sell products such as logs, firewood or pulpwood? The treatment can differ from a standing-timber sale. IRS Publication 544 notes that some farmers with no cost or other basis treat receipts and cutting or hauling expenses as ordinary farm income and expenses.

This is a decision aid, not a substitute for classifying the actual contract. In particular, “timber is always taxed as a capital gain” is not a reliable assumption. Publication 225 and Publication 544 describe federal rules and examples, but your facts determine whether a particular route qualifies.

Build a worksheet from the records you have

Collect the figures before applying a tax rate. Missing timber quantities or basis records can make even a simple-looking sale estimate unreliable. Keep the amount and the source of each figure together in your worksheet.

Worksheet input What to collect Why it matters
Contract and sale terms Executed sale or cutting agreement; whether the deal is lump sum, pay-as-cut or paid in advance; who cuts; payment dates; and the contract’s timber measurement rule. Terms can affect classification, timing and the amount realized.
Proceeds and transaction costs Gross proceeds and dates received; direct sale, cruising, logging or contract expenses; and how each cost is treated for tax purposes. The starting gain calculation uses amount realized, with transaction costs and other adjustments treated under the applicable rules.
Timber quantity Volume sold or cut, unit of measure, cruise or scale information, and any growth, inventory or quantity corrections. The depletion unit applies to timber units, so the quantity and the basis account must use consistent, documented measures.
Timber basis account Acquisition date and method, timber/land basis allocation, prior account schedules, timber acquisitions and capital additions, and prior depletion. The deductible basis is the adjusted basis assigned to the timber, not the entire purchase price of the land.
Taxpayer and election facts Tax year, filing status, other income, deductions, relevant prior-year section 1231 items, and any prior section 631(a) election or revocation. These facts affect the final federal tax and may affect whether an election or treatment is available.
Jurisdictions State of residence and location of the timber property. State and local taxes require separate review under the rules for the relevant jurisdictions.

IRS basis guidance says timber basis generally begins with cost but may differ for inherited or gifted property and may change because of later events. If you bought land and timber together, do not assign the entire land purchase price to timber without support. Locate the allocation used when the property was acquired and any later timber-account schedules.

Calculate adjusted timber depletion basis

Timber depletion basis is the portion of the timber account’s adjusted basis associated with the timber cut or sold. It is not the same thing as the land’s full cost, and it is not automatically the gross sale price. IRS Publication 225 describes a depletion unit: divide the adjusted basis in the timber account by the timber units in that account after relevant quantity corrections, then apply the per-unit amount to the units cut or sold, as appropriate.

Use a consistent unit and account

Timber may be measured in board feet, log scale, cords or another supported unit. Use the unit and measurement method reflected in your timber records, and make sure the account’s quantity and the sale or cutting quantity can be compared. If a cruise, scale or inventory is corrected, document the adjustment and apply the method consistently. If the property has separate timber blocks or accounts, use the account that corresponds to the timber involved rather than averaging unrelated property without support.

Apply the depletion-unit formula

  1. Determine the adjusted basis in the timber account, including relevant timber acquisitions and capital additions.
  2. Determine the timber units remaining in that account after relevant quantity corrections.
  3. Divide adjusted account basis by the account’s timber units to calculate basis per unit.
  4. Multiply that depletion unit by the applicable units cut or sold, following the rules for the transaction and tax year.

For illustration, the IRS’s 2025 Publication 225 example divides $24,000 of adjusted timber basis by 300,000 timber units, producing a depletion unit of $0.08. For 27,000 units cut and sold, the example calculates $2,160 of depletion. These are IRS example figures, not a benchmark for another property or a forecast of anyone’s tax bill.

The same IRS illustration distinguishes cutting from selling: if 27,000 units were cut but only 20,000 sold, it allows $1,600 as that year’s depletion and includes the remaining $560 in closing inventory. That example shows why “units cut” and “units sold” should not be treated as interchangeable in every calculation. Apply the rule appropriate to your transaction and keep supporting quantity records.

Do not substitute percentage depletion for this calculation: the IRS says percentage depletion is unavailable for standing timber.

Estimate gain under the route that fits your deal

After classifying the transaction and calculating the relevant adjusted depletion basis, make a separate gain estimate. A useful starting point for a qualifying standing-timber disposition is amount realized minus adjusted depletion basis. Account for transaction costs and other tax adjustments under the rules that apply to the particular transaction; do not automatically subtract every expense in the same way.

Outright standing-timber sale

Publication 225 says outright sales of standing timber by landowners can qualify for capital-gain treatment under rules similar to qualifying section 631(b) dispositions. The payment structure and timing can matter. For a planning worksheet, record the amount realized, the timber depletion basis associated with the sale, and the expenses or other adjustments that your tax treatment permits. Do not assume that every lump-sum or pay-as-cut arrangement qualifies just because the timber was standing when negotiations began.

Qualifying cutting contract and section 1231

Publication 544 describes section 1231 treatment for a qualifying cutting-contract disposition when the seller owns the timber, held it for more than one year before disposition, and retained an economic interest. In this context, the expected return is conditioned on cutting. The amount realized less adjusted depletion basis is reported with section 1231 items on Form 4797. Its final character is determined alongside other section 1231 gains and losses under the applicable rules; the term “section 1231 gain” does not by itself tell you the rate that will apply.

Section 631(a) election when the seller cuts

A taxpayer who owned the timber or held the contractual right to cut it for more than one year may be able to elect section 631(a) treatment when cutting timber for sale or business use. Instead of treating cash received later as the entire gain, the election measures gain or loss at cutting using the fair market value of the cut timber on the first day of the tax year and its adjusted depletion basis. The IRS states in Publication 225 (2025): “Your gain or loss on the cutting of standing timber is the difference between its adjusted basis for depletion and its FMV on the first day of your tax year in which it is cut.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Under this election, the fair market value used at cutting becomes basis in the cut timber. Its later sale generally produces ordinary business income or loss. The election is made on the return for the year of cutting, cannot be made on an amended return, and generally carries forward unless revoked under applicable rules. Include prior election history in the worksheet; the choice can affect later years as well as the immediate calculation.

Publication 225 and Publication 544 include an IRS example of a $1,240,000 section 1231 gain: $1,400,000 fair market value on January 1 minus $160,000 adjusted depletion basis for 4,000 MBF owned more than a year and cut in April 2025 under a section 631(a) election. That is a worked IRS example, not a typical result or a prediction for another sale.

Cut products and business activity

If you cut and sell logs, firewood, pulpwood or other products, the analysis may not match an outright sale of standing timber. Publication 544 notes that some farmers who cut timber and sell products with no cost or other basis treat amounts realized and cutting and hauling expenses as ordinary farm income and expenses. This is a fact-specific illustration, not a rule to apply to every landowner who sells logs.

Turn taxable gain into a tax estimate

Gain and tax are different calculations. First determine the amount and character of the taxable income under the transaction rules. Then estimate the tax using the applicable tax year and your complete return facts. A section 1231 gain, for example, is not taxed at one universal timber rate: Form 4797 reports it with other section 1231 items so that it can be evaluated as capital or ordinary gain under the applicable rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Your estimate therefore needs more than the timber sale number. Filing status, other income, prior-year section 1231 items, deductions and the tax year can change the result. The materials here do not establish a rate that can be applied to every seller, and no single percentage of gross proceeds is a dependable substitute for the return calculation.

For an initial planning worksheet, keep these lines separate:

  • Proceeds: record the amount realized and when it is received.
  • Timber basis: calculate adjusted depletion basis for the units and account involved.
  • Permitted adjustments: list transaction costs and other tax adjustments separately, with their treatment confirmed for your deal.
  • Tax character: identify the applicable route—such as qualifying section 631(b), section 1231 treatment, section 631(a), or ordinary business or farm income treatment—rather than labeling all timber proceeds as capital gain.
  • Whole-return estimate: apply the relevant tax-year rules to your income, deductions, filing status and other tax items.
  • Jurisdictional estimate: add state and local income tax only after checking the rules for your residence and property location.

This sequence can produce a reasoned estimate, but it cannot calculate a personal tax bill without the contract, basis records, timber quantities, election history, applicable tax year and the taxpayer’s return information.

Keep records that support the estimate and return

IRS Form T instructions generally call for Form T when claiming timber depletion, making a section 631(a) election, or making an outright sale under section 631(b). The instructions describe an exception for an occasional sale—one or two sales every three or four years—but adequate records are still important. Confirm the form and instructions applicable to the year you file. The Form T instructions page is labeled December 2013, while the IRS landing page points to the current revision; do not assume an older instruction page settles every current-year filing detail.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Maintain a file that ties the contract, quantity, basis and tax treatment together. Useful records include:

  • Acquisition date and method, timber/land basis allocation, and prior timber-account schedules.
  • Separate timber block or account details, species, timber units, measurement rules, growth and inventory adjustments, acreage and volume cut.
  • The signed sale or cutting agreement, payment records, sale proceeds, direct costs, and the basis for any transaction adjustments claimed.
  • Prior depletion calculations and any section 631(a) election or revocation history.
  • Valuation evidence used when fair market value at the beginning of the tax year is relevant.

For a section 631(a) valuation, the Form T instructions call out factors that affect timber value: quantity, species, quality, quantity per acre, tree size, logging conditions and distance to markets. They also identify comparable timber sales around the valuation date and supporting valuation evidence as relevant records. A bare estimate without its assumptions and supporting information can be difficult to substantiate.

When a professional review is especially useful

Consider having the contract and timber account reviewed before signing or filing if the sale combines land and timber, the basis allocation is unclear, the deal has staged or advance payments, timber is sold pay-as-cut, a section 631(a) election may apply, or the transaction includes cutting and product sales. A tax adviser or preparer familiar with timber transactions can assess tax classification and return treatment. A consulting forester or timber appraiser may help document volume or valuation when those figures are uncertain. These roles address different parts of the estimate; neither replaces complete records or the taxpayer-specific return calculation.

Use the federal framework above as a way to organize the facts, not as a state-tax answer. No state or locality is specified here, and the rules and forms can change by tax year. For filing, check current IRS publications and Form T materials for the year at issue and confirm jurisdiction-specific tax treatment separately.
